Subject: Request to Schedule Public Hearing
on June 15, 1987, relative to
Proposed Refuse Collection Rates.
Synopsis of Previous Council action:
The attached resolution and related material concerning the increase of refuse
collection rates was initially submitted to the Mayor and Common Council at the
regular meeting of May 18, 1987. Since that time, the Council Ways and Means
Committee has received the proposal and will be scheduling at least one more
meeting on the matter prior to the requested Public Hearing on June 15, 1987.
Recommended motion:
That the proposed increase in refuse collection rates, to be effective July 1, 1987,
be set for Public Hearing and discussion at the regular Council Meeting on June 15,
1987, and that the City Clerk be authorized to advertise the Public Hearing.

The City of San Bernardino's refuse collection fees have not been increased
since 1983. In the interim, there have been increases in the dl.mping fees
at County landfill sites as well as inflationary increases in the costs of
labor, parts and equi~t, refuse containers and other operating materials,
services and supplies.
In order to maintain present service levels, it is necessary that fees be
increased effective July 1, 1987. Resolution 83-245 establishing the fee
structure has been amended fran time-to-time to ~t"~te the need for
increased revenue: however, the bases for assessing the fees are outdated
and in need of revision. The attached resolution clarifies certain Sections
which have been sources of confusion to both staff and the public in the
adninistration of the fee structure.
The attached memorandum addressed to the City Adninistrator contains addi-
tional details regardill9 the necessity for the increases recarmended.

It will be necesury to increase refuse collection fees by 15' - 20\ in order to
produce the shortfall required between revenue and expenditures. Refuse rates
have not been raised since 1983, and the increase should probably have occurred
1ut year.
Based on figures available, estimated revenue for 1986-87 should be approximately
$4,984,000, u opposed to projected expenditures of apptOximate1y $5,900,000.
'!'he Department' s 1986-87 Budget was balanced by using the Refuse Fund reserve.
'!'he balance in the reserve on July 1, 1986, was $1,173,279: the SUID of approximately
$916,000 has been used to offset the known difference between current revenue and
expected expenditures for 1986-87.
Additional costs during 1986-87, chief among which was an increUe in the County
Landfill ~ing fee from $6.00 per ton to $8.60 per ton,required the use of the
addi tiona1 reserve funds. If the total amount remaining in the reserve were to
be applied toward the 1987-88 Budget (and exhausting the reserve is not r..oo.......nded),
there would still be a shortfall of more than $375,000.

These proposed rate increases will be on the Council Agenda for the meeting of
May 18,1987, to set a public hearing (and adoption) on June 1st, with an effective
date of July 1, 1987. Since the Water Department is on a daily billing basis,
and bills in arrears, the rate increasea will start producing additional revenue
about the middle of August (figures 10; months .... $488,726). If the rate increase
were to be in effect for the entire year, the revenue increase would be $570,000.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY

SECTION 1.
The fees and charges set forth herein shall
apply to refuse collection services provided by the City.
SECTION 2.
A minimum twenty-five dollar ($25.00) deposit
shall be required for each new commercial refuse account.
Said
deposit must be paid prior to the City commencing refuse collection
11 service. This deposit shall be retained by City and applied
12 to any closing bill upon termination of service. Any excess
13 amount above the closing bill shall be refunded.
14 SECTION 3. Collection and Disposal of Refuse - Single Family
15 Residences. For collection and disposal of refuse the owner,
16 or authorized agent, of any single-family residential premises,
17 or portions th~reoL, 1 Jcated within the territorial limits of
18 the City of San Bernardino, shall pay the following fees:
19 $7.00 per month for regular curbside or alley service,
20 $7.60 per month for service where containers must be

removed from below ground level.

14 (b) All fees pursuant to this Section shall be reviewed
15 periodically and, on the basis of findings, monthly fees shall
16 be adjusted to maintain conformance with the fee schedule set
17 forth in Subsection (a) above, except that monthly fees shall
18 not be adjusted in relation to temporary variations of refuse
19 due to seasonal factors, where such variations from the average
20 do not extend beyond a three-month period.
21 (c) When a City-owned bin is requested for use on a temporary
22 basis, a special delivery charge of ten dollars ($10.00) shall
23 be made for each such bin, in addition to the regular monthly
24 bin rental fee; said monthly rental fee shall be prorated for
25 the period of such use, in increments of not less than one (1)
26 week. A service fee equal to twenty-five percent (25%) of the
27 regular monthly collection and disposal fee for the size of
28 bin so-utilized shall be charged for each time the bin is serviced.

1 SECTION 7. Collection and Disposal of Refuse utilizing
2 compaction-type containers with a capacity 3 - 8 cubic yards.
3 When the service performed by the City is the collection and
4 disposal of refuse placed for collection in City-approved
5 compaction-type containers having a capacity from,three (3)
6 to eight (8) cubic yards, the monthly fee, for one time per
7 week collection, shall be as follows:

SECTION 8.
Collection and Disposal of refuse utilizing
compaction-type containers and commercial drop-bodies.
(a)
When the service performed by the City is the collection
and disposal of refuse placed for collection in City-approved
compaction-type containers or commercial drop-bodies, having a ca-
pacity of 10, 20, 30 or 40 cubic yards, the fee for each time
of collection shall be as listed below.
A monthly rental fee
shall be charged for the use of City-owned containers and shall
be in addition to the collection and disposal fee.

1 (b) In the event the City. .hrequired to 'pay <a disposal
2 charge for construction material, or other refuse which is
3 classified as "Bard to Bandle"; the amount of any such additional
4 disposal charge, or for weight charges in excess of eight (8)
5 tons, shall be a debt of the customer and shall be added to
6 the base fee due the City.
7 SECTION 9. The Director of Public Services, upon request,
8 may provide for the special collection and removal of refuse
9 from any place or premises at any time, in addition to or beyond
10 the regular collection service sChedule, or in a manner different
1] from normal collection practice and procedures. The rate for
]2 any such special service shall be thirty dollars ($30.00) per
]3 hour with a minimum charge of seven dollars and fifty cents
14 ($ 7.50) .
]5 SECTION 10. All fees and charges set forth in this resolu-
]6 tion shall be collected monthly.
17 SECTION ll. Any service for the collection and c1isposal
]8 of refuse as set forth in this resolution may be discontinued
]9 by the Director of Public Services if any fees or charges, as
20 levied herein, are not paid within ninety (90) days from the
2] date said assessment is billed.
22 SECTION 12. The Mayor and Common Council may exempt from
23 the fee provisions and charges of this resolution certain non-
24 profit events in the pUblic interest. The exemption shall be
25 subject to any conditions imposed by the Director of Public
26 Services.
27 SECTION 13. The Director of PUblic Services may provide
28 collection and disposal service without charge in emergency

1 situations and when, in the opinion of the Director, such action
2 is nec...ary.to correct fire hazards, or other conditions which
3 present an imminent threat to health and safety.
4 SECTION 14. Resolution No. 83-245 and amendments thereto
5 and any other resolution in conflict herewith are hereby repealed.
6 SECTION 15. This resolution shall be effective

(b) When any garbage or rubbish service is performed by

(c) When'the service performed by the City is for the
4 collection and disposal of construction, remodeling or hard-to-
5 handle material, in commercial drop bodies of 30 or 40 cubi~ yard
6 capacity, the fee for such service for each time 'ot: collection
7 shall be at the rate of $3.00 per cubic yard of capacity of each
I container containing said material, plus the monthly rental of
, bins as per schedule under section 6 Subsection (b), except when
10 City-approved bins are furnished by the place of business being
11 aerv iced.

(d) Whenever the City is required to pay a dumping charge
13- for construction material or other rubbish which is classified as
14 -hard to handle-, the additional amount of the dumping charge over

J5 eight tons for commercial drop bodies shall be a debt of the
J6 customer and shall be added to said total fee due to the City.

(e) Whenever a three or four cubic yard bin is requested for
II use on a temporary basis, a special delivery charge of ten dollars
l' ($10.00) shall be made in addition to the regular monthly bin
20 rental rate, which said rental rate shall be prorated for the
21 period of such use in increments of not less than one week. A
22 service fee of ten dollars ($10.00) per pickup shall be charged
23 for each time said bin is serviced.

SECTION 7. The Public Services Superintendent may provide
25 for the special collection ancl removal of garbage or rubbish from
26 any place or premises at any time in addition to or beyond the
27 regular COllection service schedule, or in a manner different from
,
28 normal collection practice and procedures. The rate (or nny such

SBCTION 8. All fees and charges as sot forth in this
resolution shall be collected monthly.
SECTION 9. Any service for the collection and disposal of

garbage or rubbish as set forth in this resolution may be
discontinued by the Public Services Superintendent if any fees or
charges, as lovied herein, are not paid within 90 days from the

date said assessment is billed.
SECTION 10. The Mayor and Common Council may exempt from the
rate provisions. and charges of this reaol-..ation ce.rtain'nonprofit

events in the public interest. The exemption shall be subject to
any conditions imposed by the Superintendent of pubaic Services.
SECTION 11. The Superintendent of Public Services may
provide emergency service without charge in emergency situations
when necessary to correct fire or health hazards or other
emergencies.
SECTION 12. Resolution No. 13570 and amendments thereto and
any other resolution in conflict herewith are hereby repealed.
SECTION 13. This resolution shall be effective
