STAFF REPORT
The City adopted a Minority Business Program in 1981, as
required by the U.S. Department of Transportation for continued
eligibility for Federal-Aid Funds apportioned through the Federal
Highway Administration. This program provides that certain per-
centages of federally-aided contracts will be awarded to a
minority or female business enterprise.
Goals for participation have been set each year since
the program has been in effect. A notice of the program is
published annually in local newspapers.
The 1987 Surface Transportation and Uniform Relocation
Assistance Act states that, for purposes of the Act, women are
presumed to be socially and economically disadvantaged. There-
fore, the Federal Highway Administration has eliminated the
requirement for separate Disadvantaged Businesses (DB) and
Women Business Enterprises'(WBE's) goals. Future projects will
contain only DB goals, of which any or all may be made up of
WBE's. The minimum goal under this act is still 10%, but includes
WBE's.
It will be necessary for the City to modify their program
to reflect the revisions in the act, by adoption of the attached
resolution. We will be required to publish the 90als for the
1987-88 fiscal year in both majority and minority media.
Adoption of a Minority Business Program is required, in
order to be eligible for Federal-Aid Highway Funds. We recommend
that the program be modified.

PUBLIC NOTICE
CITY OF SAN BERNARDINO, CALIFORNIA
DISADVANTAGED BUSINESS PROGRAM
The City of San Bernardino has adopted a policy to increase
Disadvantaged Business Utilization. This policy includes any
program or facility funded by any U.S. Department of Transporta-
tion modal element.
The City has an overall goal of 10% Disadvantaged Business
Enterprise. The goals and a description of how they were set,
are available for public inspection for a period of 30 days
in the City Engineering Division, 300 N. "D" Street (Convention
Center), San Bernardino, California.
The U.S. Department of Transportation and the City of San
Bernardino will accept comments on the goals for 45 days from
the date of this notice. The comments will be for informational
purposes only.

RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
MODIFICATION OF SAN BERNARDINO, CALIFORNIA MINORITY BUSINESS
PROGRAM AND AMENDING EXHIBIT "A" OF RESOLUTION NO. 81-579 TO
DELETE THE NAME OF GLENN WILSON AS LIAISON OFFICER
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
5 OF SAN BERNARDINO AS FOLLOWS:
6 SECTION 1. Pursuant to Resolution No. 81-579 the Director
7 of Public Works/City Engineer is hereby authorized to amend and
8 administer the City Minority Business Program, in accordance
9 with the following:
10 "The City of San Bernardino's Disadvantaged Business (DB)
11 program is hereby modified to comply with the 1987 Surface
12 Transportation and Uniform Relocation Assistance Act which pre-
13 sumes that women are socially and economically disadvantaged
14 individuals whose participation may be counted in attaining DB
15 goals. As such separate Women Business Enterprises (WBE) goals
16 will no longer be used and the terms 'DB and WBE' in the current
17 adopted program shall be understood to mean DB."
18 SECTION 2. Subsection II of Exhibit "A" to Resolution No.
19 81-579 is hereby amended to read as follows:
20 II. Minority Business Enterprises (MBE) Liaison Officer
21 The Director of Public Works/City Engineer (Director) is the
22 MBE Liaison Officer for the City and shall report to the Mayor
23 and Common Council. The Director will be assigned such staff as
24 is necessary to fully implement the provision of 49CFR Part 23
25 and such other MBE programs as may be required.
