SUBJECT
Resolution authorizing the execution of a purchase order between the City of San Bernardino and
Labrie Equipment Limited for fourteen (14) automated side loading refuse trucks and bodies to be
utilized by the Public Services Department; and authorizing the Purchasing Manager to solicit
competitive rate quotes for the lease-purchase of the fourteen trucks.
BACKGROUND
The Public Services Department FY2oo0/01 Budget provides for the replacement of fourteen (14)
automated side-loading refuse collection vehicles. These vehicles are used daily in the collection of
solid waste, conuningled recyclables and green waste from 38,000 residential customers. The City
currently operates 37 automated collection trucks; the oldest trucks in the fleet are 1989 models.
The Refuse Division is currently experiencing more frequent service interruptions due to increased
breakdowns and component failures.
Notices inviting bids for Automated Side-Loading Refuse Trucks, Bid No. F-00-49, were mailed to
16 vendors, the San Bernardino Chamber of Commerce and advertised in The San Bernardino
County Sun newspaper and the City Web page. Nine (9) bids were received and opened on May 22,
2000. No known chassis or refuse body manufacturers are located within the City of San
Bernardino. The bids consist of two parts: a truck chassis manufacturer and a refuse body
manufacturer. Therefore, some chassis vendors, in order to represent a variety of body
manufacturers submitted multiple bids using the same chassis with different bodies. In the
following list, the first name is the chassis vendor, the second name is the body manufacturer. The
following bids were received:

Because of life cycle and maintenance concerns resulting from previous automated residential
collection truck purchases, the Department required each vendor to provide a demonstration truck
to be operated a minimum one day on the City's routes and for inspection by the mechanics. In
order to control the demonstration and achieve consistency of fmdings, the same two drivers were
used to test all demonstration models. The Department originally required each vendor to provide a
demonstration unit within twenty days of bid opening; however, due to scheduling difficulties with
all the vendors, this period was extended to July 31,2000. RDO Truck/ Amrep, Cannenita
TrucklHeil7oo0 and Carmenita Truck/Heil Rapid Rail did not provide a demonstration unit in the
time allocated and therefore were disqualified.
Staff from the Fleet Division visited each vendor's parts and warranty facility to ensure that
adequate spare parts and facilities to perform warranty work were available. All vendors were
requested to provide specific requirements relating to warranty. Because of early wear-out problems
with the previous automated residential refuse tnlcks, the Department required that the body vendor
warrant the body and arm for a full-five years of normal residential operation. Any warranty repairs
controlled by the vendor must be completed within ten (10) days or the City would reserve the right
to charge back to the vendor $300 per day for each day overdue.
As a result of this extensive process, the City has detennined that Labrie Equipment Limited of
St.Nicholas, Quebec, Canada is the best and lowest bidder for the following reasons:
. Labrie provided the required five-year arm and body warranty, permitted warranty work to be
performed by the City at the Fleet Division with reimbursement of such work by the Vendor,
and guaranteed parts availability for a five-year period. Only one other vendor provided these
warranty features.
. The arm of the tested unit cycled faster than any of the other competitive units, achieving a
higher productivity rate and a higher tonnage per load. One load of 372 containers weighing 12.1
tons was achieved in two hours and forty-five minutes. The second load of 388 containers
weighing 8.25 tons was achieved in two-hours and fifty minutes. This worked out to an average
of 26 seconds per stop and was the highest productivity of any of the demonstration units
tested. lbis compares to our current collection tnlcks that pick up an average of 469 containers
in three hours and thirty minutes with an average weight of 9.145 tons at an average of 50
seconds per stop.
. The unit collection arm cycle operates while the engine is in idle and the transmission is in gear.
Other units require the operator to accelerate the engine and to shift in and out of gear to
operate the loading cycle. This feature on the Labrie unit results in fuel savings of 8 to 10
gallons per day per unit. The fuel savings for these fourteen units over a one year period is
approximately 26,208 gallons with a savings of $36,167.07 at $1.38 per gallon of diesel. In
addition, by not shifting the truck in and out of gear and accelerating the engine to operate the
loading cycle, it will significantly reduce the amount of wear on both the engine and
transmission, as well as reduce the amount of air emission and noise generated within the
neighborhoods. Only one other vendor provided this feature.
. The Labrie tnlcks are equipped with both a vane and piston hydraulic pump system. The
temperature of the hydraulic fluid on the Labrie tnlck did not exceed 30 degrees above ambient
temperature. All of the other trucks' hydraulic systems operated at higher temperatures. This
will result in an extended life for all hydraulic components, including the hoses. Hydraulic hose
failures are a significant source of out-of-service on the existing trucks.
. Both the drivers and the mechanics noted in their review that the Labrie Truck operated
smoothly when loading, thus reducing unnecessary vibration and violent rocking of the vehicle.
The mechanics noted that the packing blade of the Labrie truck does not ride on the body's
floor as do the other vendors. lbis feature eliminates the largest cause of floor wear and
premature failure. Replacement of floors on the existing refuse trucks occurred when the tnlcks
reach three years and required approximately $8,000 per tnlck and up to four (4) weeks out-of
service. None of the other vendors offered this feature.

. Labrie provided an estimated five (5) -year annual maintenance cost as part of their package, as
requested. None of the other vendors submitted this data. The five (5)-year maintenance costs
were $4,680 for the first year, $7,020 for the second year, $10,530 for the third year, $10,530 for
the fourth year and $12,870 for the fifth year for a total estimate per truck maintenance cost of
$45,630 for five years, and an average maintenance cost of $9,126 per year. The total
maintenance cost for these fourteen trucks during the first five (5) years is estimated at $638,820.
This compares to the total cost, for maintenance of fourteen (14) of the existing 1995 automated
trucks, of $3,585,750, based on the previous five years average maintenance costs. We cannot
determine the estimated five-year costs of the other trucks, since the vendors failed to provide
this data. The Labrie units are $20,240 higher per unit than the lowest price vendor, for a total
additional cost of $283,360 over the lowest bidder.
. Using the average maintenance costs of the fourteen existing trucks, the total maintenance cost
over five years with the existing fleet is $3,585,800. The Department believes that the
maintenance costs for these new trucks may result in savings of $294,700 less the higher
acquisition cost of $283,360 for a net savings of $2,663,570.
. Interviews with two users of the Labrie truck, USA Waste located in Redding, California (one
unit) and Waste Management of Savage, Minnesota (9 units of this model and 35 of another
model.) were very positive regarding the reliability, operability and maintainability. The
comments included: "It's a good running vehicle, is low maintenance and he would buy another
one;" "Very smooth running truck, the operators love them, had a couple of little bugs when
they first got them, but Labrie was right there. Service was great..
We have attached copies of the comments received from the drivers and mechanics relating to the
Labrie trucks, as well as the Labrie's submittal to our specification.
FINANCIAL IMPACT
The Public Services Department is recommending the purchase of fourteen (14)automated side
loading refuse trucks and bodies at a cost of $187,360.01 per unit at a total cost of $2,623,040.14.
The Refuse Division is anticipating use of a lease purchase agreement to acquire these vehicles.
Annual lease payments will be determined once the Purchasing Manager obtains lease purchase
quotes. Estimated semi-annual payments on a four (4) year lease will be approximately $377,600
each.
Funding for the estimated lease payments for fourteen (14) side loading refuse collection trucks and
bodies was included in the Fiscal Year 2000/2001 Refuse Budget, account number 527-413-5803.
RECOMMENDATION
Adopt the resolution authorizing the Purchasing Manager to issue a purchase order for fourteen (14)
automated side-loading residential refuse collection trucks to Labrie Equipment Limited of St.
Nicholas, Quebec, Canada in the amount of $2,623,040.14; and authorize the Purchasing Manager to
solicit competitive rate quotes to lease-purchase the fourteen new trucks.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF TIlE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. That Labrie Equipment Limited is the best and lowest bidder for the
furnishing and delivery of fourteen (14) each, automated side-loading refuse trucks and bodies in
accordance with Bid Specification F-OO-49 for the total amount of $2,623,040.14; pursuant to this
determination, the Purchasing Manager is hereby authorized and directed to issue a purchase order
for said fourteen (14) automated side-loading refuse trucks and bodies to said Labrie Equipment
Limited; such award shall only be effective upon the issuance of a Purchase Order by the
Purchasing Manager; and all other quotations therefor are hereby rejected.
SECTION 2. That the Purchasing Manager is hereby authorized to solicit competitive
rate quotes for the lease-purchase of the fourteen (14) new automated side loading refuse trucks
and bodies for a period of up to five (5) years.
SECTION 3. The authorization to execute the above referenced purchase order
is rescinded if it is not issued within sixty (60) days of the passage of this resolution.

Staff has discovered that the recommended vendor for the award of bid for the 14 automated
side loader refuse trucks, Labrie Equipment Limited of St. Nicholas, Quebec, Canada, does
not have a valid license. Section 11700 of the California Vehicle Code, states:
"No person shall act as a dealer, remanufacturer, manufacturer, or transporter, or as a
manufacturing branch, distributor, or distributor branch, without having first been issued a
license as required in Section 11701 or temporary permit issued by the department... "
Based on this discovery, it has been determined that none of the vendors were qualified and
we are therefore recommending that the Mayor and Common Council reject all bids, and
authorize the Purchasing Manager to modify the technical specifications and readvertise this
item for bid.

Re: Automaled Refuse Truck Demo's.
Here are my opinions on the Automated Refuse Truck Demos listed in my order of preference with
the pro's and con's to explain them.
1. Labrie
Pro'.
Blade and ann operation was the smoothest of all the demo's
You do nOI have 10 shift in & oul of gear or accelerate the engine to operate ann or packer, resulting
in a cost saving for fuel, engine and transmission maintenance also eliminating many trans. Shifter
repairs.
Truck was able to legally haul largest load of all demo's.
Packing blade does nol ride on floor, eliminating the largest cause of floor wear.
Hydraulic oillemperatures ran the lowest of all demo bUcks, which should resull in the extended life
of all hydraulic Components most especially hosing.
Ann controls can be taken outside of In1ck 10 use while doing assists.
Body Raises with the simplest method and raises the highest allowing easier access.

CLAIM PROCEDURE SUMMARY
The owner of the unit, the local Labrie dealer or any third party company may perform
repairs under the warranty period.
1. Claim number
Prior to performing any repair, a claim number must be obtained through the local
Labrie dealer or the Service and Warranty department at Labrie.
2. Service & Parts
Replacement parts may be purchased at the local Labrie dealer. Any defective parts
must be returned properly identified to the local Labrie dealer with a claim number.
Labrie will take the necessary actions to insure that replacement parts will be available
from a nearly local Labrie dealer or an authorized third party.
3. Reimbursement
To obtain a reimbursement under warranty, the following is required:
. claim form
. copy of the Labrie parts invoice
. proof of labour (copy of work order)
. defective part

Level 3 Product Warranty
Aeroquip warrants, for a period of three (3) years from the date of original
delivery that its products will be free from failure due to defects in material
and workmanship. Aeroquip's obligation under this warranty is limited to
repair or replacement at its factory of any product or component part
thereof which shall be returned to Aeroquip, transportation charges
prepaid, and which, following examination, Aeroquip determines in its sole
discretion to be defective in material or workmanship. This is Aeroquip's
sole warranty. AEROQUIP MAKES NO OTHER WARRANTY, EXPRESS
OR IMPLIED, WITH RESPECT TO ITS PRODUCTS, AND ALL OTHER
WARRANTIES, INCLUDING WITHOUT LIMITATION THE IMPLIED
WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A
PARTICULAR PURPOSE, ARE EXPRESSLY EXCLUDED. Aeroquip
neither assumes nor authorizes any person to change the terms of this
Aeroquip warranty or to assume for Aeroquip any other obligation in
connection with the sale of Aeroquip products. Aeroquip's warranty shall
not apply to any product or component thereof which has been repaired or
altered outside of Aeroquip's factory in any manner so as, in Aeroquip's
sole judgment, to affect its serviceability, to any product which has been
subject to misuse, negligence or accident. or to Aeroquip products which
have been installed or used in a manner contrary to Aeroquip's printed
instructions. Under no circumstances shall Aeroquip be liable for incidental
or consequential damages arising from or in conjunction with the sale, use
or repair of any Aeroquip product.

WARRANTY
1) EQUIPEMENT LABRIE LTEE, hereinafter called ''The company", warrants each new LABRIE Expert 2000
Side Loader to be free from defects in material and workmanship under normal use and service for a period
of ONE YEAR after delivery 10 the first registered owner. The company makes no warranty of products manu-
factured by others and supplied by us, the same being subjec1 to warranties, if any, by their respective manufac-
lurers.
2) EQUIPEMENT LABRIE LTEE, hereinafter called ''The company", warrants each new LABRIE Experl2000
Side Loader hydraulic cylinder to be free from defects in ma1erial and workmanship under normal use and
service for a period of THREE YEARS after delivery to the first registered owner. The company makes this
warranty with the appropriate manufacturer's approval, upon its inspection of the detective item.
DEFINITION OF NORMAL USE AND SERVICE: Normal use and service means the operation of an
equipment for fifty (50) hours per week, following all the recommendations, ensuring proper mainte-
nance and obeying restrictions as described in the owner's manual. It is the owner's responsibility to make
sure that all opera10rs are familiar with the manual and the warning decals on the vehicle.
ANY SERVICE PARTS manufactured and sold by the company are warranted against defects in materials
and workmanship for a period of six (6) months from the date of inslallation. Replacement parts and
components which were sold by Labrie and manufactured by other than Labrie are warranted to the extent
of the warranty of the original manufacturer, but the warranty shall not exceed ninety (90) days from the
date of installation. In both of these cases, a factory inspection must reveal a defect in material or work-
manship. Cost of labor to replace or repair such part(s) and all freight expenses shall be borne by the
owner.
THE COMPANY'S OBLIGATION under this warranty being limited to repairing or replacing any part(s) thereof,
including all accessories, as manufactured by the company, which have been determined by the company, or its
authorized representative, to have been defective. Such defective part(s) will be repaired or replaced, at the
company's option, free of charge and without charge for inslallation to the original user.
OWNER'S OBLIGATION: All warranty claims must be approved by an authorized company representative
prior to any repairs, modifcations and lor the purchase of parts. Parts returned for repair or replacement must
be returned freight pre-paid within thirty (30) days after receipt of new parts.
EXCEPT AS EXPRESSLY SET FORTH ABOVE, the company makes no warranties, express, implied or statu-
lory. Specifically, no warranties 0/ fitness for a particular purpose or warranties of merchantability are made.
Further, the company will not be liable for incidental damages or consequential damages such as but not limited
to loss of use of the product, damage to the product, towing expenses, attorney's fees and the liability you may
have in respect to any other reason.
