Recommended motion:
1. That Change Order No. B to the contract with Powell Construction Company. for construction
of Del Rosa VRI(~ . from 9th Street to Baseline Street. in accordance with Plan No. 4993.
be approved to authorize an increase in the quantity of roadway excavation of 4.843 C.Y.
(from 760 cubic yards to 5,603 cubic yards) for an increase in the contract price of
$4.BI2.00, from $565.539.16 to $570.351.16.
2. That the work performed by the Contractor. in accordance with Plan No. 4993. be approved
and accepted; and that final payment be authorized at the expiration of the lien period.

STAFF REPORT
Addendum No.2 to contract documents included in the work to be per-
formed. removal of a quantity of dirt stockpiled within the street right-of-way
under the items of work to be done under the contract. A total of 5603 cubic
yards were removed. which exceeds the bid item estimate of 760 C.Y. by more
than 25%. Change Order No. 8 would pay the Contractor for 125% of the bid
quantity of excavation (950 C.Y.) at the bid price of $5.00 per C.Y. The
remainder of the excavated quantity (4653 C.Y.) would be paid at the Contrac-
tor's actual unit cost plus mark-up of $0.83 per C.Y.
The total increase in contract price to be authorized by Change Order
No.8 is $4.812.00. The total estimated project cost. based upon the actual
low bid price. included an amount of $62.008 for contingencies. which can be
used to finance the additional cost authorized by this change order.
All work under this contract was satisfactorily completed as of
May 4. 1987.
The contract was awarded for the low bid price of $553.304.00.
Contract Change Orders No's 1. 2 & 3 were approved on 12-22-86. authorizing
a total increase in the contract price of $2,336.10. from $553.304.00 to
$555.640.10. Contract Change Orders No's 4. 5. 6 & 7 were approved on
April 6. 1987. authorizing a total increase in the contract price of $9.899.50.
from $555.640.10 to $565.539.60.
The original contract completion date was December 15. 1986. Time
extensions totaling 17 working days were granted for weather. change orders,
and utility delays. The Contractor exceeded the amended completion date by
84 calendar days. The project specifications assign liquidated damages of
$200.00 per calendar day. which amounts to $16.800.00. The actual damages
suffered due to increased labor and administrative costs exceeded this amount.
Therefore. the lesser amount of $16.800.00 was assessed as liquidated damages.
The actual final contract price is $543.537.36. due to differences
between actual construction quantities and estimated bid quantities. and the
assessment of liquidated damages.
A meeting was held with the Contractor and representatives from
Ca1trans to discuss the Contractor's exception of several bid items listed
on the Proposed Final Estimate. issued on 4-02-87. The resultant of this
meeting was the issuance of Change Order No.8. increasing payment for road-
way excavation. and the determination that actual liquidated damages exceed
specified contract liquidated damages.
A revised Final Estimate was forwarded to the Contractor on 6-22-87.
The Contractor has not responded. There is the possibility that he may
decide to arbitrate any items with which he is not in agreement.
We recommend that the work be approved and accepted, and that final
payment in accordance with the Revised Final Estimate be authorized. at the
expiration of the lien period.

Reference is made to Addendum #2 of the Soecia1 Provisions for the contract.
The "large quantity of dirt". referred to'in the Addendum. that was necessary
to be moved. has been calculated as 5.603.0 C.Y.
In accordance with Sections.4-1.03B(1) and 9-1.03 of the Standard
Item #5. Roadway Excavation,'is adjusted as follows:

COMMENT:
The project was designed and plans prepared quite some time before
the funding or authority was received to go to bid from Ca1trans.
In the intervening time. an adjacent developer stockpiled dirt
within the street right-of-way and was to remove it before our
construction began. However. the developer went bankrupt and did
not complete all of the work and. specifically. did not remove
the pile of dirt in the roadway.
The project bid documents were already out to bid so an addendum
was sent that made the bidders aware of the dirt and gave it to
them to use on the job. We knew that the Contractor would need
additional fill material to complete the job so gave him the dirt.
However. the addendum did not say anything about payment for moving
the dirt or reduction in costs for giving it to him in the first
place.
After the contract was awarded to Powell. he came in and stated
that he wanted to be paid at the contract price for excavation for
the material we had given him. The City said "no" and several dis-
cussions followed with Caltrans and the City. Basically. the
Ca1trans' specifications state that we must pay for this additional
excavation at the contract price for the first 25% of material over
the contract and that after that, we can negotiate a fair price or
pay the actual costs incurred. The Contractor was unwilling to
negotiate a price so we kept daily extra work reports on what he
did. Breaking down his true costs and adding overhead and profit
per the standard Caltrans methods. we arrived at the $0.83 per
cubic yard for material over the original amount plus the 25%
allowed by the specifications.
Simply put. we told the Contractor he must excavate approximately
750 yards but he actually excavated over 5500 yards. We. therefore.
paid him at the contract price for the original amount (750) plus
the contract amount for 25% over the original amount and then will
pay him his actual costs for the remainder. This has all been
approved by Ca1trans and we have the detailed backup for it. The
first paragraph was an attempt to explain how a contract item
changed from 750 cubic yards to over 5500 cubic yards and how it
was paid.
