Inthe interim, there have been increases in the dumping fees at County landfill sites as well as inflationary increases in the costs of labor, parts and equipment, refuse containers and other operating materials, services and supplies. In order to maintain present service levels, it is necessary that fees be increased effective July 1, 1987. Resolution 83-245 establishing the fee structure has been amended from time-to-time to accomodate the need for increased revenue: however, the bases for assessing the fees are outdated and in need of revision. The attached resolution clarifies certain Sections which have been sources of confusion to both staff and the public in the administration of the fee structure. Moreno, Jr., Director of Public Services Date May 5, 1987 Subject Rate Increase Justification - Refuse Collection Approved Date It will be necessary to increase refuse collection fees by 15% - 20% in order to produce the shortfall required between revenue and expenditures. Refuse rates have not been raised since 1983, and the increase should probably have occurred last year. Based on figures available, estimated revenue for 1986-87 should be approximately $4,984,000, as opposed to projected expenditures of approximately $5,900,000. The Department's 1986-87 Budget was balanced by using the Refuse Fund reserve. The balance in the reserve on July I, 1986, was $1,173,279; the sum of approximately $916,000 has been used to offset the known difference between current revenue and expected expenditures for 1986-87. Additional costs during 1986-87, chief among which was an increase in the County Landfill dumping fee from $6.00 per ton to $8.60 per ton,required the use of the additional reserve funds. If the total amount remaining in the reserve were to be applied toward the 1987-88 Budget (and exhausting the reserve is not reCOll1llended), there would still be a shortfall of more than $375,000. Since the Water Department is on a daily billing basis, and bills in arrears, the rate increases will start producing additional revenue about the middle of August (figures 10~ IIIOnths .... $488,726). C '1 ..... 0""7 - . c .-, '-' ~ :) 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO FIXING AND DETERMINING THE FEES AND CHARGES TO BE CHARGED FOR THE COLLECTION 3 AND DISPOSAL OF REFUSE, AND REPEALING RESOLUTION NO. 83-245 AND AMENDMENTS THERETO. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 5 OF SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. The fees and charges set forth herein shall 7 apply to refuse collection services provided by the City. 8 SECTION 2. A minimum twenty-five dollar ($25.00) deposit 9 shall be required for each new commercial refuse account. Said 10 deposit must be paid prior to the City commencing refuse collection 11 service. This deposit shall be retained by City and applied 12 to any closing bill upon termination of service. Any excess 13 amount above the closing bill shall be refunded. 14 SECTION 3. Collection and Disposal of Refuse - SingYe Family 15 Residences. For collection and disposal of refuse the owner, 16 or authorized agent, of any single-family residential premises, 17 or portions th~reof, located within the territorial limits of 18 the City of San Bernardino, shall pay the following fees: 19 $7.00 per month for regular curbside or alley service, 20 $7.60 per month for service where containers must be 21 removed from below ground level. 22 SECTION 4. Collection and Disposal of Refuse - Multiple 23 A artments, Etc. Yd. $68.80 $83.80 $15.00 13 *Includes monthly Bin rental fee. 14 (b) All fees pursuant to this section shall be reviewed 15 periodically and, on the basis of findings, monthly fees shall 16 be adjusted to maintain conformance with the fee schedule set 17 forth in Subsection (a) above, except that monthly fees shall 18 not be adjusted in relation to temporary variations of refuse 19 due to seasonal factors, where such variations from the average 20 do not extend beyond a three-month period. 21 (c) When a City-owned bin is requested for use on a temporary 22 basis, a special delivery charge of ten dollars ($10.00) shall 23 be made for each such bin, in addition to the regular monthly 24 bin rental fee; said monthly rental fee shall be prorated for 25 the period of such use, in increments of not less than one (1) 26 week. A service fee equal to twenty-five percent (25%) of the 27 regular monthly collection and disposal fee for the size of 28 bin so-utilized shall be charged for each time the bin is serviced. 3 . c /'", ~ :) o 1 SECTION 7. Collection and Disposal of refuse utilizing compaction-type containers and commercial drop-bodies. (a) When the service performed by the City is the collection and disposal of refuse placed for collection in City-approved compaction-type containers or commercial drop-bodies, having a ca- pacity of 10, 20, 30 or 40 cubic yards, the fee for each time of collection shall be as listed below. May 5, 1987 4 c r--., '-' o :J\ 1 (b) In the event the City is eequieed to pay a disposal 2 chaege foe consteuction mateeial, oe othee eefuse which is 3 classified as "Hard to Handle", the amount of any such additional 4 disposal charge, oe foe weight chaeges in excess of eight (8) 5 tons, shall be a debt of the customee and shall be added to 6 the base fee due the City. 7 SECTION 9. The Directoe of Public Seevices, upon eequest, 8 may provide for the special collection and eemoval of refuse 9 feom any place or premises at any time, in addition to oe beyond 10 the regular collection service schedule, or in a manner different 11 from normal collection practice and procedure~. The rate for 12 any such special service shall be thirty dollars ($30.00) per 13 hour with a minimum charge of seven dollars and fifty cents 14 ($7.50). 15 SECTION 10. All fees and charges set forth in this resolu- 16 tion shall be collected monthly. 17 SECTION 11. Any service for the collection and disposal 18 of eefuse as set forth in this resolution may be discontinued 19 by the Director of Public Services if any fees or charges, as 20 levied herein, are not paid within ninety (90) days from the 21 date said assessment is billed. 22 SECTION 12. The Mayor and Common Council may exempt from 23 the fee provisions and charges of this resolution certain non- 24 profit events in the public interest. The exemption shall be 25 subject to any conditions imposed by the Director of Public 26 Services. 27 SECTION 13. The Director of Public Services may provide 28 collection and disposal service without charge in emergency ~ . c r--. V o :J 1 situations and when, in the opinion of the Director, such action 2 is necessary to correct fire hazards, or other conditions which 3 present an imminent threat to health and safety. 4 SECTION 14. Resolution No. 83-245 and amendments thereto 5 and any other resolution in conflict herewith are hereby repealed. 6 SECTION 15. SECTION 6.- (a) When the serv ice performed by the City is the collection and disposal of refuse placed for collection in -, City-approved compaction-type containers, the fee for such service for each time of collection, shall be at the rate of two dollars and thirty-five cents ($2.35) per cubic yard of capacity of each container. (e) Whenever a three or four cubic yard bin is requested for 18 use on a temporary basis, a special delivery charge of ten dollars 19 ($10.00) shall be made in addition to the regular monthly bin 20 rental rate, which said rental rate shall be prorated for the 21 period of such use in increments of not less than one week. A 22 service fee of ten dollars ($10.00) per pickup shall be charged 23 for each time said bin is serviced. 24 SECTION 7. The Public Services Superintendent may provide 2S for the special collection and removal of garbage or rubbish [rom 26 any place or premises at any time in addition to or beyond the 27 regular collection service schedule, or in a manner different from , 28 normal collection practice and procedures. The Mayor and Common Council may exempt from the 11 rate provisions and charges of this resolution certain nonprofit 12 events in the public interest. The exemption shall be subject to 13 any conditions imposed by the Superintendent of Public Services. 14 SECTION 11. The Superintendent of Public Services may - 15 provide emergency service without charge in emergency situations 16 when necessary to correct fire or health hazards or other 17 emergencies. 18 SECTION 12. Resolution No. 13570 and amendments thereto and 19 any other resolution in conflict herewith are hereby repealed. 20 21 22 SECTION 13.
