Council Member Quiel made a motion, seconded by
Council Member Flores, that said resolution be adopted.
Resolution No. 87-165 was adopted by the following
vote: Ayes: Council Members Estrada, Reilly, Flores,
Maudsley, Quiel, Frazier, Strickler. Noes: None. Ab-
sent: None.

Council Member Quiel made a motion, seconded by
Council Member Flores, that said resolution be adopted.
Resolution No. 87-166 was adopted by the following

Maudsley, Quiel, Frazier, Strickler. Noes: None. Ab-
sent: None.

City Attorney Elect Penman stated that this resolu-
tion should be continued, as there has to be a ten day
period following publication, and that period has not yet
run.

Council Member Quiel made a motion, seconded by
Council Member Maudsley and unanimously carried, that said
resolution be continued to June 1, 1987, in the Council
Chambers of City Hall, 300 North "0" Street, San Bernar-
dino, California, and amended by interdelineation by staff
to include on page 2, line 10, the following sentence:
"Such funds shall accrue interest at the annual investment
portfolio rate as accomplished by the City Treasurer's
Office."

Council Member Frazier left the Council Meeting.

ST~~IDARD REQUIREMENT NO. 11 RELATING TO UNDERGROUNDING UTILITY

BE IT P~SOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BE~~ARDINO AS FOLLOWS:

SECTION 1. Purs~ant to San Bernardino Municipal Code

Section 18.44.070, the following requirement for un~ergrounding
utility lines is hereby adopted:
"Standard Requirement No. 11
11. All existing overhead utility lines, including, but
11 not limited to electrical, telephone, cable television, and
12 street light service, shall be placed underground. This
13 requirement shall apply to all such lines traversing the
14 development, or installed along either side of streets
15 adjoining the development, except for electrical transmission
16 lines of 33 KVA and above; distribution lines of 33 KVA and
17 below shall be undergrounded. Where one line is exempt, all
18 lines on that pole shall be exempt. Arrangements, including
19 payment of costs, shall be made by the developer with the
20 serving utility company(s). Undergrounding of utility
21 structures may be done by the developer, with permission from
22 the serving utility.
23 For developments with small frontages, the Director of
24 Public Works/City Engineer may accept a cash payment from the
2S developer, in lieu of undergrounding the lines. Payments will
26 be based upon a written estimate of the short form unit cost
27 from the serving utility co~rany(s), and will reflect the
28 development's proportionate share of the estimated cost for

undergrounding the lines over the entire section.
In the event that property on the opposite side of the
street is vacant, the developer shall pay fifty percent of the
estimated cost of undergrounding. When the vacant property is
developed it will pay the remaining fifty percent of the cost
of undergrounding. The cost of undergrounding shall be
calculated to exclude the cost of street crossings; the entire
cost to underground street crossing lines shall be borne by
the property served by the crossing lines.
All payments will be deposited into a line item account
for undergrounding utilities within the area. In no event
shall the payments from developers on both sides of the street
exceed the total estimated cost for undergrounding utilities
along that section of street.
Standard Requirement No. 11 shall not apply to the
remodeling of existing buildings where the cost of remodeling
is less than 50% of the replacement cost of the existing
structure.
Standard Requirement No. 11 shall apply to any project
for which a building permit has not been issue~.
An appeal from this requirement may be sub~itted to the
Mayor and Common Council pursuant to San Bernardino Municipal
Code Section 18.44. 070 Subsection N."
