RESOLUTION NO. 84-176
A RESOLUTION OF THE CITY OF SAN BERNARDINO VACATING A NORTH-SOUTH
ALLEY, KNOWN AS DILLON ALLEY, LOCATED EAST OF SIERRA WAY; AND LUGO AVENUE
BETWEEN FIFTH STREET AND SIXTH STREET; AND RESERVING PUBLIC UTILITY EASEMENTS
THEREON, IN THE CITY OF SAN BERNARDINO.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SANI
BERNARDINO AS FOLLOWS:

SECTION 1: The Mayor and Common Council of the Ci ty of San

Bernardino, having heard the evidence offered in relation to the proposed
7
vacation of a north-south alley, known as Dillon Alley, located east of Sierra
8
Way, and Lugo Avenue between Fifth Street and Sixth Street, more particularly
described in City Resolution of Intention NO.84-132, hereby find from all of
the evidence submitted that such alley and street, proposed to be vacated by

said Resolution, are unnecessary for present or prospective street purposes.

SECTION 2. The Mayor and Common Council of said City do hereby
13
vacate the north-south alley, known as Dillon Alley, located east of Sierra
Way, and Lugo Avenue between Fifth Street and Sixth Street, San Bernardino,
California, more particularly described as follows:
That certain north-south alley, known as Dillon
Alley, and that portion of Lugo Avenue, lying
between the north line of Fifth Street and the south
line of Sixth Street, as delineated on the map of
Tract No. 2030, as per plat recorded in Book 29 of
Maps, page 49, records of the County Recorder of San
Bernardino County, State of California,
and is also described in said Resolution No. 84-132.
SECTION 3. This Resolution shall reserve, and nothing herein shall
in any way affect or disturb" each and every existing easement for sanitary
sewer and appurtenant facilities and for pUblic utility purposes belonging
either to the City of San Bernardino or to any pUblic utility and there is
further reserved for present and future general public utility purposes and for
this City an easement reasonably necessary to locate sanitary sewer, publ ic
utility and appurtenant facilities over, in, under or across the real property

described hereinbefore along with the right to use, install, maintain, repair,

replace or renew such facilities and those reserved by Resolution of Intention
3
No. 84-132.

SECTION 4. The City Clerk of the City of San Bernardino shall cause
5
a certified copy of this resolution to be recorded in the office of the County
6
Recorder of the County of San Bernardi no.
