Funds are available under the Federal Highway Bridge Replacement and
Rehabilitation Program to finance 80% of the project cost. The remaining 20%
will have to be provided from City funds.
Execution of Program Supplement No. 44, to Local Agency - State
Agreement for Federal-Aid Projects No. 08-5033 - will commit $157,680 of
Federal funds for this project.
An amount of $31,000 has been aliocated, under Account No. 242-362-57359,
to finance the local agency share. In addition, an amount of $12,000 has been
allocated, under Account No. 242-362-57349, for drainage improvements on Oak
Street. These improvements have been incorporated into the bridge replacement
project, which means these funds are available, for a total of $43,000 for the
local agency share.
It is required that Program Suppiement No. 44 be executed by the City
and State of California, in order to receive Federai-Aid fu.nds for this project.
Therefore, we recommend that authorization to execute this suppiement be granted.

8-5033 BETWEEN SAID CITY AND THE STATE OF CALIFORNIA, ACTING 8Y
4 AND THROUGH ITS DEPARTMENT OF TRANSPORTATION.
5 BE IT RESOLVED BY THE MAYOR ANO COMMON COUNCIL OF THE CITY
OF SAN 8ERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San 8ernardino is
7 hereby authorized and directed to execute on behaif of said City
8 Program Supplement No. 44 to Local Agency-State Agreement for
9 Federai-Aid Projects No. 8-5033 to authorize certain safety
10 improvements, between said City and the State of California,
11 acting by and through its Department of Transportation, a copy of
12 which is attached hereto marked Exhibit "A" and incorporated
13 herein by reference as fuliy as ,though s'et forth at iength
14 herein.

This Program Supplement Is hereby Incorporated Into the Local Agency-State Agreement
for Federal-Aid which waa entered Into between the LOCAL AGENCY and the STATE on.
4-6-78 and Is subject to all the terms and conditions thereof. This Program
Supplement Is -adopted in accordance with Paragraph 2 of Article II of the aforementioned
Master Agreement under authority of Resolution No. I approved by the
LOCAL AGENCY on (See copy attached).
The Local Agency further stipulates that 8S a condition to payment of funds obligated to this project.

SPECIAL COVENANTS OR REMARKS
1. All maintenance, involving the physical condition and the
operation of the improvements, referred to in Article VI
MAINTENANCE of the aforementioned Master Agreement will be
performed by the Local Agency at regular intervals or as
required for efficient operation of the completed improvements.
2. In executing this Program Supplemental Agreement the Local
Agency hereby reaffirms the "Nondiscrimination Assurances"
contained in the aforementioned Master Agreement for
Federal-Aid Programs.
3. The Local Agency will advertise, award, and administer this
project and will obtain the State's concurrence prior to
either award or rejection of the contract.
4. The Local Agency agrees the payment of Federal funds will be
limited to the Detail Estimate amounts approved by the
Federal Highway Administration in the Federal-Aid Project
Agreement (PR-2), or its modification (PR-2AI, and accepts
any increases in Local Agency Funds as shown on the Finance
or Bid Letter or its modification as prepared by the Division
od Local Streets and Roads.
