01-04-87 -- Resolution No. 87-35 adopted authorizing execution of
Development Agreement with State.
June, 1987- Allocation of $2,330,408 approved in 1986/87 Budget for
design and construction.
09-19-88 Plans approved and authorization granted to advertise
for bids.
03-20-89 -- Resolution No. 89-85 adopted, awarding a contract for
the low bid price of $2,018,625.32.
05-15-89 Addition of underground electrical services and a rest-
room building to the contract for Phase I-B approved.
06-19-89 Change Order No. One approved, increasing the contract
price by $29,555.00 from $2,018,625.32 to $2,048,180.32.

Recommended motion:
That Change Order No. Four to the contract with Marina Contractors,
Inc., for the construction of Seccombe Lake Park, Phase I-B, in
accordance with Plan No. 7444, be approved; to authorize the Con-
tractor to excavate, transport and dispose of a hazardous under-
ground tank and contents, the surrounding contaminated soil,
and the hazardous material within an underground vault, for an
increase in contract price of $40,959.80, from $2,075,237.92 to
$2,116,197.72.

STAFF REPORT
During construction, an underground storage tank and an
underground vault were encountered within the limits of the
project site. The contents of these containers and the
surrounding contaminated soil were classified as hazardous
material following in-depth testing by our geotechnical con-
sultant and review by the County Environmental Health Department.
Change Order No. Four authorizes the Contractor to pump
out and dispose of the contents of the underground tank, excavate
the tank and the surrounding contaminated soil, haul off and
dispose of the tank, and excavate, haul off and dispose of the
contents of the underground vault. The total cost of Change
Order Four is $40,959.80. Change Order No. One, previously
approved, authorized the Contractor to haul off and dispose of
the contaminated soil surrounding the tank.
The State Parks and Recreation Department has not
approved any additional funding to finance the clean-up of this
existing condition. We will recommend, at the completion of the
project, that an effort be made to secure reimbursement from the
State.
An amount of $106,000 has been transferred from Account
No. 243-363-57528, .Patton Park Development,. to Account No. 243-
363-57502, .Seccombe Lake Restroom & Electrical Work." These
funds can be used to finance the cost of this change order, since
the restroom building will not be constructed by this contract.
SYNOPSIS OF PREVIOUS COUNCIL ACTION Continued:
07-17-89 - Change Order No. Three approved, to authorize the in-
stallation of electrical service, for an increase of
$27,057.60 in the contract price, from $2,048,180.32
to $2,075,237.92.
