A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CUY OF SAN BER-
NARDINO DECLARING ITS INTENTION TO ORDER WORK IN PORTIONS OF FIFTY-
EIGHTH SlREET BETWEEN MAYFIELD AVENUE AND PERSHING AVENUE; MAYFIELD
AVENUE BETWEEN A POINT APPROXIMATELY 60.00 FEET SOUTH OF THE CENTER-
LINE OF FIFTY-EIGHTH STREET AND A POINT APPROXIMATELY 350.00 FEET
NORTH THEREOF; ELECTRIC AVENUE BETWEEN HILL ALLEY AND FIFTY-EIGHTH
STREET; PERSHING AVENUE BETWEEN FIFTY-EIGHTH STREET AND HILL DRIVE;
HILL ALLEY BETWEEN ELECTRIC AVENUE AND PERSHING AVENUE; HILL DRIVE
BETWEEN PERSHING AVENUE AND I~. VIEW AVENUE, IN THE CITY OF SAN
BERNARDINO.
WHEREAS, the Neyor and Common Council of the City of San Bernar-
dino, by Ordinance No. 2063, adopted Yay 16, 1955, established a
procedure for finding and determining whether the public convenience
and necessity require certain improvements or acquisition of prop-
erty, and authorizing notices and hearings to be combined and held
concurrently with the hearing required by the improvement act pur-
suant to which the improvement proceeding is proposed.
NOW", THEREFORE, THE lfAYOR AND COIVJMON COUNCIL OF THE CITY OF
SAN BERNfu<DINO DO RESOLVE AS FOLLOViS:
SECTION 1. That pursuant to Ordinance No. 2063, said Neyor and
Common Council hereby elect to combine the hearing required therein
with the hearing required by Section 5132 of the Streets and High-
ways Code of the State of California.
SECTION 2. That it is the intention of said Mayor and Common
Council to order the improvement of portions of Fifty-eighth Street
between Wayfield Avenue and Pershing Avenue; Wayfield Avenue between
a point approximately 60.00 feet South of the centerline of Fifty-
eighth Street and a point approximately 350.00 feet North thereof;
Electric Avenue between Hill Alley and Fifty-eighth Street; Pershing
Avenue between Fifty-eighth Street and Hill Drive; Hill Alley be-
tween Electric Avenue and Pershing Avenue; Hill Drive between
Pershing Avenue and Mt. View Avenue, in said City, in the following
manner, to-wit:
The construction of Portland cement concrete curb, curb and
gutter, Asphalt concrete berm and paving, and Drainage facilities
in portions of Fifty-eighth street between Nayfield Avenue and
Pershing Avenue; ~ayfield Avenue between a point approximately
60.00 feet South of the centerline of Fifty-eighth Street and a
point approximately 350.00 feet North thereof; Electric Avenue
between Hill Alley and Fifty-eighth Street; Pershing Avenue between
Fifty-eighth Street and Hill Drive; Hill Alley between Electric
Avenue and Pershing Avenue; Hill Drive between Pershing Avenue and
Ntt. View Avenue.
Reference is hereby made to Drawing No. 3112 and any supple-
mental drawings mentioned thereon, on file in the office of the City
Engineer of said City, and to Specifications No. 2271, on file in
the office of the City Clerk of said City, for a full and detailed
description of the said proposed work and improvement, the par-
ticular locations thereof, and the lines upon which, and grades to
which, it shall be done; provided that where lines or grades there-
for, or for any portion thereof, are not shown by, or set forth upon,
such drawings, said proposed work and improvement shall be done upon
the official lines and to the official grades therefor.
SECTION 3. That said contemplated work and improvement is of
more than local or ordinary public benefit, and that said Mayor and
Common Council do hereby make the expense of such work and improve-
ment chargeable upon a district, which district is hereby declared
to be the district benefited by said proposed work and improvement,
and to be assessed to pay the cost and expense thereof, and which
district embraces all that real property situate in the City of San
Bernardino, County of San Bernardino, State of California, as out-
lined in red on District Map No. 3112 A.D., on file in the office
of the City Clerk of said City. All public streets or alleys, or
portions thereof, hereby are excepted from said district.

SECTION 4. That serial bonds extending over a period of nine
years from the second day of January next succeeding the next
September 1st following their date, and bearing interest at the rate
of six per cent per annum, payable semi-annually, shall be issued
as provided by the Improvement Act of 1911 to represent assessments
of Fifty Dollars or over for the cost of said proposed work and im-
provement, remaining unpaid for thirty days after the date of the
warrant.
SECTION 5. If any delinquency shall occur in any payments as
set forth in California Streets and Highways Code, Section 6442,
the City lreasurer shall add to and collect such penalties with and
as a part of the delinquent payment as therein provided. The 1 per
cent penalty first imposed shall be retained by the treasurer as a
cost of servicing the delinquency. All bonds issued by the City in
accordance with this Act shall provide for the retention of proceeds
of any delinquency penalty as set forth in Section 6442 of said Act.
SECTION 6. That The San Bernardino Evening Telegram, a daily
newspaper published and circulated in said City, is hereby designated
as the newspaper in which this Resolution of Intention, and all fur-
ther notices and resolutions relating to said work and improvement,
shall be published.
SECTION 7. That notice is hereby given that on February 6,
1967 at the hour of 9:30 A.M., in the Council Chamber, in the City
Hall, in said City, there shall be a public hearing before said
~~yor and Common Council for the purpose of determining whether the
public convenience and necessity require the above described improve-
ment, and at which time and place any and all persons having any
objections to such determination or to the proposed work or improve-
ment may appear and show cause why the N~yor and Common Council
should not find that the public convenience and necessity require

the above described improvement and why the said work or improve-
ment should not be carried out in accordance with this resolution.
SECTION 8. '!hat said ~ayor and Common Council, in making the
improvement, elects to proceed under and in accordance with the pro-
visions of the "Improvement Act of 1911", being Division 7 of the
Streets and Highways Code of the State of California.
