BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San Bernardino is hereby
7 authorized and directed to execute on behalf of said City an
8 Agreement with the County of San Bernardino relating to animal
9 shelter services for fiscal year 1984-1985, a copy of which is
10 attached hereto, marked Exhibit "A" and incorporated herein by
11 reference as fully as though set forth at length.

A G R E E MEN T
(animal shelter)
THIS AGREEMENT is effective the 1st day of July, 1984, by and
between the CITY OF SAN BERNARDINO, a municipal corporation,
("City"), and the COUNTY OF SAN BERNARDINO, a subdivision of the
State of California, ("Contracting Agency") .
The parties agree as follows:
1. Recitals.
(a) City has an animal shelter and other facilities for
the handling of animals..
(b) Contracting Agency does not have an animal shelter
or other facilities to handle the impounding or disposal of
animals. City is agreeable to aid and assist Contracting Agency
by impounding, caring for and disposing of animals delivered to
the Animal Shelter by residents of or official representatives of
Contracting Agency according to the provisions of this agreement.
2. Impounding and Disposal of Animals. City shall, through
its Animal Control Department, accept, impound and dispose of
dogs, cats or other animals, which are delivered to City's Animal
Shelter pursuant to this agreement. Such animals shall include
all animals brought to the City Animal Shelter by an agent,
officer, or employee of Contracting Agency apprehended within the
County of San Bernardino. City shall also accept all cats and
loose or stray dogs brought to the City Animal Shelter by anyone
from within the unincorporated area of San Bernardino County or
within the incorporated area of any entity for whom the
Contracting Agency undertakes disposal responsibilities by
contract. However, the Contracting Agency itself shall not

deliver more than twenty (20) dogs in anyone day for impoundment.
Each person delivering an animal shall sign a stub or delivery
3 sheet. City shall, for and on behalf of Contractin~ Agency
4 pursuant to applicable laws, humanely kill, release to the owner,
5 or otherwise dispose of all animals received. No dog or cat shall
6 be killed or disposed of without an attempt to notify the owner if
7 the owner is known by City. No dog or cat shall be killed or
8 disposed of before 72 hours have elapsed from the time the dog or
9 cat was delivered to the Animal Shelter, unless the owner of the
10 dog or cat gives written authorization for earlier disposal.
11 After the 72 hour period has elapsed, City is authorized to
12 dispose of the dog or cat in any manner permitted by law,
13 including City ordinances.

3. Warranty of Lawful Apprehension. Contracting Agency
15 warrants to the City that all animals impounded by its agents,
16 employees or other authorized representatives, have been
17 apprehended and impounded pursuant to existing laws.

4. Payment. Contracting Agency shall pay to City during
19 the period July 1, 1984 through June 30, 1985 for services
20 provided for in this agreement $16.50 for any canine (dog or pup),
21 and $9..00 for any feline (cat or kitten) delivered to City by
22 Contracting Agency. Additionally, Contracting Agency shall pay
23 to City for livestock animals delivered to the City under the
24 terms of this agreement the following fees:

on or before the tenth day of each month
7 for the amount due. Said bill shall be paid by Contracting Agency
8 not later than the last day of the month in which billed.

5. Voluntary Disposal. City is authorized to accept a dog
10 or cat from its bona fide owner residing within the County of San
11 Bernardino. In such cases no charge shall be made against
12 Contracting Agency for its disposal and the dog or cat shall not
13 be included in the total number of dogs or cats computed pursuant
14 to Paragraph 4 of this agreement. City may charge the owner a fee
15 not to exceed the fee City charges its own residents for similar
16 services.

6. Deputization. City officers, agents or employees shall
18 be deputized and are hereby authorized to collect Contracting
19 Agency's license, apprehension, shelter, and related penalty fees
20 at the Animal Shelter, as directed by Contracting Agency, for all
21 animals received under this agreement. City officers, agents, or
22 employees shall also collect the requisite sums for rabies
23 vaccinations where required. Such license forms and receipt books
24 as may be deemed necessary by Contracting Agency will be furnished
25 to City by Contracting Agency.

7. Funds Collected by City. Rabies vaccination deposits
27 shall be retained by City, and shall be refunded to the depositor
28 upon presentation of proof of vaccination. Fees for voluntary

1 disposal of dogs or cats shall be retained by City. All other
2 monies collected by City for Contracting Agency in connection with
3 this agreement shall be deposited in the City Treasury and shall
4 be paid to Contracting Agency on or before the tenth day of each
5 month for the month preceding.

8. Term. This agreement shall be for a term of one year
7 commencing July 1, 1984.

9. Termination. This agreement may be terminated by either
9 party upon 30 days notice. In the event of termination, the
10 Contracting Agency's compensation to City shall be prorated to
11 reflect the period during which the agreement is in effect.
12 IN WITNESS \'lHEREOF, the parties have executed this agreement
13 on the date set forth below.

The County of San Bernardino has been contracting with the City of San
Bernardino for animal shelter services for many years. The City impounds
and disposes of stray animals found in unincorporated areas of the County.
These animals are held according to the County regulations and disposed
of after 72 hours. Approval of this contract will allow continuation of
these services for FY 1984-85. unit impound and disposal fees are
$16.50 for dogs and $9.00 for cats. Expenditures are included in the
Department of Public Health's approved FY 1984-85 budget.
