Dear Mayor and Council Members:
Attached for your consideration and execution are three (3)
copies of a proposed Freeway Agreement between the City of
San Bernardino and the State of California for a portion of
Route 30 in the City of San Bernardino.
We are able to present this for formal execution at this time
because the Federal Highway Administration, on August 9, 1985,
approved the basic design features proposed for the project.
The proposed Freeway Agreement itself does not include all of
the detailed design features which have been under discussion
with the City. This is because we limit Freeway Agreements to
matters relating to the treatment of local roads or streets,
such as closures, separations, connections to the freeway,
frontage roads, etc., as provided in the Streets and Highways
Code.
The following features noted in the City Council's Resolution
dated June 19, 1985 or by the City's letter dated March 29,
1985 will be included in the freeway construction or otherwise
handled as described below:
1. The "I" Street grade separation has been deleted.
2. A grade separation on 27th Street, connecting to Muscott
Street, has been added, and the proposed Flores Street
grade separation has been deleted.
3. Landscaping plans that are mutually acceptable will be
developed, utilizing an aesthetics committee as noted in
the City Resoltuion. Landscaping treatment will be equal
on both sides of Route 215.

4. The connector between Highland Avenue and Route 215 will
be developed as a four-lane facility, and include signal-
ization at its terminus at Highland Avenue.
5. The needs for signalization at the "H" Street Interchange
will be studied, as well as mitigation of traffic impacts
on 30th Street at ~\uscupiabe Drive and at Miramonte Avenue.
6. Local drainage and potential flooding problems will be
studied and resolved.
It is only necessary to execute and return the original and one
copy of the Agreement to this office. The remaining copy is
for your records, pending return of a fully executed copy of the
document.
A certified copy of the resolution adopted by the City Council
authorizing the Mayor's signature should be attached to each of
the returned executed Agreements. Enclosed are three forms for
this resolution, if you care to use them.
I would like to express my appreciation to Council Members Dan
Frazier and Gordon Quiel,and to the City engineering staff, for
their assistance during the environmental assessment process.

FREEWAY AGREEMENT
THIS AGREEMENT, made and entered into on this
day of

19____, by and between the,STATE OF CALIFORNIA, acting by and through
the Department of Transportation (herein referred to as "STATE"), and
the City of San Bernardino (herein referred to as "CITY"),
WITNESSETH:
WHEREAS, the highway described above has been declared to be a
freeway by Resolution of the California Transportation Commission on
May 22, 1963: and
WHEREAS, STATE and CITY have entered into a Freeway Agreement
dated March 18, 1969, relating to that portion of State Highway
Route 30 from the west city limit to Route 259: and
WHEREAS, a revised plan map for such freeway has been prepared
showing the proposed plan of the STATE as it affects streets of the
CITY: and
WHEREAS, it is the mutual desire of the parties hereto to enter
into a new Freeway Agreement in accordance with the revised plan of
said freeway:

NOW, THEREFORE, IT IS AGREED:
1. This Agreement supersedes that portion of said Freeway
Agreement dated March 18, 1969, on Route 30 from Highland Avenue
to ~H~ Street.
2. CITY agrees and consents to the closing of CITY streets,
relocation of CITY streets, construction of frontage roads and
other local roads, and oth~r construction affecting CITY streets,
all as shown on said plan map attached hereto marked Exhibit A and
made a part hereof by this reference.
3. STATE shall, in construction of the freeway and at STATE'S
expense, make such changes affecting CITY streets in accordance with
the plan map attached hereto marked Exhibit A.
4. STATE agrees to acquire all necessary right of way as may
be required for construction, reconstruction, or alteration of CITY
streets, frontage roads, and other local roads, and CITY authorizes
STATE to acquire in its behalf all such necessary right of way.
5. It is understood between the parties that the right of way
may be acquired in sections or units, and that both as to the
acquisition of right of way and the construction of the freeway
projects, the obligations of STATE hereunder shall be carried out
at such time and for such unit or units of the project as funds
are budgeted and made lawfully available for such expenditures.

6. CITY will accept control and maintenance over each of the
relocated or con5tructed CITY streets, and the frontage roads, and
other STATE constructed local roads on receipt of written notice to
CITY from STATE that the work thereon has been completed, except for
any portion w~icb is adopted by STATE as a part of the freeway proper.
CITY will accept title to the portions of such roads lying outside
the freeway limits, upon relinquishment by STATE.
7. This Agreement may be modified at any time by the mutual
consent of the parties hereto, as may become necessary for the
best accomplishment, through STATE and CITY cooperation, of the
whole freeway project for the benefit of the people of the STATE
and of the CITY.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement
to be executed by their respective duly authorized officers.
