a. Move that the City set a hearing for the consideration of a policy decision
regarding prevailing wage rates, monitoring, enforcement and cost related
thereto, for any City participating contracts.
b. Move that the Commission set a hearing for the consideration of a policy
decision regarding prevailing wage rates, monitoring, enforcement and cost
related thereto, for any Commission participating contracts.

STAFF REPORT
On November 7, 1985, Mr. Joe Doyle, Business Manager for Local Union #477, along with
representatives from the developers and contractors of the Schurgin Center (Best and
Marshalls) met with the Redevelopment Committee to discuss the prevailing wage rate
language in Agency contrac~
If federal funds are used on a project, as in CDBG projects, Davis-Bacon legislation
applies. Contractors must supply certified copies of payroll records to the Agency,
When tax increment funds are used, prevailing wage rate language is incorporated into
the contracts, but the Agency does not require submittal of certified payroll records,
and does not monitor the contracts. The contractor himself is responsible for
whatever monitoring method he choses to assure compliance. The Agency does have the
right to enforce compliance. City contracts that do not use federal funds contain
similar language.
Mr. Doyle expressed his concern that the contracts are not monitored unless a
complaint is registered.
The Redevelopment Committee recommended that an item be placed on the Agenda to set a
hearing for both Commission and City to consider a policy decision regarding
prevailing wage rates, monitoring, enforcement and costs relating thereto.
Staff recommends that a date for said hearing be determined.
