Award of Contract for Renovation of Central City

Approved
FromROGER G. HARDGRAVE, Dir. of
Public Works/City Engineer
Date May 21. 1987
File No. 1.364
Date
At the Council Meeting of 5-18-87, a motion was adopted to continue this item
until 6-1-87. The reason for the continuance was to allow time for Glenda Saul,
Director of Redevelopment, ana myself to meet and review any possible conflicts
with the proposed Downtown Beautification Program.
Glenda and I have met to review the two projects. The beautification program
will encompass the sidewalk area and storefronts, while the bus stop renovation
project will be limited to repair of damage to the street pavement and gutters.
Therefore, no conflicts are expected between the two projects.
Funds to finance the costs for this renovation project will be Federal-aid Urban
Transit Funds. These funds must be used for transit rel ated purposes, whi ch
means that they cannot be used for general street improvement work.
It is Glenda's and commendation that the contract be awarded.

STAFF REPORT
Bids were received at 2:00 p.m. on Wednwsday, 4-22-87.
A total of 5 bids were received, ranging from $95,137.46 to $160,047.00.
The apparent low bid of $95,137.46 is 12.9% over the Engineer's Estimate of
$84,300.00.
In accordance with the project specifications and requirements for
Federal monies, the two apparent low bidders were requested to submit informa-
tion on their minority business and women businesses for participation in the
goals established on this project.
The apparent low bidder was unable to meet the specified percentage of
minority business participation and, therefore, failed to meet contract re-
quirements. Upon concurrence with Caltrans, the project is recommended for
award to the second low bidder who has met the minority goals for the project
and did submit all information in correct order.
Listed below is the total estimated project cost, based upon the
actual second low bid price:
Construction Contract
Engineering & Inspection (W.O. #1482)
Sub-Total
Contingencies (15%1)
TOTAL
$ 103.156.00
$ 13,115.00
$ 116,271. 00
$ 17,429.00
$ 133,700.00
Federal participation is estimated to be 86% of the project total
($114,982). Local agency share will be about 14% ($18,718).
An amount of $22,593.68 was appropriated in the 85-86 budget, in
account Number 242-362-57364, for this project. Caltrans has reviewed the
project and the bids and has granted authorization to award a contract to
the second lowest bidder.
We recommend that a contract be awarded to the second lowest bidder.

Dea r Mr. Ba 1 com:
Bob Bri tton Inc. was notified by telephone on April 22, 1987,
that they were the apparent successful low bidder. We did not
have time to notify Bob Britton Inc., by certified letter,
since the contract documents state that the low bidder and the
second low bidder shall submi t DB and WBE information to thi s
office no later than close of business on the first Monday
after bid opening.
We requested that the required information on DB and WBE's be
submitted no later than Monday, April 27,1987. We again
called Mr. Britton's office on April 23rd and 24th to offer our
assistance in helping them meet the required goals.
80b Bri tton Inc. di d submi t a letter da ted Apri 1 27, 1987,
(copy attached) describing their efforts to meet the required
goals. We have reviewed their letter and made a determination
that they failed to make a good faith effort for the following
reasons:
1. Bob Britton Inc. did not attend the pre-bid meeting
on DB and WBE goal s.
2. No advertisement was made in a minority focus
newspaper.

has been reviewed and found to be in order. Based on this
