STAFF REPORT
Tentative Tract No. 13530 was denied by the Planning
Commission on March 5, 1987.
At the meeting of the Planning Commission on March 17,
1987, Tentative Tract No. 13530 was continued indefinitely, until
such time as the applicant was prepared to present a capital
improvement program for the Verdemont Area.
At the Council meeting of December 5, 1988, Mr. Alan
Walter's appeal was heard. The Mayor and Common Council denied
Mr. Alan Walter's appeal and approved Tentative Tract No. 13530.
The Negative Declaration was also adopted.
Tentative Tract No. 13530 was approved, subject to the
findings of fact and conditions of approval. One condition was
that access from Meyers Road to Mr. Walter's property be pro-
vided. The standard conditions, with the additional stipulations
that the subdivider specifically agree to participate in the
Verdemont Improvement Plan, and to hold the City harmless in the
event any lawsuit is filed, were also placed as requirements.
Tentative Tract No. 13530 is a Forty-Five (45) Lot,
Single Family Subdivision, with an RS-l0800 Land Use Designation.
The required improvement securities and certificates of
insurance have been filed with this office, and the prescribed
fees have been paid. Also, the improvement and grading plans
have been prepared, and are in the process of being approved.
The Final Map has been reviewed and found to be in
substantial compliance with the tentative map and the Subdivision
Map Act. Therefore, we recommend that the Final Map be approved.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING THE
FINAL MAP FOR SUBDIVISION TRACT NO. 13530, LOCATED AT THE
SOUTHWESTERLY CORNER OF OHIO AVENUE AND PALM AVENUE, ACCEPTING
THE PUBLIC DEDICATIONS AS SET FORTH ON SAID MAP; AND AUTHORIZING
EXECUTION OF THE STANDARD FORM OF AGREEMENT FOR THE IMPROVEMENTS
IN SAID SUBDIVISION, WITH TIME FOR PERFORMANCE SPECIFIED.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1:
The Mayor and Common Council find that

provisions for its design and improvements is consistent with the
General Plan of the City of San Bernardino.

The Mayor of the City of San Bernardino is

authorized on behalf of said City to execute the standard form of
agreement adopted by Resolution No.
84-8 with McClellan
Development, a California corporation, for the improvements in
said subdivision tract as are required by Title 18 of the San
Bernardino Municipal Code and the California Subdivision Map Act.
Section 12 (b) (1) of said Agreement is hereby amended to require
public liability insurance in an amount of not less than $250,000
per person and $500,000 per occurrence. The time for performance
is specified at 24 months. Said improvements are specifically
described and shown on Drawings approved and on file in the
Office of the City Engineer of the City of San Bernardino.
SECTION 3: The Final Map of said subdivision tract is
hereby approved and the City of San Bernardino hereby accepts as
public property all dedications within the subdivision as shown
on said Final Map for streets, alleys, (including access rights),

drainage and other public easements'. As a condition precedent to
approval of the Final Map, the Subdivider shall first execute the
agreement referenced in Section 2 hereof for the improvements
4 within said subdivision. The City Clerk shall certify the
5 approval and acceptance of the Mayor and Common Council as set
6 forth in this resolution.

SECTION 4. This resolution is rescinded if the parties
to the agreement fail to execute it within sixty (60) days of the
9 passage of this resolution.
