Recommended motion:
That the petition from Brown and Mullins, Inc, for inclusion
of the SIMA Project (Parcel Map No. 9506) in the Central City
Assessment District, to finance the cost for undergrounding
utilities, major landscaping nodes, installation and land-
scaping of median islands along "S" Street and relocation of
a water line, be accepted; and authorization granted to issue
Certificates of Occupancy for buildings within this project,
upon submittal of a set aside letter and recordation of an
agreement stipulating these conditions.

STAFF REPORT
SIMA has petitioned the City to include the undergrounding
of utilities in the Central City South Assessment District, This
petition will be backed up by a "set aside" letter from a financial
institution, and an agreement, setting forth these conditions, re-
corded as a covenant on the parcels within Parcel Map No. 9506.
In the event that the Central City South Assessment District is
not formed within two years, then an assessment district would be
established for the SIMA project only.
Items to be included are undergrounding utilities and the
major theme landscaping nodes. Installation and landscaping of
the median islands along "G" Street, and relocation of the water
line will be done by SIMA, but "acquired" by the assessment dis-
trict.
The new tax law raised the question of what percentage of
a bond issue can be used for undergrounding utilities, and still
be tax exempt, This question is presently being researched in
relation to the Central City South Assessment District. Therefore,
inclusion of the utilities within the SIMA Project would not
materially affect the Central City South Assessment District,
There is a distinct possibility that a separate taxable bond may
have to be issued for undergrounding utilities.
We feel the petition for inclusion of the SIMA Project in
the Central City South Assessment District is a reasonable solu-
tion, and recommend that it be accepted,

On behalf of SIMA PARTNERSHIP NUMBER ONE, we hereby petition
the City of San Bernardino to include that certain parcel
of land described as Parcel Map No. 9506, as shown by plat
recorded in Book 119, Pages 31 through 33, inclusive, Records
of San Bernardino County, California, into the proposed
CENTRAL CITY SOUTH ASSESSMENT DISTRICT, and that the fOllowing
improvements for the development of said Parcel Map be installed
through the Assessment District.
These improvements are:
The undergrounding of the existing overhead electrical dis-
tribution lines along that portion of "G" Street as shown
on said Parcel Map No. 9506;
The undergrounding of any distribution lines outside of
the above described parcel of land, required to serve the
property;
The installation of the "Major Entryway Nodes" soft and
hardscape as shown on the Artistic Landscape, Inc., drawings
dated March 31, 1987 revised August 21, 1987 as Job No.
8643, Sheets LC-l and 2 of 2, or as required by the City
of San Bernardino;
We hereby propose to secure a "Set aside" letter from the
Bank of America in an amount sufficient to cover the expense
of the installation of the those improvements as outlined
above.
The "Set-aside" letter shall act as a guarantee that if
the CENTRAL CITY SOUTH ASSESSMENT DISTRICT is not formed
within two (2) years, SIMA PARTNERSHIP NUMBER ONE shall
agree to the formation of a separate Assessment District
for the area of land within said Parcel Map No, 9506.
The undergrounding of the existing electrical distribution
and landscaping improvements shall be deferred until the
formation of an Assessment District.

We further petition that the proposed CENTRAL CITY SOUTH
DISTRICT reimburse SIMA PARTNERSHIP NUMBER ONE for the cost
of the fOllowing improvements already installed at SIMA'S
expense.
These improvements are:
The installation and landscaping of the median islands aIong
"G" Street as shown on the approved Street Improvement Plans
for said Parcel Map No. 9506;
The relocation of the existing water mains and services
within "G" Street made necessary by the re-alignment of
said "G" Street as described by the Water Department letters
to SIMA dated August 13 and September 25, 1987;
The above referenced reimbursement shall be made as a credit
or reduction in the annual assessment fee.
If the proposed CENTRAL CITY SOUTH ASSESSMENT DISTRICT is
not formed, reimbursement shall be made through the formation
of a special Assessment District as outlined above.
If this proposal is acceptable, SIMA is agreeable to entering
into an agreement with the City of San Bernardino setting
forth the above outlined conditions. The agreement shall
be recorded and made a covenant of Parcel Map No. 9506.
Once this agreement has been recorded. the City shall accept
all of the improvements for Parcel Map No. 9506. release
any and all bonds and iesue a Certificate of Occupancy for
all buildings.
