RESOLUTION NO. 2009-104
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO APPROVING THE PROPOSED TARGETED
EMPLOYMENT AREA BOUNDARIES FOR THE SAN BERNARDINO
VALLEY ENTERPRISE ZONE
WHEREAS, the purpose of the Enterprise Zone program is to stimulate business and
6 industrial growth in depressed areas of the State by relaxing regulatory controls that impede private
7 investment and in March 2006, the California State Department of Housing and Community
8 Development ("HCD") issued a Request for Proposals to fill twenty-three (23) vacant enterprise
9 zone designations; and
10
WHEREAS, on August 21, 2006, the Mayor and Common Council of the City of San
11 Bernardino ("Council") authorized the submittal of a multi-jurisdiction application to HCD for
12 designation of the San Bernardino Valley Enterprise Zone ("SBVEZ") in addition to approving a
13 Memorandum of Understanding among the City of Colton and the City of San Bernardino ("City"),
14 the County of San Bernardino ("County"), and the Inland Valley Development Agency, as parties
15 to the SBVEZ application setting forth the duties and responsibilities for each jurisdiction; and
16
WHEREAS, on March 5, 2009, HCD issued the SBVEZ its final designation status to take
17 effect on October 15, 2006; and
18
WHEREAS, the Redevelopment Agency of the City of San Bernardino ("Agency") has been
19
delegated the responsibility to carry out the duties of said application on behalf of the City; and
20

WHEREAS, Government Code Sections 7070-7089, require the establishment of "Targeted
Employment Areas" ("TEAs"), composed of census tracts which have at least 51 percent of its
22
23 residents who are individuals or households at low- or moderate-income levels, for the purpose of
24 encouraging businesses in an Enterprise Zone to hire eligible residents, of those geographical areas
25 of the members of the SBVEZ, who are most in need of employment targeting as said TEAs are
26 illustrated on Exhibits "A" and "B" attached hereto and by this reference made a part hereof; and

WHEREAS, Governmental Code Sections 7070-7089 require the City, as well as the other
governmental entities that have territorial jurisdiction over any part of each eligible census tract

1 within the proposed TEA, to approve the proposed TEA boundaries by Resolution or Ordinance;
2 and
3 WHEREAS, it is incumbent upon the jurisdictions that are parties to the SBVEZ to
4 establish TEAs within their jurisdictional boundaries in accordance with Governmental Code
5 Sections 7070-7089.
6 NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND ORDERED BY
7 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, AS
8 FOLLOWS:
9 Section 1. The Council hereby finds and determines that the facts and circumstances set
10 forth in the Recitals hereof are true and correct in all respects. The Council acknowledges receipt of
11 the Staff Report as presented to the Council and hereby approves this Resolution.
12 Section 2. The Council approves the following census tracts, lying wholly or partly within
13 the jurisdiction of the City, which have been designated by the U.S. Department of Housing and
14 Urban Development in conjunction with the most recent United States Census Bureau data as
15 having at least 51 percent of the residents being of low- or moderate-income levels, and are hereby
16 identified as the proposed TEAs for the SBVEZ as further illustrated on Exhibits "A" and "B":

18 56, 57, 58, 59, 60, 61, 62.01, 62.02, 63.01, 64.01, 66, 67, 68, 69, 70, 71.08, 91.06,
19 91.07,104.02, 108.oI, 108.02, 110, 113, 114, 115
20 Section 3. This Resolution shall take effect upon its adoption and execution in the manner
21 as required by the City Charter.
