Subiect
Resolution of City of San Bemardino authorizing the amendment of an agreement for classroom
and swim pool improvements at the Boys and Girls Club with San Bernardino County Economic
and Community Development, to add a new scope of project for rehabilitation of the gymnasium
floor.

The Boys and Girls Club procured County CDBG funding in the amount of $10,000 for
classroom improvements and replacement of the swimming pool pump. The classroom
improvements allowed the facility to accommodate the "Boys Club Academy School," a
Superintendent of County Schools program. The pump replacement was essential for the
continued safe and sanitary operations of the swimming pool. Both of these projects have been
completed. The Boys and Girls Club has now procured an additional $36,000 for rehabilitation
of the gymnasium floor. The existing floor is polyurethane that has numerous tears, gouges, and
blisters making the rehabilitation essential. As owner and landlord of the Boys Club facility, the
City is required to administer the ECD contract. The project will be managed by the City using
the standard formal bid procedures. The Boys Club will provide input regarding type of
flooring.
Fiscal ImDact
There is no additional cost to the City in excess of that which is already being included in the
City's budget to support the Boys and Girls Club. The City will administer the project and the
County will reimburse the City. Therefore, a budget amendment is needed to increase Account
No. 243-363-5504-7181 (Boys & Girls Club Facility Improvements) by $36,000 and increase the
corresponding revenue reimbursement to be received from the County by $36,000 (243-000-
4651 construction reimbursement) because revenues and expenditures are being increased
equally, there is not net cost to the City.
Recommendation
I. Adopt resolution.
2. The Director of Finance is authorized to amend the FY 00/01 Park Construction Budget and
increase Account # 243-363-5504-7181 (Boys & Girls Club Improvements) by $36,000 and
increase Account # 243-000-4651 (Construction Reimbursement) also by $36,000.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
6 OF SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed
8 to execute on behalf of said City an amendment to the agreement with San Bernardino County and
9 the Boys and Girls Club of San Bernardino relating to classroom and swim pool improvements and
10 rehabilitation of the gymnasium at the Boys and Girls Club, a copy of which is attached hereto,
11 marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length.
12 SECTION 2. The authorization granted hereunder shall expire and be void and of no further
13 effect if the agreement is not executed by both parties and returned to the Office of the City Clerk
14 within 90 days following effective date of Resolution.

Nature of Contract: (Briefly describe the general terms of the contract)
On May 18, 1999, the Board of Supervisors approved Agreement No. 99-369, between the County, the City of San
Bernardino and the Boys and Girls Club of San Bernardino, which provided Community Development Block Grant
(CDBG) funds for a new pool pump and for the construction of a computer room at the Boys and Girls Club facility. This
first amendment to the Contract provides CDBG funding for the rehabilitation of the gymnasium floor at the facility. The
Boys and Girls Club will be responsible for maintenance and operation of the facility at their sole expense for no less than
ten (10) years following the date of completion of the work. The Boys and Girls Club provides programs and services to
youths from low-and moderate-income households in the Fifth Supervisorial District and the City of San Bernardino.
Construction management of the facility improvements will be provided by the City of San Bernardino. All other
provisions and tenus of Agreement No. 99-369 will remain the same.

FIRST AMENDMENT TO THE CONTRACT
BETWEEN THE COUNTY OF SAN BERNARDINO
THE CITY OF SAN BERNARDINO AND
THE BOYS AND GIRLS CLUB OF SAN BERNARDINO
CONTRACT # 99-369
This First Amendment to Contract No. 99-369 is made and entered into this day of
19_, by and between San Bernardino County, hereinafter referred to as "COUNTY", the City of San Bernardino,
hereinafter referred to as "CITY", and The Boys and Girls Club of San Bernardino, hereinafter referred to as "CLUB".
WHEREAS, COUNTY, CITY and CLUB have previously entered into a Contract, Contract No. 99-369
hereinafter referred to as "CONTRACT", for Community Development Block Grant (CDBG) funded improvements at
the CLUB facility, hereinafter referred to as "FACILITY", located in the City of San Bernardino; and,
WHEREAS, COUNTY, as part of the 1999.2000 CDBG application, approved funding in the amount of thirty-
six thousand dollars ($36,000) for rehabilitation improvements to FACILITY; and,
WHEREAS, the City of San Bernardino has allocated thirty eight thousand six hundred thirty eight dollars
($38,638) for utility payments and continued facility maintenance for CLUB under separate lease agreement; and,
WHEREAS, COUNTY, CITY, and CLUB desire to amend CONTRACT to include additional funding for
improvements.
NOW, THEREFORE, in consideration of the mutual covenants herein set forth and the mutual benefits to be
derived therefrom, the parties agree as follows:
I. Replace CONTRACT Section 2, with new SCOPE OF PROJECT
SCOPE OF PROJECT
COUNTY has constructed improvements, hereinafter referred to as IMPROVEMENTS, to the CLUB facility
which included the replacement of a swimming pool pump, and the construction of a computer room in the
facility. This amendment provides for the rehabilitation of the gymnasium flooring. In consideration of
IMPROVEMENTS, CLUB will continue to provide programs and services to youths from low-and moderate-
income households of the Fifth Supervisorial District and the City of San Bernardino.
Unless as specified otherwise, ECD shall have the authority to represent COUNTY regarding the terms and
conditions of AMENDMENT and the administration thereof, and CITY Department of Parks, Recreation, and
Community Services shall have the authority to represent CITY regarding the terms and conditions of this
Contract and the administration thereof. CITY shall provide COUNTY with all documents necessary to comply
with CDBG Program regulations.
2. Replace CONTRACT Section 4, with new FUNDING
FUNDING
COUNTY has provided CDBG funds in the amount of ten thousand ($ I 0,000) for the purchase and installation of
a new swimming pool pump, and for the construction of a computer room in the FACILITY. COUNTY shall
provide additional CDBG funds in the amount of thirty-six thousand dollars ($36,000) for the construction of
IMPROVEMENTS as described in Section I, SCOPE OF WORK in this first amendment to CONTRACT.
CITY will provide funds from various sources in the amount of thirty eight thousand six hundred and thirty eight
dollars ($38,638) for utility payments and continued maintenance of FACILITY.
. 3. Replace CONTRACT Section 3, with new TIME OF PERFORMANCE
TIME OF PERFORMANCE
The term of this contract shall be extended and continue in force for not less than ten (IO) years following the
date of completion of IMPROVEMENTS. CITY shall notify COUNTY of said date of completion of
IMPROVEMENTS.
4. Replace CONTRACT Section 7, with new MAINTENANCE AND OPERATION
MAINTENANCE AND OPERATION
CLUB shall have sole responsibility for the maintenance of IMPROVEMENTS at the sole expense of CLUB for
a period of not less than ten (10) years beginning upon the date of completion of IMPROVEMENTS.
FACILITY and IMPROVEMENTS shall be maintained at all times in accordance with federal, state and local
laws, regulations and safety standards.
5. Replace Section 10, CONTRACT COMPLIANCE with new CONTRACT COMPLIANCE
CONTRACT COMPLIANCE
CLUB will take all necessary affirmative steps to assure that minority firms, women's business enterprises, and
Labor Surplus Area Firms (a firm located in an area of high unemployment) are used when possible in
compliance with provisions of Title 24 Code of Federal Regulations Part 85.36(e).
CLUB shall comply with Executive Orders 11246, 11375, 11625, 12138, 12432, 12250, Title VII of the Civil
Rights Act of 1964, the California Fair Employment and Housing Act, County Policy 15-01, and other applicable
Federal and State and County laws, regulations and policies relating to equal employment and contracting
opportunities, including laws and regulations hereafter enacted.
CLUB shall make every effort to ensure that all projects funded wholly or in part by CDBG Program funds shall
provide equal employment and career advancement opportunities for minorities and women. In addition, CLUB
shall make every effort to employ residents of the area and shall keep a record of the positions that have been
created directly as a result of this Contract.
All other provisions and terms of the Contract, Contract No. 99-369, shall remain the same and are hereby
incorporated by reference.
