Synopsis of Previous Council action:
On September 8,1987, your Honorable Body adopted the Findings of Need for Health and
Safety Reasons for the Vacation of State Street North of Sheridan Road. The Negative
Decleration submitted by the Environmental Committee was adopted and consistency with
the General Plan was approved.
Recommended motion:
1. That Plan No. 7271 for the vacation of State Street north of Sheridan Road be
approved and the City Engineer and City Clerk be authorized to proceed.
2. Adopt Resolution

STAFF REPORT
A request was received on April 28,1987, to vacate a portion of State Street, North
of Sheridan Road from the owner who adjoins the portion to be vacated relative to a
deve 1 opment. Thi s request represents 50:!; of those owners who adjoi n the street.
At your September 8, 1987 meeting, the Findings of Need as to why the vacation of
State Street North of Sheridan Road is in the public interest of health and safety,
was adopted. At that same meeting, the Negative Declaration submitted by the
Envirionmental Review Committee was adopted and the proposed ~acation was found to be
consistent with the General Plan.

All of the interested City Department Heads and Utility Companies were notified of the
proposal on May 29, 1987 with a reply due by June 26, 1987. The Utility companies have
responded and a reservation for an easement for sanitary sewer and appurtenant
facilities and pulic utility easements was requested. An Ea'~ement for Ingress and
Egress for Lot 4 of Tract No. 12674 will also be reserved.
The proponents have been notified by letter on September 9,,1987 of the requested
reservation for public utility easments and have responded with notification for us to
proceed. The remaining fee of $200.00 will be paid prior to adaption of the final
Resolution Ordering vacation, and it is therefore recommended that favorable
consideration be given to the requested vacation.
The Resolution of Intention, which sets a protest date of November 2, 1987, has been
attached hereto for your action also.

RESOLUTION NO.
A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
TO ORDER THE VACATION OF STATE STREET, NORTH OF SHERIDAN ROAD AND RESERVING
AN EASEMENT FOR SANITARY SEWER AND APPURTENANT FACILItIES AND PUBLIC UTILITY
EASEMENTS THEREON; ALSO RESERVING AN EASEMENT FOR INGRESS AND EGRESS FOR LOT
4 OF TRACT NO. 12674.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. That the ~Iayor and Common Council of the Ci ty of San
Bernardino hereby declares its intention to order the vacation of State
Street, North of Sheridan Road and reserving public utility easements
thereof and an easement for ingress and egress for Lot 4 of Tract No. 12674,
described as follows:
That portion of State Street, as delineated on map of
Tract No. 12674, as recorded in Book 183 of Maps, pages
35-37, records of the County Recorder of San Bernardi no
County,.lying Northerly of the Southwesterly prolongation
of the Southerly line of Lot 5 of said Tract, said
Southerly line also being the Northerly line of Sheridan
Road, 60 feet wi de.
SECTION 2. That the Mayor and Common Council of the Ci ty of San
Bernardino, in vacating the above described portion of said street ,elects
to proceed under and in accordance with the provisions of the "Public
Streets, Highways and Services Vacation Law", being Division 9, Part 3, of
the Streets and Highways Code of the State of Cal ifornia.
SECTION 3. That the hour of 10:00 A.M. on the 2nd day of
November, 1987, in the Council Chamber of the City Hall, San Bernardino,
California, be, and the same hereby is fixed as the time and place when and
where all persons interested in or objecting to the proposed vacation may
appear before the said Mayor and Common Council and offer evidence in
relation thereto. For further particulars as to the proposed vacation of
the hereinbefore described portion of said street, reference is made to that
certain map marked "Plan No. 7271" approved October 5,1987, on file in
the offi ce of the Ci ty Cl erk of said Ci ty.

SECTION 4. Nothing in this Resolution shall in any way affect or
disturb any existing easements for sanitary sewer anp appurtenant facilities
and for public utility purposes belonging either to the City of San
Bernardino or to any publ ic util i ty and there is hereby reserved for future
general public utility purposes and for this City an easement reasonably
necessary to locate such sanitary sewer and public utility facilities over,
in, under or across the real property hereinabove described and to use,
maintain, repair, replace or renew such faCilities; and an easement for
ingress and egress for Lot 5 of Tract No. 12674.
SECTION 5. That the City Engineer of the City of San Bernardino
hereby is directed to cause Notices of Street Vacation to be posted as
required by the Public Streets, Highways and Services Vacation Law.
SECTION 6. That the City Clerk shall certify to the adoption of
this Resolution of Intention and shall cause the same to be published once a
week for two successive weeks in The Sun, a newspaper published and
circulated in the City of San Bernardino, prior to the date of the above
public hearing.
