FEES FOR USE OF BUILDINGS, SPORTS STAFF REPORT
FACILITIES, INCREASING FEES FOR RECREATIONAL
FACILITIES.
The resolution is proposed to be amended to allow for new fees for an "Alcohol
Permit" and to provide for rental fees for the Seccombe Lake Pavill ion and
concession stands at Encanto Ballfields, Nunez Park, and Seccombe Lake. There
are no other changes in fees other than these newly proposed fees.
The "Alcohol Permit Fees" are intended to cover, in part administrative costs
to process a request for the waiver of Municipal Code 9.32.020 which prohibits
alcohol on public property. Municipal Code 9.32.040 provides for the administra-
tive waiver of this code. Actual staff and administrative costs for this process
may range up to $180. This procedure involves the Parks, Recreation and Community
Services Department, the Police Department and the City Administrator's Office.
The permit fee applies only to City Parks, Recreation and Community Services
facilities. The Park and Recreation Commission conducted a public hearing on
this proposed fee at its meeting of January 21, 1988 and subsequently voted to
recommend the fees to Council on a 5 for, 1 opposed, I abstention vote.
The actual modification of the resolution is as follows:
Alcohol Permit fees (on City Parks, Recreation and Community Service facilities)
1. Special Events, Athletic Events, Fundraisers
Sponsor must be an established, non-profit organization.
Beverages are restricted to beer and wine.
A. Alcohol Permit Fee: $50 - when ABC permit is not required and partici-
pation is 150 or less; $100 - when ABC permit is required or participation
exceeds 150 (this fee is in addition to any rental or staffing fees.).
2. Private Gatherings
A. Alcohol Permit Fee: $50 (0-150 participants); $100 (151 or more parti-
cipants). This fee is in addition to any rental or staffing fees.
The additon of the pavillion at Seccombe Lake is included as a new facility. The
fees are structured to be identical to FDR Bowl in Perris Hill Park ($13 for first
hour, $8 for each additional hour).
The concession stands are included to provide the recovery of costs associated with
their occasional use. The proposed fees for the Encanto, Seccombe Lake and Nunez
Concesstion stands are identical to the fee for the Perris Hill Concession stand
($50 per use) already established in the resolution. A lease agreement for any
concession stand will preclude any rental.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION l. Findings. The Mayor and Common Council hereby
find:
A. A hearing has been held by the Mayor and Common Council
pursuant to the provisions of Government Code Section 54990. et
seq., to consider the levy of new and additional fees and service
charges for various services provided by the Parks, Recreation
and Community Services Depa~tment. and for uses of certain
buildings. facilities. and equipment. which hearing was held
following public notice published in a newspaper of general
circulation in the City of San Bernardino.
B. None of the proposed increases exceed the actual cost
of providing such services and facilities. and, for those
services. which are not completely paid for by the proposed fees,
the additional expense to the City of providing services shall be
borne by the general fund of the City of San Bernardino.
C. The proposed fees and charges are reasonable and
necessary to enable the City of San Bernardino to more nearly
meet the actual costs of providing such services and facilities.

Department sponsored activities.
2. Parks, Recreation and Community Services
Department cosponsored activities and tax-
supported groups.
3. Non-profit. youth-servicing organizations located
permanently in and serving the City of San
Bernardino.
4. Civic and social groups (resident and non-profit).
5. Civic and social groups (non-resident or com-
mercial).
E. Non-profit. youth-serving organizations located
permanently in and serving the City of San Bernardino are those
organizations whose principal purpose is to provide a service or
program to participants, generally under the age of l8. of which
at least fifty-one percent (5l%) reside in the City of San
Bernardino. Groups iri this classification shall pay no fee for
use of outdoor athletic facilities and fifty percent (50%) of the
stated rate for all other facilities and equipment.
F. A non-reSidency surcharge of ten percent (lO%) for all
facility or equipment rentals. class registration fees. and
excursion fees, and a five dollar ($5.00) per non-resident player
surcharge for adults sports programs shall be charged.
G. The Mayor and Common Council may exempt non-profit
associations or corporations organized primarily for patriotic.
civic betterment or charitable purposes or any local civic or
charitable organization from the foregoing rates and fees

schedule for the use of park and recreation buildings and
facilities upon a finding that the rental fee would create a
financial hardship jeopardizing the activity or event planned for
such use and that the activity or event will be of unusual
benefit to the inhabitants of the City and should be supported
with public funds. The word 'local' as used herein is defined to
mean an organization whose membership is comprised of more than
fifty percent (50%) of City residents."
