STAFF REPORT
It is required that a Right-of-Way Certificate be provided for
Federal-aid projects.
The City of San Bernardino enters into many Federal Aid
projects and with each project a Right-of-Way Certification
must be provided assuring that we, the City, do in fact have
the right-of-way within the area of construction. It appears
to us tha t there coul d be ti me saved by the Engi neeri ng
Department, City Administrator, City Attorney, City Clerk, and
Mayor and Common Council if the Director of Public Works/City
Engineer was given authorization to sign the Right-of-Way
Certificate which is a routine item.
We have checked with Caltrans. They have advised that other
ci ties use thi s procedure. Therefore, we recommend that the
Resol uti on be passed.

OF THE CITY OF SAN BERNARDINO, AUTHORIZING
EXECUTION OF RIGHT-OF-WAY CERTIFICATES BY THE
PUBLIC WORKS DIRECTOR/CITY ENGINEER

WHEREAS, Federal regulations require that an agency
performing work under a Federal~aid project shall provide a
Right-of-Way Certificate assuring the Federal Highway
Administration (FHWA) that the agency has acquired all of the

right-Of-way necessary for such Federal-aid project and that
said right-of-way was acquired in accordance with the applicable
Federal regulations; and
WHEREAS, Right-Of-Way Certificates are required before such
projects may be advertised; and
WHEREAS, the City of San Bernardino participates in Federal-
aid projects from time to time.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Common
Council of the Ci ty of San Bernardino, Cal ifornia, hereby

authorizes the Public Works Director/City Engineer, for the City
of San Bernardino, to execute Right-af-Way Certificates on
behalf of the City of San Bernardino for submission to the
Department of Transportation, State of California, for public
works projects involving Federal and/or State funding.
