No written protest were received prior to the Board of Building Commissioners' meeting on July 8, 1987. Section 8.27.140 of the Municipal Code deals with the refunding of the amount of an "erroneous" assessment. Whil e it is stretchi ng it somewhat to say that bi 11 i ng the person in whose name the property was registered at the time the work was performed was an error, the Municipal Code makes no provision for excusing the new owner of the debt and removing the charge as a lien against the property. In the past, liens were placeOlOn properties once a year. Accordingly, the case often occurred where the new owner never received "Notice to Clean" hislher property. To reduce the amount of protest received for this reason, on the recommendation of the Legislative Review Committee, we will in the future bring these matters before the Mayor and Council on a monthly basis. 7/8/87 75.0264 c o o o 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING COSTS OF ABATEMENT OF PUBLIC NUISANCES AND IMPOSING LIENS ON CERTAIN 3 REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE COSTS OF THE ABATEMENT. 4 5 WHEREAS, the City of San Bernardino, pursuant to its 6 authority under Chapter 8.27 of the San Bernardino Municipal 7 Code, did lawfully cause public nuisance to be abated on the 8 properties described in Exhibit "A" attached to and incorporated 9 in this resolution 1 and 10 WHEREAS, notice was given to the owners of record of said 11 properties, and a hearing has heretofore been held to hear 12 protests and assess the costs of said abatements before the Board 13 of Building Commissioners 1 14 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 15 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 16 SECTION 1. Said costs are found to have been incurred by 17 the City pursuant to proceedings under the San Bernardino 18 Municipal Code, and the final statement of costs on file with the 19 City Clerk is hereby confirmed and adopted as special assessments 20 against the properties listed in Exhibit "A" hereto. 21 SECTION 2. If any of the sums due are not fully paid to 22 the City Clerk, City Hall, San Bernardino, within five days 23 following date of mailing of the notice of this action, then each 24 of these unpaid sums shall be and become a lien of the subject 25 property pursuant to the Municipal Code and applicable laws and 26 shall be collected as a special assessment thereon. 27 28 7-13-87 1 c o o o 1 SECTION 3.
