Subject: Appeal of Conditional Use Permit No. 87-37
Mayor and Council Meeting of October 5, 1987
BACKGROUND
On August 18, 1987 the Planning Commission, after conducting
a properly noticed, public hearing, approved Conditional Use
Permit No. 87-37 for an off-site alcohol outlet for a conven-
ience store/service station located at the southwest corner
of 33rd and nEn Streets. The service station aspect of the
business has been an on-going operation for several years.

The Police Department submitted comments of no objections to
the proposed Conditional Use Permit for the sale of alcoholic
beverages <Attachment D). The Police Department's recom-
mended security requirements are contained in the standard
requirements.
A letter of protest was received on September 17, 1987 from
Dr. Ina Katz, for the Board of Directors of Congregation
Emanu El Synagogue located at 3512 North nEn Street. Content
of her letter protest states nit would be extremely detri-
mental to the neighborhood in which our synagogue is 10catedn
<Attachment E).
A letter of protest was also received on August 17, 1987
contending that such an operation would be detrimental to the
businesses within the area and cites problems that have
occurred in the past with the existing gas station <Attach-
ment F).
ANALYSIS
The findings necessary for a Conditional Use Permit for the
sale of alcoholic beverages refers to non-adverse impacts to

the surrounding land uses and is deemed compatible with its
surrounding land uses.
The Police report states that they are not in opposition to
the requested A.B.C. license and that there is not an over-
concentration of such uses within the area.
The surrounding area is designated General Commercial on the
City's General Plan and has zoning of C-3 General Commercial.
The requested proposal for the sale of alcoholic beverages is
a retail operation consistent with the permitted uses of the
C-3 zone, subject to the approval of a Conditional Use
Permit.
CONCLUSION
There are supporting statements and findings which support
the approval of the Conditional Use Permit. Letters of
protest and the appeal discuss concerns and accounts which
the surrounding businesses have raised which may support, a
determination in support of denial of the proposed Condi-
tional Use Permit.
Issues such as increased late night traffic, noise and
potential for crime as stated in the letters of protest would
tend to make this site inappropriate for the sale of alco-
holic beverages for off-site consumption. However, state-
ments from the Police Department indicate that the proposed
use is viable and would not place an adverse impact on the
surrounding land uses.
COUNCIL ACTION
The Council may deny the appeal and uphold the Planning
Commission approval of Conditional Use Permit No. 87-37 or
may uphold the appeal and deny Conditional Use Permit No. 87-
37. The Council may make additional conditions of approval.
Further, if the Council chooses to uphold the appeal and deny
Conditional Use permit, negative Findings of Fact must be
articulated to support the denial.
RECOMMENDATION
Staff recommends that the Council deny the appeal and approve
Conditional Use Permit No. 87-37.

1. REQUEST
The applicant is requesting approval to demolish an
existing gasoline station, utilize the existing gasoline
pumps, and construct a mini market offering the sale of
beer and wine for off-site consumption in the C-3A Zone.
2. LOCATION
The subject property is located on the southwest corner
of 33rd Street and E Street on a 0.31 acre site {Exhibit
E>.

(
The proposal is to construct 1290 square foot "Circle K
mini market in the extreme southwest corner of the
property. The two (2) existing pump iSlands are slated
to remain where they are, with a canopy overhead.
(Exhibits "A" and "B").
4.
PARKING AND ~]:g~ULATI9E
The proposed gasoline station will retain access from
North E Street and 33rd Street. Two (2) existing
driveways off of E Street will be consolidated into one
(1) central 36 ' foot wide access. The two (2) existing
drives off of 33rd Street will remain. Five parking
spaces, as required by code, are to be located in front
of the new market structure. One of the spaces will be
designated for handicapped patrons.

The San Bernardino Municipal Code Section 19.24.020 (C)
(l)(a) require a Conditona1 Use Permit prior to
establishing an automobile service station with gasoline
dispensing pumps. The subject property has an existing
service station presently in operation. Consequently a
new Conditional Use Permit is not required for the
dispensing of gasoline. The applicant is required by
Section 19.26.020 (B) 15 to obtain a Conditional Use
Permit in order to sell alcoholic beverage for Off-site
consumption.

6. LANDSCAPI~Q
The ~roposed rehabi1ation of the subject property will
requlre the development of on-site landscaping. At
present the site has none. Future landscaping will be
developed in the front setback areas, along the north
elevation of the proposed structure and along the
southern property line adjacent to an existing structure
on the neighboring parcel. The on-site landscaping
proposed by the applicant exclusive of landscaping
required in the front setback will amount to 890 square
feet (8.1 percent) which is above the 5 percent required
by code. Parking, trash enclosure and landscaping are
provided next to the western property line adjacent to a
vacant parcel.
(
Staff recommends that a six foot high block wall be
required along the west property line to continue the
built environment established by the market structure
and the trash enclosure. A condition of approval has
been added requesting such.

FACILITY OP~EATIQ~
The applicant has indicated that the proposed facility
will be operational 24 hours a day. Store employees
will monitor and police the premises for trash removal
and control as well as for monitoring loitering or other
potential problems. Additionally Circle KZone Managers
inspect each facility daily. Alcoholic beverages will
occupy approximately 10 to 15 percent of the total shelf
space of the store. Staff is of the opinion that such
an amount is incidentia1 to the total operation.
8. AGENCY CQM~E~
The City of San Bernardino Police Department has in-
dicated that they have no objection to the proposed
Conditional Use Permit for the sale of alcoholic bev-
erage for off-site consumption. (See Exhibit "Cn.)
The Department's recommended security requirements are
contained in the standard requirements.

CUP No. 87-37 shall be in effect for a period of 12 months
from the date of approval. However, if no development has been initiated at
the end of the l2-month period, the application shall expire. Additional
time may be approved upon request of the applicant prior to expiration of
the 12-month period. Expiration Date: August 18, 1988.

a. This development shall be required to maintain a minimum of ~ stan-
dard off-street parking spaces.
b. All parking and driving aisles shall be surfaced with two inches of AC
over a suitable base or equivalent as approved by the City Engineer.
Parking spaces shall be striped and have wheel stops installed at least
three feet from any building, wall, fence, property line, or walkway.
c. Whenever an off-street parking area is adjacent to or across an alley
from property zoned residential, a solid decorative wall six feet in
height shall be erected and maintained along the property line so as to
separate the parking area physically from the residentially zoned pro-
perty provided such wall shall be three feet in height when located
within the required front or street side yard setback. Where no front
or street side yard is required, such wall shall be three feet in
height when located within ten feet of the street line.
d. Whenever an off-street parking area is located across the street from
property zoned for resi denti a 1 uses, a sol i d decorati ve wall or equi va-
lent landscape berm not less than three feet in height shall be erected
and maintained along the street side of the lot not closer to the
street than the required depth of the yard in the adjoining residential
'area. No fence or wall located in the front,setback shall obscure the
required front setback landscaping.

REFUSE ENCLOSURES:
Whenever refuse bins are located within or adjacent to a parking area used
by the public, they shall be enclosed by a decorative wall six feet in
height along the rear and sides and screened gate(s) six feet in height
along the front. The enclosure shall not be placed within the required
front or street side yard setback area. Exact location and size of refuse
enclosures are to be determined by the Planning Department and Division of
Public Services Superintendent.

LANDSCAPI NG:
The intent and purpose of this section is to prevent trees and other
landscaping from damaging public improvements.
a. Street trees must be installed at a minimum of 30 feet on center.
Varieties and exact location shall be determined by the Director of
Park and Recreation.

b. All required setbacks abutting a public right-of-way shall be
landscaped (except for walks and driveways which bisect or encroach
upon the required landscape area).
c. Three copies of a landscape plan (including plant material
specifications) shall be submitted to the Planning Department and Park
and Recreation Department for review and approval.
d. All required landscaping shall be protected from parking areas and
shall be provided with automatic sprinkler facilities which shall be
'maintained in an operative condition.
e. Interior planting shall be required and maintained equal to at least '
five percent of the open surfaced parking area excluding the area of
landscaping strip required by subsection "b" and shall include at least
one tree for every five spaces or major fraction thereof. Measurements
shall be computed from the inside of perimeter walls or setback lines.

MECHANICAL EQUIPMENT:
a. Air conditioning and vent ducts shall be directed away from any adja-
cent residential uses.
b. All mechanical equipment located on the roof shall be screened and
located away from adjoining residential uses. Screening design shall
be approved by the Planning Department.
Compliance with all recommendations of the Geology Report shall be required
(i f app 1 i cab 1 e).
Grading and revegetation shall be staged as required by the City Engineer
in order to reduce' the amount of bare soi 1 exposed to preci pitati on.
During construction, the City Engineer may require a fence around all or a
portion of the periphery of the site to minimize wind and debris damage to
adjacent properties. The type of fencing shall be approved by the City
Engineer to assure adequate project site maintenance, clean-up and dust
control.
Within 75 feet of any single-family residential district, the maximum
height of any building shall not exceed one-story or 20 feet unless the
Commission determines that due to unusual topographical or other features,
such restrictive height is not practical.
All utility lines shall be installed underground subject to exceptions
approved by the Planning Department and the City Engineer.
No Certificate of Occupancy shall be issued prior to compliance with these
Standard Requirements as well as all provisions of the San Bernardino
Municipal Code.

All signs shall be in conformance with San Bernardino Municipal Code

a. A single or double door shall be equipped with a double or single
cyl i nder dead bolt. The bolt sh all have a mi ni mum projecti on of 1" and
be constructed so as to repel cutting tool attack.
b. The dead bolt shall have an embedment of at least 3/4" into the strike
receiving the projected bolt. The Cylinder shall have a cylinder
guard, a minimum of five pin tumblers and shall be connected to the
inner portion of the lock by connectirigscrewsof at least 1/4" in
diameter. The recommendation does not apply when panic hardware is
required or an equivalent device is approved by the Building Code.

Double doors shall be equipped as follows:
a. The active leaf of double doors shall be equipped with metal flush
bolts having a minimum embedment of 5/8" into the head and threshho1d
of the door frame. Double doors shall have an astragal constructed of
steel, a minimum of .125" thick which will cover the opening between
the doors. Thi s astraga 1 sh all be a mi ni mum of 2" wi de and extended a
mi ni mum of 1" beyond the edge of the door to whi ch it is attached. The
astragal shall be attached to the outside of the active door by means
of welding or with nonremovable bolts spaced apart on not more than 10"
centers. Hinges for outswinging doors shall be equipped with nonremo-
vable hinge pins or a mechanical inner lock to preclude removal of the
door from the exterior by removing the hinge pins. Strike plates shall
be a minimum of 3i" in length and secured to the jamb with screws a
mi ni mum of 21" in 1 ength .

a. All moveable windows shall be equipped with a locking device and shall
be constructed in a fashion to restrict them from being lifted out of
its track when in closed position.

(1) Wood doors shall have panels a minimum of five-sixteenths (5/16)

Our graveyard shift would feel in great jeopardy from the type of
consumers who would frequent this business in the early morning hours.
Previously a liquor store owner just south of us was murdered during
a robbery. This is basically a residential area, with a bar a block
and a half away and another 24 hr. mini-market 2 blocks south of us.
This would seem to suffice.

Previously we have had problems with the sale of gasoline alone. Once
when their customer backed into our bu.ilding at 3280 North "E" punching
a hole through the exterior and the employees never notified us. Secondly,

The Board of Directors of Cor:v,p:egation Emanu El wi.shes to register'
its opposition to the granting of a Conditional Use Pennit f= the
sale of Alcoholic Beverages and the right to operate twenty-four
hours a day which is being sought by Circle K Minimarkets f= their
location at 33rd and E streets.
Our Board has CXll1Sidered the implications of granting such a pennit
and we find that it ~d be extremely detrimental to the
neighborh:Jod in which our synagogue is located and of which we seem
to be the maj= property owner.
Over a period of years the area on E street between Marshall Blvd.
and the end of E street has eIlCCJW"ltered serious problEm3. J\n
inordinate number of traffic accidents and a growing incidence of
vandalism and =:ime are particularly troublesane. The increased
number of apartments builtin the area has brought a nore transient
populati.cn and with it has oane these and other problEm3 which are of
concern to us and our neighbors. The temple particularly would be
adversely affected by the granting of the pennit. Our many activities
bring people to our buildings during the daytime and the evening
ra.rcs. D-..tring t.'oa day we have CNer two hundred children in
attendance at our scIxJols regularly.
We urge you and the council and planning a::mnission to deny .g;:.:Ff.~

congregation appear at any hearing which is scheduled to be hel~;,'~' -
