SUBJECT: APPEAL OF CERTAIN CONDITIONS OF APPROVAL FOR PARCEL
MAP 11421
MAYOR AND COUNCIL MEETING - JULY 5, 1989, 2:00 p.m.
REOUEST
The applicant, Guadalupe Homes, is appealing thirty-six
Conditions of Approval by the Planning Commission. The
applicant requests that the Mayor and Council reconsider the
imposition of these Conditions of Approval and not require
them.
BACKGROUND.
Parcel Map 11421 is a request to create two parcels fron a
3.64.acre site located at the southwest corner of Sierra Way
and Cluster Street.
On November 2, 1965, Conditional Development Permit No. 349
was approved to convert a home to a residential care
facility. The adjacent mobile home park was approved by the
Planning Commission under Conditional Development Permit No.
119 on October l4, 1957.
The parcel map is consistent with the General Plan adopted
June 2, 1989, in that the two lots being created are of
. buildable size, there is no minimum lot size in the CH-Heavy
commercial Land Use Designation, and both lots abut upon . a
dedicated street. At the April 27, 1989, Environmental
Review Committee meeting a negative declaration was
recommended after review of the initial study. The study was
made available for public review and comment. No comments
were received.
On June 6, 1989, the Planning Commission approved Parcel Map
11421, subject to the standard conditions and requirements
for parcel maps and tentative tract maps. The applicant is
appealing the following conditions or standard requirements
(see Attachment A).

The Parks and Recreation Department requirements require the
submittal and approval of landscaping plans and the con-

struction or installation of landscaping. The applicant has
the misunderstanding that 401 trees . are required to be
planted. This is not correct. Along Cluster street a tree
is required to be planted every 35 feet for a total or about
nine trees. Along Sierra Way a tree is required to be
planted every 40 feet for. a total of about ten trees.
Combined total of .trees required to be planted is 19.
STANDARD REOUIREMENT NOS. 6-7 and 9-11
The Building and Safety Requirements relate to building and
safety requirements tied to new construction or any
remodeling proposed for any existing structures. Also, if
there is any doubt about the existing building's structural
veracity or compliance with the latest building codes, then
plans of the existing building is required to be reviewed.
STANDARD REOUIREMENT NOS. 15-30
The Police Department Requirements relate to the installation
of security lighting, doors and locking devices on windows.
These are required for all development projects including
development of parcel maps or tentative tract maps.
STANDARD REOUIREMENT NOS. 37. 39-43. 46-50 and 53-54
(Public Works Department Requirements) relate to requiring a
drainage study so it can be shown that all drainage is
directed to an approved public drainage facility. Condition
NO. 41 requires a reciprocal access easement to be recorded
when two parcels use the same access. Condition No. 42
requires the submittal and approval of Landscape Plans.
Condition No. 43 requires the submittal and approval of a
Lighting Plan. Condition Nos. 46-48 require that utility
services be placed underground.
Condition Nos. 49~50, and 53 and 54 require street improve-
ment be made along Cluster Street and Sierra Way, including
curb, 9utter and street lighting. Cluster Street. was
required to be widened by five feet along the northern
boundary of Parcel Nos. 1 and 2. The applicant is under the
misunderstanding that Cluster Street was required to be
widened from 15 feet from centerline to 35 feet from
centerline. This is incorrect. The requirement is that
Cluster Street be widened from 15 feet from centerline to 20..
feet from centerline. All of these public improvements
requirements are standard requirements for parcel maps or
tentative tract maps.

CONCLUSION
All parcel maps and tentative maps are conditioned with
improvement requirements similar to those required for Parcel
Map. 11421. The fact that development on these two proposed
parcels already exists, does not exempt the subdivision from
these stand~rd requirements.
OPTIONS AVAILABLE TO THE MAYOR AND COUNCIL
The Mayor and Council may:
1. Deny the appeal and approve Parcel Map 11421 subject to
the Standard Requirements and Conditions of Approval;
2. Deny the appeal and deny Parcel Map 11421; or,
3. Uphold the appeal and delete any or all of the following

This letter is our notice or appeal of the condi-
tions imposed on Parcel Map 11421 as approved by ~e City's
Planning Co~ission at its meetinq of Tuesday, June 6,
1989. As we note in the attachment accompanyinq this
letter, we believe many of these conditions are either
.inapplicable to our onqoinq use of our facility or
inappropriate for our Parcel Map request, as we understand
the Parcel Map process.
By way or background, Guadalupe Homes operates
homes for children throuqhout the state or California. St.
Anthonys Children's Home has been providinq 24-hour
treatment and a residential home for up to 16 emotionally
and/or physically abused children rrom birth to aqe ten at
111 W. Cluster Avenue in San Bernardino since Auqust of
1987. We anticipate continuing our current use of the site
.at current levels for the foreseeable future.
We have been operating that facility under a Lea.e

~railer park. We decided late in 1987 to purchase our site
from Mrs. 3anza by exercising an option to purchase
. contained in our Lease. Dna of the conditions to the pur-.
chase was to obtain the city'S approval or a lot split to
oreate separate leqal parcels for our site and the trailer
~ark. .

tor the Parcel Map on March 1, 1988. The City's Planninq
Department notified us that the application was complete on
March 23, 1988.
The Planninq Department then notified us by letter
dated April 15, 1988 that the Environmental Review
Committee, at its April 7 meeting, determined that a
Conditional Use Permit was necessary because Guadalupe was
operat;nq a "social care racility" in an M-1 Light
Industrial Zone. We were told that the Parcel Map should. be
put lion hold" for a while until the CUP a-pplication could
catch up to it, and then both applications could be reviewed
and approved simultaneously. We therefore went ahead and
hired a surveyor, prepared a CUP application and suemitted a
package to the Planning Department on June 6, 1988. We were
informed by the planninq Department's July 5 letter that the
application was deemed complete.
We next learned (via correspondence from the plan-
ning Department dated AUgUst 8, 1988) that there were addi-
tional reauirements we had to meet in order to have the CUP
application approved. In brief, these conditions were as
followl5:
1. 6 foot front set back on Cluster street.
2. Variance on fence height.
3 . Adequate parking space..
4. Proper tr~sh enclosure.
5. Landscaping of 5% of parking lot.
6. Have plans reflec~ modular office.

7. Provide second exit for mobile home park.
Guadalupe was.willing to mee~ the.. requir.ments and
undertook .to prepare new maps, plans and transparencie., a.
. .well a. the requested Variance application. The extra time.
needed to comply with these requirements, in conjunction with
other issues regarding the open escrow on our purchase of the
site from Mrs. Janza, =esulted in the Planning Department's
letter of November 21, 19BB informing us that our CUP
application was incomplete. We did file a Project
Reactivation Request along with the requested information
with~n the ti~e period permitted by the Planning Department's
November 21 letter. We heard back from the Planning
Department by letter on March 16, 19B9 that we needed to
satisfy the following two additional requirements (which we
have gone ahead and. complied with): .
.1. Deletion of trailer (i.e. the modular
office noted earlier).
2. structural analysis of building.
Towards the end of last month, we. were informed by
the Planning Department that the CUP portion of our pending
applications was no longer necessary because although our
site is located in the M-1 Zone, our site is also desiqnated
as IL, Light Industrial by the Interim Policy DOCUment and
CH, Heavy Commercial by the proposed General Plan. We
thought this decision would clear the way for prompt approval
of the Parcel Map, but were told instead that a new and wide
ranging set of conditions would be imposed on the Parcel
Map. It is the imposition of these new and wide ranging
conditions at the Planning Commission'S June 6 meeting which
we are appealing. .
Up until the end of last month, we were ready to
comply with all of the requirements imposed by the City which
we have mentioned earlier in this letter. The newly imposed
conditions, however, work a real hardship on us since they.
bear little relationship to our continued use of the site.
We believe the newly imposed conditions are more
relevant to either brand new construction or a Parcel Map
accompanied by a change in use or intensirication in use of a

site. Since we have been operatinq at our current site for
almost two years, there i. no need for new construction and
there .will be no change in use coincident with the approval
of the Parcel Map.or for the foreseeable future.
In addition, because the child care services we
provide promote the pUblic interest by prOViding unique
~enefits to the City, County and State, we hope the C~uncil
will balance the benefits we prOVide with the bene tits to be
promoted by the newly imposed conditions. We believe this
balancing process should result in the Council cutting. back
en the newly imposed conditions to those initially proposed
by the City as enumerated herein.
We attach with this letter a review ot the newly
imposed conditions and a brief statement of reasons why we
believe. .these newly imposed conditions are either inappro-
priate.o~ overly .burdensome. .We anticipate providing staff
and the Council with additional information in staff meetings
and at the hearing on this matter.

useful and prOductive member of the Sen Bernardino community.

C9NDITIONS APPEALED AND REASONS FOR APPEAL
(GUADALUPE HOMES PH 11421)
A. Plannino Oenanll'lent. Conditions 2 and 4 contain
landscaping requirements imposed by the Planning Department
. and the. Department of Parks and Recreation. These condi-
tions are very onerous, requiring installation of 401 trees
and other plantings along the full frontage or both
parcels. While these requirements might correspond in scale
to heavy commercial projects that might otherwise develop on
site, they seem too broad-sweeping for our limited use of
the property.
B. Standard Reauirements. Standard Requirements Nos.
6-7 and 9-11 relate to building and safety requirements
normally tied.to new construction requirinq certificates of
occupancy. Since we are not seeking these approvals, their
relationship to this SUbdivision is difficult to understand~
C. POlice Deoartment Reauirements. Police Department
Requirements (Conditions. Nos. 15 through 30) also seem
related to new construction and not to subdivisions. Since.
no new construction is proposed, it is difficult to see how
this Parcel Hap triggers the requirement to do extensive
retrofitting of the site. Furthermore, providin9 security
lighting in the manner called for would disrupt oUr opera-
tions at the site, given the fact that we operate a home for
children designed to give the children the feel of a home
environment.

D. Public Works. Condition No. 37 requiring a
drainage stUdy is unnecessary since no grading or alteration
in drainage patterns will occur with this approval. Condi-
tions N~s. 39 through 43 also relate to grading and grading
plans and have no relationship to the project. No gradinq,
other than minor qradinq tor landscaping purposes, is
proposed.
E. utilities. Conditions Nos. 46 through 48
requiring utility underqrounding and other utility improve-
ments would be extremely expensive and, since no new utili-
ties or buildinq will occur on site, they appear to be
unrelated to our application.
Conditions Nos. 49 through SO require street.
dedication and improvements. They propose a street widening
that would bring the street much too close to the Home. Our
preliminary aS8essment i. that the wideninq might even
require dedication"of part of the Home itself. Since the
project will continue operating at current levels, we do not
anticipate creating traffic impacts qiving rise to the need
for these conditions. (Conditions Nos. 53 and 54 are also a
problem since they relate to sign-Off on these street
improvements.)

FINDINGS OF FACT
1. The Planning Department has investigated Parcel Map
11421 and has determined that approval of the proposed
subdivision is consistent with the Interim Policy
Document adopted by the Mayor and Common Council on May
23, 1988, amended on June 6, 1988, and approved by the
State Office of Planning research on June 9, 1988. .
2. The two (2) lots being created conform to the lot
requirements of the Zoning Code in that there is no
minimum lot size nor minimum lot dimensions in the Land
Use Designation. Each parcel conforms with all other
aspects of the provisions of the Title 18 of the San
Bernardino Municipal Code.
3. All lots created by parcel Map No. 11421 abut upon a
dedicated street of a width as established by the City
ordinances for access to or use of the property within
the proposed subdivision.

The applicant requests approval under authority of San Ber-
nardino Municipal Code Section l8.l8.0l0 to subdivide a 3.64
acre parcel into two parcels in the M-l Light Industrial Zone.
The site is designated as IL, Light Industrial by the Interim
Policy Document and CH, Heavy Commercial by the proposed General
Plan.
Parcel 1 is occupied by a mobile home park. Parcel 2 is
occupied by a child treatment residential center.
2. SITE LOCATION
The 3.64 acre site is located at the southwest corner of Sierra
Way and Cluster Street. See attachment G - Location Map.
3. MUNICIPAL CODE AND GENERAL PLAN CONFORMANCE
The proposed project is consistent with the Municipal Code and
in conformance with the Interim Policy Document and the proposed
General Plan as shown in Attachment A.
4. C.E.Q.A.
An Initial Study was prepared by staff and presented-to the
Environmental Review Committee (ERC) on April 7, 1988. The item
was continued until a secondary access for the mobile home park
could be clarified. The Initial Study was resubmitted on April

5 . BACKGROUND
The child treatment home site on Cluster was constructed prior
to 1939. It was reroofed in 1949. On November 2, 1965,
Conditional Development Permit Number 349 was approved to con-
vert the home to a residential care facility. The applicant,
Guadalupe Homes, has occupied the site for approximately l8
months. The mobile home park was approved by the Planning
Commission with Conditional Development Permit No. ll9 on
October l4, 1957.

6. ANALYSIS
The Municipal Code requires that subdivided lots must be of
buildable size. The lots must also have access from a dedicated
street or abut an approved easement. The zoning ordinances do
not have a minimum lot size in the light industrial zone. The
proposed parcels are fully developed and both parcels have
access from dedicated streets.
Size of Parcels/Street Access
Parcel Number One has l,775 feet frontage on Sierra Way and l26
feet frontage on Cluster. Parcel One is 3.02 acres in size..
Parcel One, which is the site of the mobile home park, has access
from Sierra Way wi th a secondary access through Parcel Two.. A
reciprocal access agreement has been added as a Condition of
. Approval.
Parcel No. Two is .63 acres in size. The parcel has l88 feet of
frontage on Cluster and access is from Cluster.
Parking and Circulation
Parking for the mobile home park and circulation within the park
were approved with the original application. A Condition of
Approval has been added to prohibit parking in the drive aisle
of the mobile home park to maintain clear access through .to the

l. The Planning Department has investigated Parcel Map ll42l and
has determined that approval of the proposed subdivision is con-
sistent with the Interim Policy Document adopted by the Mayor
and Common Council on May 23, 1988, amended on June 6, 1988, and
approved by the State Office of Planning Research on June 9,
1988.
2. The two (2) lots being created conform to the lot requirements
of the Zoning Code in that there is no minimum lot size nor
minimum lot dimensions in the Land Use Designation. Each parcel

A. Landscape Plan
Four (4) copies of a master landscape plan shall be submitted to the.
Public Works/Engineering Department for review and approval by.the
Planning Department and Parks, Recreation and Community Services De-
partment staff. Plans shall meet the standards and guidelines
established in the Requirements for Landscaping and Irrigation. The
plan shall include, but not be limited to, the following:
1. Size, type, and location of plant material proposed.
2. Irrigation plan.
3. Such other alternate plants, materials and design concepts as may
be proposed.
4. Name and address of owner, address of property, name, address and
phone number of plan preparer.
5. Erosion control plans (where necessary or specified) will be reviewed
by all departments with the primary responsibil ity with Publ icWorks/
Engineering.
B. Trees
Tree varieties and exact locations will be determined prior to planting
by the Director of Parks, Recreation and Community Services Denartment
or his/her designee. A minimum number of 1 inch caliper/15 gallon (24"
box specimen preferred), multibranched trees shall be planted within.
the public parkway right-of-way at a minimum of 30 feet on center.

REQUIREMENTS FOR SUBMITTAL AND APPROVAL OF
LANDSCAPE AND IRRIGATION PLANS:
I. PURPOSE
The intent and purpose of these guidelines is to provide:
1. Guidance in the required submittal of landscape and irrigation
plans.
2. Guidance in meeting street tree requirements.
3. Guidance in selection of plant material.
4. Guidance in what the plans (landscape and irrigation) shall show.
II. SUBMITTALS
A. NUMBER OF PLANS AND SUBMITTAL PROCEDURE
~~ (1) copies each of landscape and irrigation plans shall be sub-
mitted to the Public Works/Engineering Department along with payment
of the appropriate Landscape Plan Review Fee.
B. LANDSCAPE PLANS
1. Shall be drawn by one of the following:
A. A registered landscape architect.
B. A licensed landscape contractor who installs the actual
landscape.
C. A nursery.
D. The owner.
NOTE: The name, address, telephone number, along with .signature of the
person(s) who do the design shall be on the plans. Registered
landscape architects and licensed landscape contractors shall
include their registration numbers and/or license numbers.
2. .Plans shall be legibly drawn to scale on paper no smaller than
18" x 24" and no larger than 24" x 36".
3. Plans shall show location of the property by vicinity map and
nearest cross streets and give the property address or assessor's
parcel number.
4. Plans shall show location of existing and proposed utilities - above
ground and.underground.
5. Plans s~all show type of zoning, the scale, and northerly directional
arro'W.
6. Plans shall contain plant legends for all existing and proposed
plant material. The legend shall be as follows:

7. Plans shall show exiting and proposed plant material drawn to
scale at their mature size.
8. Plans shall contain landscape specifications and details.
9. Plans shall show all required landscape areas protected from
parking areas with concrete curbing.
10. Plans shall show the name, address, and telephone number of
property owner or developer.
C. IRRIGATION PLANS
1. All required landscaping shall be provided with an automatic
irrigation system.
2. Plans shall be submitted with, attached to, and the same size as
landscape plans.
3. Plans shall address conservation of water and energy.
A. Components - low gallonage and low precipitation heads,
drip systems and other sub-surface techniques, mini jet
heads, moisture sensing devices, controllers with ability
of variable programming.
B. Efficiency - velocity shall be close as possible to 5 feet
per second. Plant material with different water requirements
shall be on separate valves. Slopes shall be on separate
valves. System design shall eliminate costly, wasteful,
overthrow and runoff.
4. Plans shall show:
A. Static P.S.I.
B. Service Main - type, size and length.
C. Water Meter - location and size.
D. Approved Backflow Prevention Device - location and size.
E. All locations of pipe, valves and heads, (includes emmitters, etc.)
5. Slopes required to be planted shall be provided with efficient and
water conserving irrigation systems.
NOTE: Actual water application rates shall be applied, as soil
absorption rates dictate. Over watering shall be avoided.
6. All sprinklers shall be installed with approved swing joints.
7. All above ground sprinklers shall be the pop up type, installed
flushed with the soil. Exposed sprinklers on risers above ground
are acceptable in limited areas with "bubbler" type sprinklers
and do not border. sidewalks, walkways, or areas subject to
pedestrian traffic.
8. Separate water meter for landscape irrigation is optional at owners
request and expense.
NOTE: Owner must notify the Water Department.
9. Plans shall contain installation specifications and details.
10. Plans shall contain irrigation legends as tollows:

Interior planting .shall be required and maintained equal to at least

thereof. Measurements shall be computed from the inside or perimeter
walls or setback lines.
D. IRRIGATION
All required landscaping shall be provided with automatic sprinkler
facilities which shall be maintained in an operative condition.
Utilize only reduced pressure (rp) devises or double check valve
assembly. No atmospheric vaccuum breakers are permitted.
E. SETBACK AREAS
All required setbacks abutting a public right-of-way shall be land-
scaped (except for walks and driveways which bisect or encroach opon
the required landscape area). The required setbacks shall be land-
scaped with trees, shrubs, and groundcover. Landscaped earth berms
shall be erected and maintained within the setback along the above
indicated property line. Bermed areas shall have a maximum of 3:1"
slope and be planted with a tall fescue type turf grass, or other
approved landscaping.
F. GRO~D COVER AND BEDDING MATERIAL
Gravel and decorative rock are not appropriate materials to be used
as ground cover or bedding material and will be considered hardscape.
G. SLOPES
1. To protect against damage by erosion and negative visual impact,
surfaces of all cut slopes more than five feet in height and fill
slopes more than three feet in height shall be protected by land-
scaping. Slopes exceeding 15 feet in vertical height shall also
be landscaped with shrubs, spaced at not to exceed twenty (20)
feet on cetners; or a combination of shrubs and trees as cover
plants. Plant material selected and planting method used shall be
suitable for the soil and climatic conditions of the site. Public
Works/Engineering will also approve these.
2. Plant sizes shall be as follows:
A. Trees 20% - 24" box
60% - 15 gallon
20% - 5 gallon
B. Shrubs 20% - 5 gallon

Due to the hot and dry climate of San Bernardino, drought and heat
tolerant material may be used upon prior aPproval.
B. STREET TREES
Street trees shall be required. Tree varieties and exact location
will be determined by the Director of the Parks, Recreation and
Community Services Department or his/her designee. The Parks, Rec-
reation and Community Services Department shall mark locations and
inspect plant material on site, prior to planting. Sidewalks, curb
and gutter, must be clean of debris prior to marking. A 24 hour
notice is required for inspection. (see attached specifications for
Street Tree planting and Street Tree list). The size of the Street
Trees shall be: 1. All 24 inch box specimans, or 2. 25% or the total
amount of trees. The 24 inch box trees shall be planted as street
trees within the public parkway or City property.
C. PLA~T MATERIAL
Landscaped areas shall have plant material selected and planting methods
used which are suitable for the soil and climatic conditions of the
site. Sizes of the plant materials shall conform to the following

V. INSPECTlON
A. IRRIGATION SYSTEM
.1. Inspections shall be performed by a Park and Recreation Department
representative at the following:
A. Pressure test of irrigation main line (150 PSU for 2 hours)
B.. Coverage test and final acceptance.
2. Do not allow or cause the above items to be covered up, until it
has been inspected and approved by a Park Department representative.
A 24 hour notice shall be given prior to anticipated. inspections:
B. LANDSCAPING
1. Inspections shall be performed by a Park and Recreation Department
representative at the following:
A. Upon completion of finished grade, soil preparation and final
rake out.
B. When trees and shrubs are spotted for planting, with one
example of planting hole for trees and one for shrubs.
C. Final inspection when planting and all other specified work
has been completed.
2. A 24 hour notice shall be given prior to anticipated inspections.
VI. OTHER REQUIREMENTS
A. Notify Parks, Recreation and Community Services Department of commence-
ment of landscaping. Give anticipated time line (start to finish).
B. All landscaping, irrigation and street trees shall be installed and
maintained in accordance with City of San Bernardino Municipal Codes,
ordinances and standard requirements.
C. Material requirement for all plant material shall be number one (1)
grade of the California Nursery Industry Certificate as issued by the
Agricultural Commissioner of the County of origin.
D. All landscape material, irrigation equipment, irrigation components
and workmanship shall be guaranteed for a period of not less than
one (1) year from date of final approval by the Director of Parks,
Recreation and Community Services or his/her designee. The. conditions
of the guarantee will be to insure, but not limited to all plant
material being in healthy condition and free from abnormal conditions
which may have occurred during or after planting, such as defoliation
or structure dieback.

c. Except when double cylinder dead bolts are utilized, any glazing uti-
lized within 40' of any door locking mechanism shall be constructed or
protected as follows: Fully tempered glass or rated burglary resistant

2" mesh secured. on the inside of the glazing may be uti 11 zed or the

a. A single or double door shall be equipped with a double or single
cylinder dead bolt. The bolt shall have a minimum projection of I" and
be constructed so as to repel cutting tool attack.
b. The dead bolt shall have an embedment of at least 3/4" into the strike
receiving the projected bolt. The Cylinder shall have a cylinder
guard, a minimum of five pin tumblers and shall be connected to the
inner porti on of the lock by connecti ng screws of at 1 east 1/4" in
diameter. The recommendation does not apply when panic hardware is
required or an equivalent device is approved by the Building Code.
Double doors shall be equipped as follows:
a. The active leaf of double doors shall be equipped with metal flush
bolts having a minimum embedment of 5/8" into the head and threshhold
of the door frame. Double doors shall have an astragal constructed of
steel, a minimum of .125" thick which will cover the opening between
the doors. This astragal shall be a minimum of 2" wide and extended a
mi ni mum of 1" beyond the edge of the door to whi ch it is attached. The
astragal shall be attached to the outside of the active door by means
of welding or with nonremovable bolts spaced apart on not more than 10"
centers. Hi nges for outswi ngi ng doors shall be equi pped with nonremo-
vable hinge pins or a mechanical inner lock to preclude removal of the
door from the exterior by removing the hinge pins. Strike plates shall
be a minimum of 3i" in length and secured to the jamb with screws a
mi ni mum of 2i" in length.
Windows:
a. All moveable windows shall be equipped with a locking device and shall
be constructed in a fashion to restrict them from being lifted out of
its track when in closed position.
Garage type doors; rolling overhead, solid overhead, swinging, sliding or
accordion style.
a. The above-described doors shall conform to the following standards:
(1) Wood doors shall have panels a minimum of five-sixteenths (5/16)
inch in thickness with the locking hardware being attached to the

(2) Aluminum doors shall be a minimum thickness of .02l5 inches and
riveted together a minimum of eighteen (lS) inches on center along
the outside seams. There shall .be a full width horizontal beam
attached to the main door structure which shall meet the pilot, or
pedestrian access, door framing within three (3) inches of the.
strike area of the pilot or pedestrian access door.

(3) Fiberglass doors shall have panels a minimum density of six (6)
ounces per square foot from the bottom of. the door to a height of
seven (7) feet and panels in residential structures shall have a
density of not less than five (5) ounces per square foot.
b. Where sliding or accordion doors are utilized, they shall be equipped
with guide tracks which shall be designed so that the door cannot be
removed from the track when in the closed and locked position.
c. Doors that exceed sixteen (l6) feet in width shall have two (2) lock
receiving points; or, if the door does not exceed nineteen (19) feet, a
single bolt may be used if placed in the center of the door with the
locking point located either in the floor or door frame header.
d. Overhead doors shall be equipped with slide bolts which shall be
capable of utilizing padlocks with a minimum nine-thirty-seconds (9/32)
inch shackle.
(1) Slide bolt assemblies shall have a frame a minimum of .l20 incheS
in thickness, a bolt diameter a minimum of one-half (i) inch and
protrude at least one and one-half (Ii) inches into the receiving
guide. A bolt diameter of three-eights (3/8) inch may be used in a
residential building.
(2) Slide bolt assemblies shall be attached to the door with bolts
which are nonremovable from the exterior. Rivets shall not be used
to attach such assemblies.
e. Padlocks used with exterior mounted slide bolts shall have a hardened
steel shackle a minimum of nine-thirty-seconds (9/32) inch in diameter
with heel and toe locking and a minimum five (5) pin tumbler operation.
The key shall be nonremovab1e when in an unlocked operation.
f. Doors utilizing a cylinder lock shall have a minimum five (5) pin
tumbler operation with the bolt or locking bar extending into .the
receiving guide a minimum of one inch.

Roof top address numbers shall be provided. They shall be a minimum of
three (3) feet in length and two (2) feet in width and of contrasting color
to background. Numbers shall be placed parallel to street address as

Dear Ms. Nadeau:
Pursuant to our telephone conversation yesterday, I am
writing you to request that the hearing on the appeal on Guadalupe
Homes' parcel map (PM ll42l) be continued to the Common Council's
meeting of August 7, 19S9. We are requesting that the hearing be
continued so that we can have adequate time to get cost estimates
from Edison and others on the costs of the conditions imposed on
the parcel map.
We are also requesting that the Common Council consider this
letter an appeal filed pursuant to Section lS.44.070 of the San
Bernardino Municipal Code for a waiver of the undergrounding
requirements (Conditions Nos. 46-47) imposed on the map. Because
we have not yet received a preliminary estimate of undergrounding
costs from Edison, and because we are not yet sure which utilities
must be undergrounded, we will supplement this letter prior to the
hearing date with our outline of the reasons why the undergrounding
requirement is unreasonable and impractical.
We appreciated the opportunity to meet with staff on Monday
and their help in understanding the precise nature of the
conditions imposed. We also appreciate the additional time
necessary to gather the information for our appeal.
