F...J. c.. +'.J ,.., {...L +-- 't ~ Aqenda Item NO,~C::;. 75-0262 Clk OF SAN BERNARDQo - REQU~T FOR COUNCIL ~ON STAFF REPORT The Roberti-Z'berg-Harris Urban Open Space and Recreation Program portion of the 1984 Bond Act allocates $65,181 to the City of San Bernardino for FY 85/86. Local assistance grants under this part of the Bond Act require a minimum of 25% matching funds. After evaluation of needs in all our parks, this department is recommending the following project: Wildwood Park- Elks Field: (Ward 4) This location has no restrooms. At the present time, patrons of athletic events at this field must walk across the parking lot into the Park proper for restroom facilities. This presents a problem for some parents and small children attending evening events because the park is not lighted sufficiently the entire distance between the field and the restrooms. The proposal is to construct restrooms with handicapped facilities and vandal resistant fixtures adjoining the existing concession/scorers booth/ storage building. The estimated cost for this project is ~2,OOO. (See attached application.) A proposal for a second project to construct new restroom facilities at Perris Hill Park will be submitted at a later date. These projects have been discussed and recommended by the Parks and Recreation Commission and this department staff recommends submission of the application for local assistance grants. RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE 2 APPLICATION FOR BLOCK GRANT FUNDS UNDER THE PROVISIONS OF THE 3 ROBERTI-Z'BERG-HARRIS URBAN OPEN-SPACE AND RECREATION PROGRAM FOR THE CONSTRUCTION OF RESTROOM FACILITIES AT ELKS FIELD, WILDWOOD 4 PARK . BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 5 OF SAN BERNARDINO AS FOLLOWS: 6 7 SECTION 1. Recitals. (a) The people of the State of California have enacted the 8 ROberti-Z'Berg-Harris Urban Open-Space and Recreation Program Act 9 (Public Resources Code Sections 5620, et seq.) which provided ]0 funds to the State of California and local agencies for acquiring ]] lands and developing facilities for public outdoor recreation ]2 purposes. ]3 (b) The State Department of Parks and Recreation has been ]4 delegated the responsibility to administer the program, and to ]5 establish procedures governing application by local agencies for ] 6 funds. ]7 (c) Procedures established by the State Department of Parks ]8 and Recreation requires the applicant to authorize by resolution ]9 the filing of applications for funding. 20 (d) Public Resources Code Section 5626 requires grant 2] applicants to certify compliance with certain laws and 22 regulations. 23 (e) Adopted procedures require the applicant to have 24 adopted a plan showing parks and recreation lands and ~aci1ities, 25 existing and proposed. 26 (f) The City's General Plan was first adopted by the Mayor 27 and Common Council on October 3, 1964. 28 / / / / / / / / 1 l,.. /' " /'.' "-' -- 1 (g) The proposed project at Wildwood Park appears on the 2 City's General Plan. The Plan is consistent with the California 3 Outdoor Recreation Resources Plan and is in conformity with the 4 State Environmental Goals and Policy Report. 5 (h) The project is compatible with the land use plans of 6 those jurisdictions immediately surrounding the project. 7 SECTION 2. The Mayor and Common Council approve the filing 8 of applications for grant assistance under the Roberti-Z'Berg- 9 Harris Urban Open-Space and Recreation Program Act. ]0 SECTION 3. The Mayor and Common Council certify that the ]] City of San Bernardino understands the certifications set forth ]2 in the application, and authorize the City Attorney to make the ]3 certifications. ]4 SECTION 4. The Mayor and Common Council certify that the ]5 City of San Bernardino has or will have sufficient funds to ]6 operate and maintain the project. 17 SECTION 5. The Mayor and Common Council certify that the ]8 City of San Bernardino meets the planning requirements and that ]9 the project is compatible with the land use plans of those 20 jurisdictions immediately surrounding the project. 21 SECTION 6. The Director of Parks, Recreation and Community 22 Services Department of the City of San Bernardino is authorized 23 and direoted to execute on behalf 'of the City application for 24 block grant funds under the provisions of the Roberti-Z'Berg- 25 Harris Urban Open-Space and Recreation Program, a copy of which 26 is attached, marked Exhibit -A- . The Director of the Parks, 27 Recreation and Community Services Department is authorized to 28 administer any grant funds which may be received, and to provide 2 \.. ,.' Assurances The applicant hereby gives assurances and certifies with respect to the grant that: It possesses legal authority to apply for the grant, and to finance, acquire and construct the proposed project; that a resolution. motion or similar action has been duly adopted or passed as an official act of the applicant's go.....erning body, authorizing the filing of 'the application, including all understandings and assurances contained therein, and c;recting and authorizing the person identified as the official representative of the applicant to act in connection with th~ application and to provide such additional information as may be rE'quired. It will provide and maintain competent and adequate architectural engineering superVISion and inspection at the con- struction site to insure that the completed work conforms with the approved plans and specifications; that it will furnish progress reports and such other information as the State may require. It will give the State's authorized representative access to and the right to examine all records, books, papers, or document related to the grant. It will cause work on the project to be commenced within a reasonable timp after receipt of notification from the State that funds have been approved and that the project will be pursued to completion with reasonable diligence." It will not dispose of or encumber its title or other intrests in the site and facilities without permission from the State Legislature. It will comply where applicable with provisions of the California Environmental Quality Act and any other State, and/or local laws, rules and/or regulations. In cases involving leased property. it agrees to maintain and operate the property and/or facilities acquired or developed for an agreed to period commensurate with the type of project and the proportion of state grant funds and local funds allocated to the capital costs of the project.
