Recommended motion:
That the appeal hearing be closed, that the approval conditions of
the Planning Commission be modified by deleting Conditions No. l5,
37, 38 and 42, and that the appeal be granted except for the deletion
of Condition 16.

BACKGROUND
Tentative Tract No. l3619 is a 2l lot subdivision in the
Verdemont Area located on a 9.3 acre site at the southwestern
corner of Verdemont Drive and Olive Avenue. The site is
located in the R-l-l4,400, Single-Family Residential Zone
with a RS-10,800 Land Use Designation.
The conditions of approval included the following Standard
Requirement items from the Engineering Department:
Condition No. 15
Comprehensive storm drain project No. 7 E14 is master planned
in the vicinity of your department. This drain shall be
designed and constructed by your project unless your Engineer
can conclusively show that the drain is not needed to protect
your development or mitigate downstream impacts.

Project No. 7-El4 shall be constructed adjacent to the tract
and upstream to the debris basin. construction shall include
the debris basin. Sufficient improvements downstream shall
be made to mitigate downstream impacts.
After the planning Commission heard Tentative Tract No.
l3619, the Engineering and Planning Department received the
attached memos from Kenneth Henderson, Director of Community
Development (Attachment "B"). These memos clarified the
direction of Council in regards to infrastructure
requirements in the Verdemont Area.
The Engineering Department has indicated that they don't have
a problem with dropping Conditions l5, 37, 38 and 42, because
of the Planning Department's inclusion of Condition 44
(Attachment "C") which addresses those infrastructure items.
However, according to the Engineering Department they would
prefer that Condition Number 16 remain, because this
condition is a standard requirement relating to drainage and
is applicable to all proposed subdivisions in the city.
MAYOR AND COUNCIL OPTIONS
That the Mayor and Council may deny the appeal and not delete
Conditions l5, l6, 37, 38 and 42 from the Planning
commission's approval of Tentative Tract No. 136l9;
or
That the Mayor and Council uphold the appeal and delete
conditions No. 15, 16, 37, 38 and 42 from the Planning
commission's approval of Tentative Tract No. 13619;
or
That the Mayor and council uphold to appeal but delete only
Conditions No. l5, 37, 38 and 42, and not delete condition
No. 16 from the Planning Commission's approval of Tentative
Tract No. l36l9.

Honorable Mayor & Common Council:
On July 5, 1988 at a regularly scheduled Planning Commission
hearing, Tentative Tract 13619 filed by Monnig Development Inc.
(MOIl was approved as follows:
In favor - 4
Against - 2
Abstention - 1
Although the application received a favorable vote by the
Commission I feel uncomfortable accepting the conditions applied
to the project by the City Staff.
Several of the conditions contained in the environmental docu-
ments and the conditions of approval are contradictions and
pxcessive due to the conditions contained within the adopted
",lterim Policy Document which are automatically applied to the
project.
I am fully aware of the conditions outlined in the document
entitled Interim Policy Document which was approved by the State
Office of Planning and Research on 6/9/88 and recognize the need
for public improvements to be constructed in the Verdemont Area.
I respectfully request that conditions 15, 16, 37, 38, and 42
be deleted in total due to the requirement for all developments
in a specified boundary within the Verdemont Area to comply with
the Council action taken on June 15, 1988 which addressed certain
public improvements and the development of a financing plan. Fur-
thermore, there is a need to identify those conditions within t~e;' '., ['.. :~.

themselves towards the payment of fee's or the total obliga-
tion to construct off-site improvements and insert a statement in
place of these conditions requiring the projects compliance with
the Interim Policy Documents goals and objectives with respect to
nitigating environmental impacts.
Another issue/condition aside from the standard subdivision
:onditions is item .8 relating to the payment/~eimbursement of
\ttorney's fee's.
I feel that this condition is unnecessary and very unusual.
I wish to reserve this item for further conversation at the
Jub1ic hearing regarding the appeal.
Due to the sensitive issues involving both the community and
~eveloper within the Verdemont Area it is essential that the
Councils actions be clear & decisive for the benefit of all con-
cerned.

Gene, pursuant to my meeting with Planning Director Ann
Siracusa and Principal Planner Vince Bautista and my subse-
quent meeting with you regarding the Verdemont Area Public
Improvement Plan, please initiate proceedings to vacate
Chestnut Avenue in accordance with normal procedures. The
Planning Director has advised that an environmental assess-
ment should be conducted as a part of this process.
It would be appreciated if you would coordinate with the
Planning Department to expedite this task which, when accom-
plished, will facilitate the construction of the Chestnut
Avenue storm drain and debris basin.

I have reviewed the above conditions assessed to Case '1"1'-
l3619 and find what appear to be internal inconsistencies in
what I may inaccurately refer to as conditions of approval.
In the Background Section under Observations, the Planning
Department references the clarification provided by Council-
man Minor on June 20, 1988. As you know, the clarification,
among other things, limited the scope of the public improve-
ment plan ~ to those items set forth in Councilman Minor's
motion in the area bounded by the national forest on the
north, the alignment of Cable Canyon Creek on the south,
Little League Drive on the west and Devil's canyon Creek on
the east. The Planning Department, however, has included as
standard condition number 4 compliance with the requirements
of San Bernardino County Flood Control District, which is
outside the scope of this project and in conflict with
standard condition number 2. The Department has further
required a bridge improvement fee (Palm Avenue Bridge) in the
amount of $3l5.00 which is inconsistent with the direction
given by the Mayor and Common Council.
The action taken by the Mayor and Common Council states as
follows, "The Planning Department was instructed to continue
processing of applications for single family developments on
lO,800 square foot or larger lots within the area described
above~ and the annroval of anv annlication for develonment in
the area was conditioned unon the narticination of develoner
and nronertv owner. as annronriate. in the develonment of the
financina nlan for the imnrovements noted above. and their
aareement to nav their nroDortionate share of said
imnrovements (emphasis added)." It is inappropriate, at this
time, to collect a bridge improvement fee when each developer
and property owner will be required to pay their
proportionate share of the public improvement at some later

date.
I would recommend that a form be developed which each
developer and/or property owner be required to sign, agreeing
in writing to the .above condition. This procedure would be
in addition to the above condition as a standard condition
for projects within the boundaries of the area in question.
The scope of the Verdemont Area Public Improvement Plan is
defined in the action taken by the Mayor and Common Council
on June 20, 1988, which is attached to this memorandum. It
does not include the entire San Bernardino Flood Control
District, nor does it include all of the City's master storm
drain or infrastructure plan for the entire area.
I hope this memorandum provides the necessary clarification
and direction in processing projects for the area as
described hereinabove.

At the meeting of the Mayor and COIIUlIOn Council held on June 20, 1988, the
following clarification was made of Council action of May 23, 1988 regard-
ing the development and adoption of a financing and implementation plan
relative to the Verdemont Area improvement plan:
The Director of Community Development was instructed to coordinate
the development and adoption by the Mayor and Common Council of a
financing and implementation plan for the following improvements in
the area bounded by Little League Drive on the west, the alignment
of Cable Canyon Creek on the south, Devil's Canyon Creek on the east
and the National Forest boundary on the north:
I. Palm Avenue Box Culvert
2. Bailey Canyon Storm Drain and Debris Basin
3. Chestnut Street Storm Drain and Debris Basin
4. Traffic Signal at Palm Avenue and Kendall Drive
5. Installation of CUrbs and Gutters, along with
Full Street Improvements at the Following
Locations:
a. Palm Avenue - frOlll Kendall Drive to
Ohio Street
b. Irvington Avenue - from Chestnut Street
to Pine Avenue
C. Belmont Street - from Chestnut to Pine
Avenue
d. Pine Avenue - frOlll Belmont Avenue to
Ohio Street:
All departments were instructed to give full cooperation to the
Director of Community Development in the development of said plan,
as a time frame of six months has been set by motion of the Mayor
and Common Council:
The Planning Department was instructed to continue the processing
of applications for single family developments on 10.800 square
foot or larger lots within the area described above; and the
approval of any application for development in the area was condi-
tioned upon the participation of the developer and property owner,
as appropriate, in the development of the financing plan for the
improvements noted above, and their agreement to pay their propor-
tionate share of said improvements:

Council Member Minor ~ade a motion, seconded by
Council Member Millet and unanimously carried, that the
Cable Lakes area, bounded on the south by 1-215; north by
Cable Canyon Road; east by Little League Drive, which is
now designated RS, be changed to RL with a minimum lot
size of U,8n.
In a memorandum dated May 18, 1988, Council Member
Minor provided recommended public improvements and
development standards in the Verdemont Area.
Council Member Minor made a motion, seconded by
Council Member Reilly for discussion, that in the area
bounded by Little League Drive on the west, Devil's Can-
yon Creek on the east, the al ignment of Cable Canyon
Creek (flood control channel) on the south and the
National Forest to the north:
1. That no development be approved until a financ-
ing plan for all developers and property owners to share
in the costs of the following improvements totalling $3.6
to $3.9 million has been approved by the Council. The
improvements are as follows:
a. Palm Avenue box culvert
b. Bailey Canyon storm drain and debris basin
c. Chestnut Street storm drain and debris basin
d. Traffic signal at Palm Avenue and Kendall Drive;
2. That a finding be made that the improvements
benefit the entire area, and as such, require the par-
ticipation of every developer and property owner;
3. That any new development in the Verdemont Area
will not be supported until an infrastructure financing
plan has been approved which addresses the projects
listed above as a minimum, and also includes plans for
the installation of cutbs and gutters, along with full
street improvements, at the following locations:
a. Palm Avenue, from Kendall Drive to Ohio Street
b. 1rvington Avenue, from Chestnut Street to Pine
Avenue
c. Belmont Street, from Chestnut to Pine Avenue
d. Pine Avenue, from Belmont Avenue to Ohio Street;

4. That development standards in this motion in-
clude more stringent than current standard.. These
standards should, however, be sllpple~ented and contain
more specificity. The development standards set forth in
the Verdemont Area Plan be adopted by the Council, and
that these development standards be supplemented by the
following:
a. All residential structures (houses, garages,
barns) shall have clay tile or concrete tile
roofs
b. Minimum front set-back requirements are as
follows:

f. All developments opening onto an arterial or
collector street shall provide an entry
treatment.
g. All developments having perimeter fencing shall
use slump stone, split face block, river rock or
concrete block with stucco color coating only.
Wood and/or chain link fencing shall not be
allowed on the perimeter of or corner lots
within any developments.
h. CC&R's: All developments shall include
restrictions covering satellite dishes,
equestrian/hiking trails, screening of storage,
recreational vehicle storage, repair of motor
vehicles and other matters a9proved by Council;

5. And, that these development standards are
effective immediately and include all projects in various
phases of development, including tentative tract maps and
projects going through final engineering as of this date,
May 23, 1988: (See following text for amendment)
And, that a six-month time frame for development of
the infrastructure financing and implementation plan be
imposed.
Discussion ensued regarding the intent of the motion
being that it would pass through the City Attorney's
Office for review and come back in legal form. Also,
befOre development can take place, a financing and an
implementation plan for the infrastructure will be
developed.
Ann Siracusa answered questions regarding the Speci-
fic Plan process accompliShing the need for having the
developer responsible for improvement costs.

immediately. Legal lots of record as of this date, May
23, 1988, are exempt from these development standards.
Ann Siracusa defined the following as needing to be
accomplished before the General Plan can be sent to the.
State of California: finalization of the map, action on
hillside management densities, action on the interim
implementation policies and adoption of a resolution
forwarding the packet to the state with a request for
exemption from the moratorium.

FINDINGS OF FACT
1. All lots created meet or exceed the minimum lot
requirements of Title 19, Zoning Code, and also meet the
requirements of Title 18, Subdivisions, of the San
Bernardino Municipal Code.
2. No lot created is less than the minimum dimension
required by Code.
3. The size and shape of each lot meets the design
requirements of the Planning Department in that adequate
area is provided on each lot to accommodate a residence
with accessory structures and meet the setback
requirements of the zone.
4. All lots created abut on dedicated streets as required
by code. Circulation in the general area will be
enhanced by the construction of connector segment of

The applicants request authority under Municipal Code
Section 18.12.010 to establish a 2l lot subdivision in
the R-14,400, Single-Family Residential Zone.

An Initial Study was prepared by staff and presented to
the Environmental Review Committee on May 5, 1988. The
Committee recommended a Negative Declaration and the
report was advertised and made available for public
review and comment until May 25, 1988. No comments were
received. See Attachment wEw, Initial Study.

This project was submitted March 22, 1988 just after the
March 16, 1988 letter from the State Office of Planning
and Research (OPR) which lifted the moratorium on lots
of 10,800 square feet and over in the Verdemont Area.
The letter from OPR dated June 9, 1988, lifted the
~oratoriuID for the entire City and established the
Interim Policy Document as the city's operating
procedures. The clarification by Councilman Minor dated
June 20, 1988 provided staff clear direction on how to
process the maps and the conditions needed in order to
meet the requiremenlfi or the Interim Policy Document and
the Verdemont Area Plan. This application was continued
from the June 21, 1988 Planning Commission to the July
5, 1988 meeting because of the timing of the letter and
this needed clarification.

RESIDENTIAL DEVELOPMENT
1. ~ TT 13619 shall be in effect for a period of ~ months from the
date of approval by the Planning Commission and/or Planning Department.
However, if no development has been initiated at the end of theZA--month
time period the approval shall expire. Additional time may be approved
by the Planning Commission upon request of the applicant prior to expira-
tion of the ~-month time period. Expiration Date: July 5. 1990
COVENANTS, CONDITIONS AND RESTRICTIONS FOR P.R.D.

The Covenants, Conditions and Restrictions (CC&R's) shall be reviewed
and approved by the Planning Department prior to final approval of the
tract maps. The CC & R's shall include liability insurance and methods
of maintaining the open space, recreation areas, parking areas, private
roads, and exterior of all buildings. The CC&R's shall also include
a statement that no radio frequency antenna shall be included within
the complex except for central antenna systems.
No lot or dwelling unit in the development shall be sold unless a cor-
poration, association, property owner's group, or similar entity has
been formed with the right to assess all properties individually owned
or jointly owned which have any rights or interest in the use of the
common areas and common facilities in the development, such assessment
power to be sufficient to meet the expenses of such entity, and with
authority to control, and the duty to maintain, all of said mutually
available features of the development. Such entity shall operate under
recorded CC&R's which shall include compulsory membership of all
owners of lots and/or dwelling units and flexibility of assessments to
meet changi ng costs of mai ntenance, repai rs, and servi ces. Recorded
CC&R's shall permit enforcement by the City of provisions required by
the City as conditions to approval. The developer shall submit evi-
dence of compliance with this requirement to, and receive approval of,
the Commission prior to making any such sale. This condition shall not
apply to land dedicated to the City for public purposes.

Every owner of a dwelling unit or lot shall own as an appurtenance to
such dwelling unit or lot, either (1) an undivided interest in the com-
mon areas and facilities, or (2) a share in the corporation, or voting
membership in an association, owning the common areas and facilities.

Prior to issuance of any building permit, access rights shall be granted to
the City for the purpose of allowing access over the private drives within
the project for all necessary City vehicles including fire, police, and
refuse disposal vehicles, and any other emergency vehicles. The documents

All refuse storage areas are to be enclosed with a decorative wall.

The developer shall obtain Planning Department approval of the visual or
engineering design of the proposed wall.
When graded slopes occur within or between individual lots, the slope face
shall be a part of the downhill lot. Exceptions to this requirement must
be approved by the City Engineer.
Grading and revegetation shall be staged as required by the City Engineer
in order to reduce the amount of bare soil exposed to precipitation.
Compliance with all recommendations of the Geology Report shall be required
(if applicable).
Any clubhouse, swimming pool, spa. putting green, picnic areas or other
amenities shall be installed in the manner indicated on the approved site
plan.
Ouring construction the City Engineer may require a fence around all or a
portion of the periphery of the tract site to minimize wind and debris
damage to adjacent properties. The type of fencing shall be approved by
the City Engineer to assure adequate project site maintenance, clean-up and

1.0 INTRODUCTION
This report is provided by the City of San Bernardir\o
as an Initial Study for Tentative Tract l36l9 to
subdivide 9.3 acres into 21 single-family lots in the
R-1-14,400 single family district. As stated in
Section 15063 of the State of California Environmental
Quality Act (CEQA) Guidelines, the purposes of an
Initial Study are to:
l. Provide the Lead Agency with information to use
as the basis for deciding whether to prepare an
EIR Or a Negative Declatation,
2. Enable an applicant or Lead Agency to modify a
project, mitigating adverse impacts before an EIR
is prepared, thereby, enabling the project to
qualify for a Negative Declaration,
3. Assist the preparation of an EIR, if one is
required by:
a. Focusing the EIR on the effects determin~d
to be significant,
b. Identifying the effects determined not to be
significant,
c. Explaining the reasons for determining that
potentially significant effects would not h~
significant.
4. Facilitate environmental assessment early in the
design of a project,
5. Provide documentation of the factual basis for
the finding in a Negative Declaration that a
project will not have a significant effect on the
environment, .
6. Eliminate unnecessary
EIRS.
7. Determine whether a previously prepared EIR could

2.0 EXECUTIVE SUMMARY
2.1 Proposed "Project
The applicant proposes to establish a 21 lot
subdivision in the R-1-14,400, single-family
residential zone. The subject ptoperty is a 9.3 acre
parcel located at the southwest corner of Verdemont
Drive and Olive Avenue.
2.2 Project Impacts
Impacts identified in the attached checklist include:
1(a) The cut of 19,000 cubic yards and fill of 26,000
cubic yards.
2(c) The proposal will result in development within a
high wind hazard area.
3(a) The proposal may result in changes in absorption
rates, drainage patterns, or the rate and amount
of surfact runoff due to impermeable surfaces.
3(e) The proposal may result in exposure of people or
property to flood hazatds.
6(a) The proposal could result in a change in the
land use as designated on the General Plan is

3.0 PROJECT DESCRIPTION
3.l Location
The proposal i~ located on

3.2.l Existing Conditions
The site is vacant. The topography drops approxi-
mately 41 feet from north to south. The northerly-
mo~t portion of the property is approximately 1,500
feet south of the San Andreas Fault Alquist-Priolo
Special Studies Zone.
3.7.2 Project Characteristics
The proposal is to create a 21 lot single-family
subdivision in the R-1-14,400 single-family
residential district. The lot sizes range from 14,400
square feet to 15,470 square feet. Five of the lots
are irregularly shaped but comply with the Municipal
Code requi.rements regarding minimum di.mensions of
irregular lots. Access to the tract is shown from
Olive and Verdemont Drives. Garfield Street is shown
improved. The two new streets meet City requirements.

4.0 ENVIRONMENTAL ASSESSMENT
4.1 Environmental Setting
verdemont Drive is the northern boundary of this 9.3
acre site and the Olive Avenue is the Western
boundary. The area has a gentle slope with a 70 foot
drop from north to south over the 578 foot length of
the parcel. The area has been disked.
4.2 Environmental Effects
The environmental checklist identifies several areas
of potential concern. Each item checked .maybe. Or
.yes. on the checklist is identified below and
followed by a recommended mitigation measure.
l(a) Will the proposal result in earth movement (cut
and/or fill) of 10,000 cubic yards or more?

The Preliminary Environmental Description
submitted by the applicant indicates 19,000 cubic
yards of cut and 26,000 cubic yards of fill.
Slopes will be 2:1. The City Engineering
Department will require that a grading bond be
posted for any earthwork over 5,000 cubic yares
to insure that the work is done in accordance
with Section 7014 (c) of the Uniform building
code.
2(c) Will the proposal result in development within a
high wind hazard area?
The City requires that new projects located in
the high wind area have tile roofs with hurricane
clips for wind protection.
3(a) Will the proposal result in a change i~

The tract is engineered to drain toward the
southeast into Olive Avenue. The City Senior
Civil Engineer, Mike Grubbs, reviewed the plans
and found the tract meets the City preliminary
requirements for drainage.

prior to recordation and constructed prior to
occupancy.
6(a) Will the proposal result in a change in the lafld
use as designated on the General Plan?
The June 11, 1987 letter from the State Office of
Planning and Research prevented the City of San
Bernardino from accepting or processing any
permits north of the Saldecke-Sky line. It
further released the City from maifltaining a
complete and adequate general plan. The
processing of applications north of the Saldecke-
Sky lifle on Single-Family lots of 10,800 square
feet and larger was allowed by the February 5,
1988 letter from the State Office of Planning and
Research.
6(c) Will the proposal result in development within
.Greenbelt Zone .C.'?
The proposal is located in Zone .e. of the
Greenbelt Study. Mi tig~tioll nleasures are
enumerated below.
The project is required and does have two
publicly dedicated ingress and egress routes in
that both Garfield and Verdemont Drive will be
improved to connect to Olive and Palm. Olive and
Palm serve as points of entry or exit to the
area.
III addition, the development will be required to
have non-combustible and reflective street
markers and three iflch high house numbers that
are all visible for 100 feet.
The development will be required to ptovide six
inch or larger circulating maifls and storage
capacity sufficient to provide the minimum fire
flow duration and hydrant spacing with a residual
pressure of 20 pounds per inch.
Each hydrant shall be identified with approvec
blue reflecting street markers.

The City Engineering Department will impose fees
in the area. The fees will be for improvements
such an storm drainage, park fees and etc. The
developer will be required to connect to the
city Water and Sewer facilities. At present the
water and sewer rights ate available. A fee
will be imposed to complete the bridge across
Palm Avenue. The bridge will be constructed
when all monies have been collected.

Gentlemen:
Reference is made to your transmittal requesting the. District
review and comments on Tentative Tract l36l9. The site is
located at the southwest corner of Pennsylvania and Olive Avenues,
in the northwest portion of the City of San Bernardino.
The northeast corner of the tentative tract is traversed by a
natural drainage course outletting flows from Bailey canyon,
originating in the mountainous area to the north. Highly debris
laden flows can be expected from the mountainous drainage area of
over 500 acres. The natural drainage course is not adequate to
contain the total flows from the canyon, and in the event of a
major storm, overflow across the site can be expected. The flood
Insurance Administration mapping for the area shows those portions
of the site lying within and adjacent to the natural drainage
course as Zone "A", area subject to lOO year overflow. The Flood
Insurance Administration mapping is based on clear water storm
flows. Since flows from Bailey canyon may be highly debris
ladened, the possible overflow limits are much broader than that
shown on their mapping.
Therefore, in our opinion, the site is subject to infrequent
flood hazards due to overflow, erosion and debris deposition from
Bailey canyon in the event of a major storm. Portions of the
si te may be subj ect to excessive street flows and accumulated
drainage from the north. It is therefore recommended that a
separate report be obtained from the city Engineer'S Office with
respect to local and on-site drainage conditions.
Our recommendations are as follows:
1. If the Bailey Canyon Debris Basin is not constructed
prior to the development of this site, adequate provisions
shall be made to protect the site from the debris ladened
flows from Bailey canyon.

2. Adequate provisions shall be made to intercept and
conduct the tributary flows from the north, including
Bailey Canyon, around or through the site in a manner
which does not adversely affect adjacent or downstream
properties.
3. The developer.should provide his fair share of the cost
for the Bailey Canyon Debris Basin if there is not
another means for financing the basin. Attention
should be directed toward construction of the local
storm drain identified as Project No. 7-E14A in Comprehensive
Storm Drain Plan No.7. This would be the time to
review and update engineering hydraulics and development
of current funding mechanisms in coordination with the
City Engineers Office in order to proceed with the
construction of the storm drain facility.
4. In addition to the Drainage Requirements stated herein,
other "on-site" or "off-site" improvements may be
required which cannot be determined from tentative
plans at this time and would have to be reviewed after
more complete improvement plans and drainage analysis
have been submitted to this office.
5. section l6.02l2(g) of the county Code sets the fee fro
this review and analysis at $200.00. This fee is to be
submitted directly to the District Office with an
indication that it is for flood Hazard Review of ID
