Synopsis of Previous Council action:
The Council Personnel Committee of the Common Council Meeting of May 8,
1987, recommended the upgrade of two Deputy City Attorney II positions

STAFF REPORT
At the May 8, 1987, meeting of the Council Personnel Commit-
tee, the City Attorney-Elect, James Penman, reviewed proposed
budget and organizational changes for the City Attorney's
Office. The changes discussed include: the upgrading of two
(2) Deputy City Attorney II positions to Deputy City Attorney
III's; the creation of a new Deputy City Attorney III posi-
tion; a mid-range placement for Executive secretary; and,
automobile expenses for the City Attorney Elect. The Person-
nel Committee asked for details as back-up and justification
for hiring an additional attorney to be funded through the
cutback of outside litigation expenses. The mid-range
placement for the Executive Secretary can be handled
administratively but the other proposed changes need action
by the Mayor and Common Council. The cost for the above
mentioned (2) reclassifications, the additional position and
automobile expenses are outlined separately in an attachment.
Also attached is a 10/13/86 memorandum outlining litigation
expenses for the past four years. The city Attorney-Elect
urges the approval of the proposed reclassifications and new
hire to provide for the continuity of staff.

STAFF REPORT
Summary and narrative information has been provided by the
Finance Director and the City Attorney Elect regarding
litigation expenses. Mr. James F. Penman has indicated that
the cost of outside litigation has been significant enough so
as to easily justify the cost of adding another staff
attorney. This argument is well documented by these facts:
1. A four year (1982-83 to 1985-86) cost of outside
litigation totals $1,235,138.24.
2. The cost of adding another staff position (Deputy
City Attorney III) is estimated at $53,810 annual-
ly.

4. The cost of an additional attorney would be 31.3%
of the 1982-83 annual outside litigation expense.
Based on these facts, the cost of an additional attorney can
be offset by a reduction in outside litigation expenses.
Further, it is entirely possible that the City of San
Bernardino may save money when comparing a 4-year staffing
cost of $215,240 to the last four year total of
$1,235,138.24. Thus, the addition of another staff attorney
would be financially feasible. Finally, the additional
attorney could be used to emphasize and increase code
enforcement which is a stated goal of the Mayor and Common
Council.
