ADOPT RESOLUTION APPROVING AN .AGREEMENT
WITH BOYS AND GIRLS CLUB RELATING TO STAFF REPORT
FINANCIAL ASSISTANCE FOR FISCAL YEAR
1988-89.
During the 1987-88 City budget hearing, this Department was directed to fund social
service organizations for not more than three years and to reduce each recipient's
grant by one-third each year. These funds were intended to assist the recipients
as they sought funding from other sources to continue their programs. Accordingly,
the following is a schedule for social services funding for a three year period:

Each of the above organizations has submitted their proposal for 1988/89. Their
proposed social services are the same as in previous years. The funding provided
by the City is integrated into their respective budgets and assists in offsetting
their operating costs in all areas from salaries to transportation and utilities.
Recommend adoption of resolution.

City an agreement with Boys Club of san Bernardino, Inc.
: relating to financial assistance for fiscal year 1988-1989, a
copy of which is attached hereto, marked Exhibit "A" am
incorporated herein by reference as fully as though set forth
at length.

(COOnunity Service Organization)
THIS AGREPMENl' is entered into effective as of July 1,
1988, at San Bernardino, california, between the City of San
Bernardino, a nunicipa1 corporation, referred to as "City",
and Boys Club of San Bernardino, Inc., a nonprofit camunity
service organization, referred to as "Service Organization".
City and Service Organization agree as follows:
1. Recitals.
(a) Service Organizatioll has re<pested financial
assistance from City for the fiscal year 1988-1989.
(b) Service Organization represents that the
expenditures authorized by this agreenent are for a valid
nunicipa1 public purpose. The purpose is to provide space
for prograns benefiting the youth of the camunity.
2. Pavment. City shall pay to Service Organization the
total sum of SEllEN TII){JSl\N) NINE HUN>RED FIF'lY -SIX DOLIARS
($7,956), for the term of this agreenent, payable in twelve
IOOnth1y insta1lnents of SIX. HUN>RED SIX'lY-'1'HREE DOLIARS
($663). Monthly paynent for the IOOnth of July shall be
payable upon execution of this agreement, and all subsequent
paynents shall be paid on or before the 5th day of each
succeeding IOOnth.
3. Term. This agreement shall cover the period from
July 1, 1988, through June 30, 1989.
4. use of Funds. The funds paid to Service Organiza-
tion shall be used by it solely for the purpose set forth in

3. Term. 'ft1is agreenent shall cover the period from
July 1, 1988, through June 30, 1989.
4. Use of Fums. The films paid to Service Organiza-
tion shall be used by it solely for the purpose set forth in
Paragraph 1 (b) of this agreenent and in accordahce with the
budget submitted to the City, a copy of which is attached
hereto as Exhibit "I" and by this reference made a part
hereof. A variation in the itemization of costs, as set
. forth in the proposed budget, not to exceed ten percent
<lO%), shall be allowed, provided the prior written approval
of the Director of Parks, Recreation and Camunity Services
of city is ootained. At the em of the te1;lll, all unexpemed
funds shall be returned to City by Service Organization.
5. AccountillCl. Prior to the final payment umer this
agreenent, and at such other tines as may be requested by the
City Administrator or Director of Finance of City, the
Service Organization shall submit to the City Administrator,
with a copy to the Director of Finance, an accounting of the
proposed and actual expemitures of all revenues accruing to
the organization for the fiscal year eming June 30, 1989.
().1arterly reports shall be forwarded for review by the
Director of Parks, Recreation and Camunity Services Depart-
ment.
().1arterly Reports shall be conpared with original
budget proposal. Financial records shall be maintained by
service Organization in accordance with generally accepted
accounting principles, in a manner which permits City to
trace the expemitures of the fuOOs. All bodts and rEICords
of service Organization are to be kept open for inspection at

any time during the business day by the City or its officers
or agents.
6. Services Available to Residents. The services of
Service Organization shall be made available to residents and
inhabitants of the City of San Bernardino. No person shall
be denied service because of race, color, creed, age, or sex.
Service Organization shall have and comply with Affirmative
Action guidelines in its employment practices.
7. Approval of City of any Charaes. City reserves the
right to require Service Organization to obtain the prior
written approval of City of any charges or fees to be charged
by Service Organization, and of any rules and regulations
governing the services.
8. Application for Other Fundina. No Service Organi-
zation will be funded by the City for more than a total of
three years. Service Organization must apply for funds from
other sources. Evidence of the application shall be made
available to City prior to any consideration for further
funds for the next fiscal year. Receipt of any revenue from
such other sources during this fiscal year must be reported
immediately to the Director of Parks, Recreation and communi-
ty Services.
9.
Temporary Withho1dina.
The Director of Parks,
Recreation and Community Services, with the concurrence of
the Mayor and Common Council, is authorized to temporarily
withhold or to terminate the payment of funds to Service
Organization when the Director determines that any violation

1 of the agreement has occurred. Funds shall be withheld until
2 the violation is corrected to the satisfa~tion of the Direc-
3 tor and Mayor and Common Council.

10.
Hold Harmless.
Service Organization agrees to
5 indemnify and save harmless the City and its employees and
6 agents from all liabilities and charges, expenses (including
7 counsel fees), suits or losses, however occurring, or damages
8 arising or growing out of the use or receipt of funds paid
9 under this agreement, and all operations under this agree-
10
ment.
payments under this agreement are made with the
11 understanding that the City is not involved in the performan-
12 ce of services or other activities of Service Organization.
13 Service Organization and its employees and agents are inde-
14 pendent contractors and not employees or agents of City.

11. Standards. Service Organization agrees to comply
with the provisions of "Section 1.
Recommendations", of a
17 portion of a report entitled "Report of the Special Council
18 Subcommittee for Social Service Funds" dated and adopted on
19 February 18, 1975, and on file in the Office of the City
20 Clerk of City, a copy of which has previously been provided
21
to Service Organization.
All references to Human Services
22 Department and/or Director are now referred to as "Parks,
23
Recreation
and
Community
Services
Department
and/or
24 Director".

12.
Termination.
City shall have the right to
26 terminate this agreement and any funding of Service Organi-
zation for any reason by mailing a ten day written notice to

Service Organization and this agreement shall terminate ten
days after the mailing of such notice.
13. Amendment. This agreement may be amended or
. modified only by written agreement signed by both parties and
failure on the part of either party to enforce any provision
of this agreement shall not be construed as a waiver of the
right to compel enforcement of any provision of provisions.
14. Assiqnment. This agreement shall not be assigned
by Service Organization without the prior written consent of
city.
15. Notices.
All notices herein required shall be in
writing and delivered in person or sent by certified mail,
postage prepaid, addressed as follows:

16. Entire Aqreement This agreement represents the
