SUBJECT:
Public Hearing- 10:00 AM and Resolution Ordering Work- Proposed formation of Assessment
District No. 1018 (Northpark & Mountain - Tract No. 14448).
BACKGROUND:
On January 22, 1996, Resolution No. 96-16 was adopted, approving the final map for Tract No.
14448, located south of North park Bou1evard and east of Mountain Drive,
The developer of this tract, Osborne Development, had requested that the City form an
acquisition assessment district to help finance some of the off site improvements, consisting of
perimeter block walls, landscaping and sidewalks, Normally in these types of districts, the City
acquires the improvements from the developer and then is reimbursed through assessments. For
this district, however, it was proposed that the City wou1d not pay for the improvements, but
wou1d reimburse the developer through the assessments collected.
On March 18, 1996, authorization was given to proceed with the formation of the district and a
petition was submitted that was signed by 100% of the property owners at that time, The
developer also paid the necessary formation costs of $4,000. On August 8, 1996, Resolution No.
96-249 was adopted, authorizing the execution of a Reimbursement Agreement with the
developer. Despite numerous contacts with the developer, the developer only recently submitted
the information necessary for the preparation of the Engineer's Report, consisting of quantities
and costs of the improvements to be acquired.
On June 19,2000, Resolution oflntention No, 2000-136 was adopted setting a public meeting
date of Ju1y 24, 2000 and a public hearing date of August 7, 2000. The Engineer's Report, on file
in the office of the City Clerk, was also preliminarily approved. The Report gives the details as
to the improvements to be acquired, the assessment spread and how the assessments will be
collected, In surmnary, the total cost of the improvements is $218,128.00. This amount will be
spread evenly across the 98 lots within Tract No, 14448, As proposed, the annual assessment per
lot, which includes improvement costs, interest and administrative fees will not exceed $268,77
per year. The total assessment per parcel is $2,225,80 collected over 15 years and may be paid
off in full at anytime.
Ninety-seven of the ninety-eight lots within the proposed district have been sold. As required by
law, all property owners were sent a notice of the public meeting and hearing, by mail. The
notice also included an Assessment Ballot, which the property owners may use to indicate
support or opposition to the proposed assessment.
At the conclusion of public hearing, a determination of the protests and ballots submitted will be
made, If over 50% of the ballots returned are in opposition, the proceedings for the formation

of the assessment district must be terminated. Ballots are weighed ill proportion to the
assessment amount.
In the event that the formation of this district is not successful, the City will have no further
obligation to the developer, as stated on the Reimbursement Agreement.
FINANCIAL IMP ACT:
None. Applicant has paid the $4,000 processing fee. The City will not be up-fronting any costs,
but will reimburse the developer directly from assessments collected if formation of the
Assessment District is approved,
RECOMMENDATION:
Staff reconunends that the hearing be closed, a determination of protests and ballots submitted be
made and, in the absence of a majority protest, the attached Resolution forming the assessment
district be adopted.

DETERMINING THE EXISTENCE OF LESS THAN A MAJORITY PROTEST, AND
THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION
OF CERTAIN IMPROVEMENTS IN THE AREA OF NORTHPARK BOULEVARD AND
MOUNTAIN DRIVE, APPROVING THE FINAL ENGINEER'S REPORT, CREATING AN
ASSESSMENT DISTRICT TO COVER THE COSTS OF SAID IMPROVEMENTS
KNOWN AS ASSESSMENT DISTRICT NO. 1018, ORDERING THE ACQUISITION OF
SAID IMPROVEMENTS, CONFIRMING THE 2000-2001 ASSESSMENT ROLL, AND
DETERMINING THAT THE SPECIAL ASSESSMENT, INVESTIGATION AND
LIMITATION ACT OF 1931 SHALL NOT APPLY.
WHEREAS, pursuant to Chapter 12.90 of the San Bernardino Municipal Code, the Mayor
and Comrnon Council of the City of San Bernardino have preliminarily found that the public
interest, convenience, and necessity require the acquisition of certain improvements in a portion
of the City, as more fully hereinafter described, and the appurtenances and appurtenant work and
incidental costs and expenses in connection therewith, that the project is feasible, and that the lands
to be assessed will be able to carry the burden of the proposed assessments to pay the costs and
expenses thereof; and
WHEREAS, on June 19, 2000, the Mayor and Common Council of the City of San
Bernardino preliminarily approved the Engineer's Report relative to the formation of Assessment
District No. 1018, which is on file in the office of the City Clerk, and adopted Resolution No.

Said resolution was du1y and legally published and notice given of a Public Meeting and a Public
Hearing in the manner required by law, and pUISUant to Section 4 of Article XIIID of the California
Constitution, all property owners given notice were also given an Assessment Ballot to indicate
support or opposition to the proposed assessment, and written objections and protests, if any, to
the formation of the proposed district, the work to be done or the extent of the district to be
assessed were heard and considered; and
WHEREAS, a Diagram of the Assessment District has been prepared and is on file in the
office of the City Clerk; and
WHEREAS, said Engineer's Report sets forth the description of the improvements to be
acquired, the total cost of said improvements, an assessment according to benefit and the
assessment spread; and
WHEREAS, said Engineer's Report sets forth the total assessment to be levied against
each parcel with Assessment District No, 1018; and
WHEREAS, said Engineer's Report sets forth the maximum annual assessment to be levied
against each parcel within the boundaries of Assessment District No.1 018,
BE IT RESOLVED BY TIlE MAYOR AND COMMON COUNCIL OF TIlE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. That a Public Meeting having been held on July 24, 2000 and a Public
Hearing having been held on August 7, 2000, the Mayor and Conunon Council, having heard and
considered any and all conunents received thereon and being fully advised in the premises, hereby
determine that any and all protests received represent less than a Majority Protest, as represented
by the assessment ballots submitted.

SECTION 2. That assessment ballots having been received and tabulated at the conclusion
of the Public Hearing, it is hereby determined that the ballots submitted in opposition to the
assessment do not exceed the ballots submitted in favor of the assessment, weighing the ballots
according to the proportional fmancial obligation of the affected property,
SECTION 3. That it is hereby determined that all properties, parcels and lots within the
boundaries of the Assessment District receive a local and direct benefit for the woiles of
improvement as proposed for said Assessment District, and it is hereby further determined arid
declared that all assessable costs and expenses have been apportioned and spread over the
properties within the boundaries of the Assessment District in direct proportion to the benefits
received thereby,
SECTION 4, That the public convenience and necessity require the proposed maintenance
and the Mayor and Conunon Council hereby order, by an affirmative vote of not less than 4/5ths
of its members present and voting, the formation of Assessment District No, 1018, along with the
acquisition of improvements described in said Resolution No, 2000-136 and said Engineer's Report
as herein approved and that the Special Assessment, Investigation and Limitation Act of 1931 shall
not apply,
SECTION 5, That the Engineer's Report relative to the formation of Assessment District
No, 1018, as now submitted, together with a Diagram of the Assessment District, both on file in
the office of the City Clerk, are hereby accepted and approved and that said Engineer's Report shall
stand as the Report for all future proceedings for this Assessment District.
SECTION 6, That the Mayor and Conunon Council do hereby find and determine that the

proportionate costs to be levied against each parcel ofland within Assessment District No.1 018
are correctly set forth in said Engineer's Report, as now approved, and on file in the office of the
City Clerk of the City of San Bernardino, and do hereby confirm said assessments to be as follows:
A. The total assessment representing the total cost of improvements to be acquired,
B, The 2000-2001 total annual assessment in the amount of 526.339.35
SECTION 7, That the City Clerk is directed to cause a copy of the assessment diagram and
a Notice of Assessment to be filed in the office of the County Recorder of San Bernardino County.
SECTION 8. That the City Clerk is hereby directed to cause a Notice of Assessment to be
mailed to each owner of real property within the Assessment District and shall publish a Notice of
Filing of Assessment in the San Bernardino County Sun, a newspaper of general circu1ation within
said City.
SECTION 9, That the City Clerk shall cause a copy of this Resolution to be transmitted to
the office of the Auditor-Controller for the County of San Bernardino with the request that the
individual assessments be placed on the subject 2000-200 I property tax bills for collection together
with all other property taxes,
SECTION 8, Reference hereby is made to said Resolution No. 2000-136 and said
Engineer's Report for a description of the work, the extent of the assessment district, the financing

Hearing in the manner required by law, and pursuant to Section 4 of Article XIIID of the California
Constitution, all property owners given notice were also given an Assessment Ballot to indicate
support or opposition to the proposed assessment, and written objections and protests, if any, to
the formation of the proposed district, the work to be done or the extent of the district to be
assessed were heard and considered; and
WHEREAS, a Diagram of the Assessment District has been prepared and is on file in the
office of the City Clerk; and
WHEREAS, said Engineer's Report sets forth the description of the improvements to be
acquired, the total cost of said improvements, an assessment according to benefit and the
assessment spread; and
WHEREAS, said Engineer's Report sets forth the total assessment to be levied against
each parcel with Assessment District No, 1018; and
WHEREAS, said Engineer's Report sets forth the maxirnum annual assessment to be levied
against each parcel within the boundaries of Assessment District No. 1018,

less than a Majority Protest, as represented by the assessment ballots submitted.
SECTION 2. That assessment ballots having been received and tabulated at the conclusion
of the Public Hearing, it is hereby determined that the ballots submitted in opposition to the
assessment do not exceed the ballots submitted in favor of the assessment, weighing the ballots
according to the proportional financial obligation of the affected property.
SECTION 3. That it is hereby determined that all properties, parcels and lots within the
boundaries of the Assessment District receive a local and direct benefit for the works of
improvement as proposed for said Assessment District, and it is hereby further determined and
declared that all assessable costs and expenses have been apportioned and spread over the
properties within the boundaries of the Assessment District in direct proportion to the benefits
received thereby,
SECTION 4. That the public convenience and necessity require the proposed maintenance
and the Mayor and Conunon Council hereby order, by an affirmative vote of not less than 4/5ths
of its members present and voting, the formation of Assessment District No. 1018, along with the
acquisition of improvements described in said Resolution No. 2000-136 and said Engineer's Report
as herein approved and that the Special Assessment, Investigation and Limitation Act of 1931 shall
not apply,
SECTION 5. That the Engineer's Report relative to the formation of Assessment District
No, 1018, as now submitted, together with a Diagram of the Assessment District, both on file in
the office of the City Clerk, are hereby accepted and approved and that said Engineer's Report shall
stand as the Report for all future proceedings for this Assessment District.

SECTION 6, That the Mayor and Conunon Council do hereby find and determine that the
proportionate costs to be levied against each parcel of land within Assessment District No. 1018
are correctly set forth in said Engineer's Report, as now approved, and on file in the office of the
City Clerk of the City of San Bernardino, and do hereby confirm said assessments to be as follows:
A, The total assessment representing the total cost of improvements to be acquired.
B. The 2001-2002 total annual assessment in the amount of $26.339.35
SECTION 7, That the City Clerk is directed to cause a copy of the assessment diagram and
a Notice of Assessment to be filed in the office of the County Recorder of San Bernardino County.
SECTION 8, That the City Clerk is hereby directed to cause a Notice of Assessment to be
mailed to each owner of real property within the Assessment District and shall publish a Notice of
Filing of Assessment in the San Bernardino County Sun, a newspaper of general circulation within
said City,
SECTION 9. That the City Clerk shall cause a copy of this Resolution to be transmitted to
the office of the Auditor-Controller for the County of San Bernardino with the request that the
individual assessments be placed on the subject 2001-2002 property tax bills for collection together
with all other property taxes.
SECTION 8, Reference hereby is made to said Resolution No. 2000-136 and said
Engineer's Report for a description of the work, the extent of the assessment district, the financing
alternatives and for further particulars.

Assessment District 1018
1. Since when is the City in the business of assessing taxes on their citizens to
help a private developer recoup his cost for the construction of sidewalk,
block walls and installation of landscaping and appurtenances? Weren't
these improvements required in order for the builder to get approval and
permits to build this tract? I feel, along with many of the homeowners that
these cost should have and probably were already included in the price of
our homes, and if not, why weren't they? Why form this assessment
district?
2. Mr. Osborne's request that the city create assessment district 1018 is based
on Proposition 218. This proposition was voter approval for local
l!overnment taxes. Proposition 218 was meant to set limitations on fees,
assessments, and charges. For example, homeowners may pay assessments
for sidewalks, streets, lighting, or recreation programs in their
neighborhood. It was not meant to tax it's citizens for the benefit of a
private developer, it was meant to recoup monies spent bv the local
l!overnment to pay for projects and services that benefit specific
properties.
3. Some of the features boasted on Northpark II's brochure stated
that concrete driveways and walks were included as well as block
wall fencing (most perimeter lots.) I, and most of the homeowners
I spoke with assumed these were all included in the price of the homes we
purchased.
4. A letter to the homeowners dated July 26, 2000 from Lori Ferguson,
director of sales and marketing for Osborne Development Corporation is
misleading. It states that the establishment of Assessment District
No. 1018 within Tract 14448 is for the construction of and continued
maintenance of sidewalks, block walls, and installation of landscaping.
That the assessment will provide for the City of San Bernardino acquiring
and maintaining sidewalks, masonry wall and landscaping along
Northpark Blvd., Mountain Ave. and Hill Drive. The maintenance is
already being paid for through Assessment District No. 1019, which we are
already been taxed on.

Dear Homeowner:
At the time you purchased your home, we advised you that the City of San Bernardino at some future date,
establish an assessment district within Tract 14448 for construction of and continued maintenance of
sidewalks, block walls, and installation of landscaping along portions of Northpark Boulevard. Mountain
Drive, Hill Drive and "H" Street. This assessment will provide for the City of San Bernardino acquiring
and maintaining sidewalks, masonry wall and landscaping along Northpark Boulevard, Mountain A venue
and Hill Drive.
In the event that the property owners do not approve the assessments, the only other funding source for the
proposed maintenance of the masonry walls, landscaping and sidewalks is the contract you signed.
You, as homebuyer, executed a "Notice of Assessment District," a copy of which is enclosed. The contract
states:
"We, the undersigned, further unconditionally agree to pay the above
described assessment in accordance with the terms and conditions set
forth herein."
It is important that you return the ballot to the City confJIming your approval of the assessment. If the
assessment is not approved, you are still contractually obligated to pay the assessment in full. By
approving the assessment, you will be able to spread that obligation out over a period of 15 years.
Otherwise, you are contractually obligated to pay the entire sum at once.
For your convenience, we are enclosing a copy of the ballot and request that you approve the assessment
and return the ballot immediately to the City in the enclosed self-addressed, stamped envelope.
