STAFF REPORT
The City's Underground Utility District Committee recommends
the undergrounding of utilities within Mt. Vernon Avenue,
between 9th and 16th Streets.
Rule 20-A of the Public Utilities Commission requires Southern
California Edison Comp~ny to set aside a certain percentage of
their receipts to cover the cost of undergrounding their facil-
ities within districts established by local agencies. Approxi-
mately $314,000 is set aside each year for the City of San
Bernardino.
According to the Edison Company, its estimated cost of their
project will be approximately $500,000 and the work to be done
within this area will be done at no cost to the City of San
Bernardino. We recommend that the district be approved and
the resolution be adopted.
URGENCY CLAUSE:
The public hearing was held on 10-05-87. The hearing was closed
and directions given that the resolution ordering formation of
the district be prepared. Adoption of this resolution at the
10-19-87 meeting will avoid a 2 week delay in getting the utili-
ties undergrounded.

RESOLUTION NO.
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO CREATING UNDERGROUND UTILITY DISTRICT NO. 16,
LOCATED BETWEEN NINTH STREET AND A LINE APPROXIMATELY TWO HUN-
DRED FEET NORTH OF THE NORTH LINE OF SIXTEENTH STREET AND A LINE
APPROXIMATELY 250 FEET EAST AND WEST OF MT. VERNON AVENUE.
WHEREAS, a public hearing was held on October 5, 1987, at
the hour of 10:00 a.m., at the Council Chambers, 300 North "D"
Street, San Bernardino, California, to determine whether the
public necessity, health, safety or welfare requires the for-
mation of an underground Utility District No. 16 located between
Ninth Street and a line approximately two hundred feet north of
the north line of Sixteenth Street and a line approximately 250
feet east and west of Mt. Vernon Avenue, San Bernardino,
Ca1 ifornia; and
WHEREAS, notice of such hearing has been given to all
affected property owners as shown on the last equalized assess-
ment roll and to all utilities concerned in the manner and for
the time required by law; and
WHEREAS, such hearing has been duly and regularly held
and all persons interested have been given an opportunity to be
heard;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO, AS FOLLOWS:
SECTION 1. It is hereby found and determined pursuant to
24 Chapter 13.36 of the San Bernardino Municipal Code of the City
2S of San Bernardino, and to definitions contained therein that
26 the public necessity, health, safety and welfare require the
27 formation of an underground utility district located between
28 Ninth Street and a line approximately two hundred feet north of

the north line of Sixteenth Street and a line approximately

250 feet east and west of ~t. Vernon Avenue, San Bernardino,

California, public streets which are extensively used by the
general public and carry a heavy volume of vehicular traffic,
in order to remove utility poles, overhead wires and associated

structures and to underground utilities along said portions of
~t. Vernon Avenue and Fifth Street.

SECTION 2. An underground utility district to be known
9
as Underground Utility Oistrict No. 16 is hereby established in
that area located between Ninth Street and a line approximately
two hundred feed north of the north line of Sixteenth Street
and a line approximately 250 feet east and west at Mt. Vernon
Avenue.
NOTE: Drawing No. 7309 by the Engineering,Division, Department
of Public Works, City of San Bernardino, is attached hereto and
made a part of this description.
SECTION 3. All poles, overhead wires and associated
overhead structures shall be removed and underground installa-
tions made in said underground utility district within the
following times:
a. Underground installation by utility companies and
property owners and reconnections not later than October 31,
1989.
b. Removal of poles, overhead wires and other associated
structures not later than March 1, 1990.

SECTION 4.
V
The City Clerk is hereby directed to mail a
copy hereof and a copy of Chapter 13.36 of the San Bernardino
Municipal Code at the City of San Bernardino, to all affected
property owners as shown on the last equalized assessm~nt roll
and to all affected utilities within ten (10) days after the
adoption of this resolution.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a
