At its regularly scheduled meeting of September 10, 1987, the
Environmental Review Committee recommended approval of the
Negative Declaration for Public Works Project 87-15.
Previous Council Action:
On September 8, 1987, the Council made the finding that Public Works
Project 87-15, is necessary for the health and safety of the public.
Recommemled motion:
Adopt the Negative Declaration for Public Works Project 87-15 a
vacation of a portion of Belleview Street east of Pico Avenue and
west of Mt. Vernon Avenue.
Adopt a Finding of Consistency with the General Plan.

The portion of Belleview Street to be vacated is located
280 feet east of the centerline of Mt. Vernon Avenue.'
Belleview Street is already interrupted by elevated
railroad tracks which block the street immediately to
the west of the proposed street vacation. Belleview
Street immediately to the east of the proposed vacation
is zoned R-2, Two Family Residential, and is occupied by
single family residences. Land to the west of the
proposed street vacation is zoned M-2, General
Industrial, and is vacant on the north side of Belleview
Street. The south side of Belleview immediately to the
west of the proposed vacation is used as a railroad
storage yard.

The proposed project is in conformity with the General
Plan in that it will not change any proposed land uses
as indicated on the General Plan. Belleview Street is
classified as a local street and as such is not intended
to be a major thoroughfare; moreover, Belleview Street
is already interrupted immediately to the west of the
proposed street vacation.

At its regularly scheduled meeting of September 10,
1987, the Environmental Review Committee recommended a
Negative Declaration for Public Works 87-15.
5 . BACKG.BQ!lND
The parcels immediately to the north and south of the
proposed vacation are zoned M-2, General Industrial, as
equipment and vehicle storage yards for a steel company.
The Public Works Department initiated this proposed
street vacation at the request of the owner of the steel
company who intends to use the vacated area to increase
the area of the company's storage yard. On September 8,
1987, the Common Council made the finding that Public
Works Project 87-15 is necessary for the health and
safety of the public.

6. ANALXSIS
The propsoed street vacation presents three issues for
consideration: potential impacts on traffic
circulation, compatibility with the neighborhood, and
access to public utilities on the site in the event that
repair or maintenance work is necessary.

Belleview Street is classified as a local street and is
already interrupted by elevated railroad tracks
immediately to the west of the proposed vacation.
Therefore the street vacation will have no impact on
traffic circulation in the area.
Compatibility with the Neignp9JP99Q
Although the neighborhood immediately to the east of the
proposed street vacation consists of single family
residences, the land immediately to the north and south
of the proposed vacation is zoned M-2 General Industrial
and is already used as storage and parking areas for a
steel company. The M-2 district also extends to the
west of the proposed vacation. A vacation of a portion
of Belleview for the purpose of expanding an industrial
parking and storage area is consistent with the zoning
and General Plan designation of the area to the north,
west and south.
Any expansion of the industrial parking and storage area
will be subject to a Review of Plans. A requirement to
provide screening of the storage area, perhaps in the
form of wooden slats in the chain link fence, might be
required as a condition of approval in order to reduce
the visual impact of the storage area on this adjacent
residential neighborhood.

commented that Belleview is a local street and is not a
major part of the circulation element as shown on the

Department, the Streets Section of the Public Services
Department and the Atchison Topeka and Santa Fe Railroad
all returned comment sheets expressing no objections to
the proposed street vacation.
8 . CONq,!1.QJ9~1
The proposed street vacat10n will not have any impact on
traffic circulation in the area nor will it prevent
access to any public utilities. The proposal 1S
consistent with the zoning and General Plan designation
of the area. The Development Review CommIttee will have
the option of requiring screening between the site and
the adjacent residential neighborhood. No objections to
the proposal were made by any of the City Departments or
outside agencies that were contacted. The proposal will
have no adverse impacts on the immediate neighborhood
nor on the city as a whole.
9. RECOM!1~MJA'l'I9Ji1
It i,s recommended that the Mayor and Common Council:
1. Adopt the Negative Declaration for Public Works
Project No. 87-15.
2. Adopt a Finding of Consistency with the General
Plan.
