Synopsis of Previous Council action:
10-6-87 --- The City Clerk and City Engineerwere authorized to proceed to initiate
proceedings for the formation of an Assessment District for this area
under the provi sions of the 1913/15 Act.
Recommended motion:
That the City Engineer and City Clerk are authorized to proceed with expanding the
scope of Assessment District No. 985 by including the construction of curbs, gutters,
paving, Street lights and landscaping in portions of the East side of Palm Avenue
between the A. T.& S.F. Railroad and Industrial Parkway.

STAFF REPORT
Letters of petition have been received by this office for the installation of curbs,
gutters, paving and street lights in portions of Industrial Parkway, Southeasterly of
Palm Avenue and the signatures affixed to the letters have been checked and found to
represent 90.86% of the area of the property to be assesed for the proposed
improvement.

On October 6, 1987, evidence of these letters of petition was submitted to your
Honorable Body and the City Clerk and City Engineer were authorized to proceed with
initiating proceedings for the proposed assessment district under the provisions of
the 1913/15 Act.
Subsequent to the original request, one of the parcels has been sold and is presently
in escrow. The developement of this parcel requires certain improvements to be
accomplished along the East side of Palm Avenue between the Railroad right of way and
Industrial Parkway. On November 16, 1987, both the present owner and future owner
have requested that those improvements be included in the proposed assessment district
and that the cost therefore be assessed directly and only to the parcel in question.
This office has no problem with the request and therefore recommends that the new
improvements be included in the proposed district to be assessed only against the
parcel in question.
The developer will be required to up-front the cost of the proceedings, Bond Counsel
and Financial Counsultant fees for establishment of the district which will be
returned to him when the Bonds are sold.
