Further, the recommended action is in compliance with the Health and Safety Code Section 33679 concerning the use of Agency revenueo for the purpose of aBBiBling in the acquisition and construction of the San Bernardino Central Police Station. BACKGROUND On May 16, 1994, the City and Agency approved the borrowing of bond proceeds from the San Bernardino 10int Powers Financing Authority, Tax Allocations bonds (Issue of 1994 - Police Station F"mancing Project). The purpose was to provide funds to enable City acquisition and construction of a new police Blation. The City has indicated it will be able to contribute approximately five million dollars ($5,000,000) net funds to the construction of the station. In order to aBBiBl in the project's construction, staff has propoeed that the Agency issue tax allocation bonds. The bonds would be secured by tax increment revenues from the Agency's State College Project No.4 in an amount not to exceed ten million dollars ($10,000,000). The bond issue would be Bltuctured to allow the San Bernardino loint Powers F"mancing Authority (JPFA) to issue the bonds and enter into a loan agreement with the Agency for repayment of the bonds. The total amount of tax increment revenues eBlitnated to be used to repay the bonds totals fourteen million, two-hundred and fifty dollars ($14,250,000). This methodology of financing is in harmony with the recommendstions of Miller and Schroeder Financial, Inc., the prospective f"mancial underwriter and has been reviewed and approved by Agency bond counsel. There is no other reasonable means to f"mance the police Blotion. The City has budgeted to pay the maximum it can contribute and the remainder will be paid by the Agency. The tranBaction, as propoeed, will aBBist the e1imination of blight within the project by providing a safe environment for residenlB and employees of the project area. Such action will increase stagnant property values, stabilize and increase the viability of impaired inveatmenlB, reduce abnonna1ly high busineBB vacancies, directly spur or encourage the development of abandoned buildings and vacant 1018. The spin-off ramifications of these immediate benefilB, prompted by heightened confidence within the development community, is an increase in jobs and reduction of crime due to the increased density, more activity, the mere presence of the police station and other nearby pending and propoeed uses. Pursuant to State law, in order to use tax increment revenues for the acquisition and construction of land and improvemenlB, the Agency must hold a public hearing which has been duly noticed in a newspaper of general circulation (San Bernardino Sun). RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, MAKING FINDINGS AND DETERMINATIONS AS TO THE BENEFIT OF A POLICE STATION FACILITY TO STATE COLLEGE PROJECT NO. 4 WHEREAS, the city of San Bernardino, California (the "City"), is a municipal corporation duly created and existing pursuant to the Constitution and the laws of the State of 9 California (the "City"); and 10 11 WHEREAS, the Redevelopment Agency of the City of 12 San Bernardino (the "Agency"), is a redevelopment agency, a 13 public body, corporate and politic of the State of California, o 14 organized and existing pursuant to the community Redevelopment 15 Law (Part 1 of Division 24 commencing with section 33000) of the 16 Health and Safety Code of the State of California (the "Act"); 17 and 18 19 WHEREAS, pursuant to section 33445 of the Act, the 20 Agency may, with the consent of the Mayor and Common Council of 21 the city (the "council"), pay all or a part of the cost of 22 installation and construction of any building, facility, 23 structure or other improvement which is publicly owned either' 24 within or without the boundaries of a redevelopment project area 25 if the Council determines: (1) that such buildings, facilities, 26 structures or other improvements are of benefit to the 27 redevelopment project area or the immediate neighborhood in which 28 the project is located, regardless of whether such improvement is o -1- ~ o o o o o 1 within another project area, or in the case of a project area in 2 which substantially all the land is publicly owned that the 3 improvement is of benefit to an adjacent project area of the 4 Agency, (2) that no other reasonable means of financing such 5 buildings, facilities, structures or other improvements is 6 available to the community, and such determination by the Agency 7 and the Council shall be final and conclusive, and (3) that the 8 payment of funds for the cost of the facilities, structures or 9 other improvements will assist in the elimination of one or more 10 blighting conditions inside the project; and 11 12 WHEREAS, the City and the Agency have previously 13 approved and adopted the Redevelopment Plan for the State College 14 Project No. 4 (the "Redevelopment Plan"); and 15 16 WHEREAS, it is in the interests of the present 17 landowners within the project area subject to the Redevelopment 18 Plan (the "Project Area") and the residents, both within the 19 proj ect Area and wi thin the city generally, that the Agency 20 causes the construction of a certain police station located at 21 700 North "D" Street (the "Police Station"); and 22 23 WHEREAS, the Police station will provide needed 24 protective services to the City of San Bernardino which will 25 include services to the members of the Project Area who are in 26 need of such services; and 27 28 -2- ~ o o o o o 1 WHEREAS, stagnant property values, impaired 2 investments, high business vacancies, low lease rates and 3 abandoned buildings and vacant lots are conditions which 4 constitute blight within the Project Area; and 5 6 WHEREAS, the Police station shall provide protective 7 services and employment opportunities within the Project Area and 8 thereby eliminate blighting conditions which adversely impact the 9 proj ect Area; and 10 11 WHEREAS, the Police Station will serve the entire city, 12 including the Project Area and therefore will benefit the 13 residents and occupants of the Project Area who rely on the 14 provision of such police services; and 15 16 WHEREAS, providing the Police station facility to serve 17 the Project Area will make the Project Area more desirable and 18 will increase the incentives for economic reinvestment in the 19 Project Area, thereby contributing to the elimination of existing 20 blighting conditions in the Project Area; and 21 22 WHEREAS, in order to promote the City's health, safety 23 and welfare, it is important that the Police station be financed 24 with tax increment revenues to ensure the orderly and timely 25 development of the Project Area and neighboring areas; and 26 27 28 -3- c? o o o o o 1 WHEREAS, it is appropriate at this time for the Agency 2 to make certain findings and determinations and take certain 3 action with respect to the construction of the Police station. 4 5 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 6 COUNCIL OF THE CITY OF SAN BERNARDINO, AS FOLLOWS: 7 8 Section 1. The Recitals hereinabove are true and 9 correct and are incorporated herein by this reference. 10 11 Section 2. The city consents to the payment by the 12 Agency from tax increment revenues of the costs of the 13 acquisition and construction of a new police station which is of 14 benefit to the Project Area and other neighborhoods within the 15 City for the reasons set forth in the Recitals hereinabove. The 16 city also finds and determines that no other reasonable means of 17 financing the construction of the Police station is presently 18 available to the City and that the city and the Agency require 19 the use of revenues generated from the Project Area in order to 20 fund the construction of the Police station. The City further 21 finds that the construction of the Police station will provide 22 needed protective services and enhance the desirability of the 23 City for economic investment, which in turn will enhance economic 24 investment in the Project Area and thereby eliminate existing 25 blighting conditions. 26 27 Section 3. The construction of the Police Station 28 will provide needed health and safety services and employment -4- ~ o o o o o 1 related opportunities to the entire city. Such services and 2 opportunities will make the city more desirable for use by 3 residents and occupants of the Project Area and more desirable 4 for development in order to help eliminate blight within the 5 Project Area and other areas of the city. 6 7 Section 4.
