STAFF REPORT
Staff and Redevelopment Committee rec~end approval of an agreueut between
the City and the Agency for expanded Code Enforcement within Redeve101Dent
Project Areas, if the City chooses to expand its current program.
BAcmROUND
It is our understanding that Ways and Means Co_ittee will be considering
recomaending an expanded Code Enforcement Progr.. for the City of San
Bernardino. Contingent upon the City's approval of this program staff and
Redevelopaent Comaittee rec~d approval of an agreellent between the City
and the Agency for ezpanded Code Enforcellent within our twelve Redevelopment
Project Areas. Below is an outline of this propoaed agreeaent.
Agency agrees to:
a) Retain City to provide services of the Building & Safety
Depart1lent, and various staff therein, in connection with
code enforcellent over and above that which otherwise would be
provided as nomal city business, within designated
redevelopment project areas.
b)
COIDpensate the City at a rate representing the actual cost of
providing said additional code enforceaent services,
including fringe benefits, on an hourly basis for all work
performed on behalf of the agency, within redevelopment
project areas.
City to:
a) Perform code enforcellent services within designated
redevelopaent project areas over and above that which
otherwise would be provided as nomal city business.
b) Provide to the Agency an invoice for payment specifying the
work performed, the project area, the actual hourly rate of
the staff person including fringe benefits, on a monthly
basis. Total fees for said services shall not exceed $84,000
for year one and *84,000 for year two.
Funds for this service will be from tax increment revenue from the individual
project areas that receive the service.
It our understanding that if Ways and Means eo_ittee reco_ends approval of
the expanded Code Enforcement Program the full Co_ission will consider this
issue on June 20, 1988. In an effort to coordinste our services with that of
the City the proposed agreement is recommended for consideration pending
formal recommendation of Ways and Means and Commission/City Council approval
of both the expanded code enforcement program and the agreement between the
Agency and City.

CITY OF SAN BERNARDINO AUTHORIZING AND DIRECTING THE EXECUTION OF

BE IT RESOLVED BY THE COMMUNITY DEVELOPMENT COMMISSION OF
6 THE CITY OF SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. The Chairman and Secretary of the Community
8 Development Commission of the City of San Bernardino are hereby
9 authorized and directed to execute for and on behalf of the
10 Redevelopment Agency of the City of San Bernardino an Agreement
11 between the Redevelopment Agency of the City of San Bernardino
12 and the City of San Bernardino, with such non-substantive changes
13 to said Agreement as may be approved by the Chairman and Agency

Counsel. A copy of said Agreement is attached hereto as Exhibit
"1" and incorporated herein by this as though fully set forth at
length.

EXECUTION OF AN AGREEMENT WITH THE COMMUNITY DEVELOPMENT
COMMISSION OF THE CITY OF SAN BERNARDINO, RELATING TO CODE

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor is hereby authorized and directed to
execute on behalf of said City an Agreement with the Community
Development Commission of the City of San Bernardino, relating to
code enforcement, which Agreement is attached hereto, marked
Exhibi t "A", and incorporated herein by reference as fully as
though set forth at length.

THIS AGREEMENT, entered into this day of
1988, by and between the CITY OF SAN BERNARDINO, a municipal
corporation and charter city ("City"), and the COMMUNITY
DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO, on behalf
of the REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO, a body
corporate and politic ("Agency").
WITNESSETH:
WHEREAS, City now provides code enforcement services within
the redevelopment areas of the Agency at a level agreed by the
parties to be three-fifths (3/5) of one man year: and
WHEREAS, in fulfillment of the duties and responsibilities
of Agency, increased code enforcement services are desired: and
WHEREAS, City is willing and able to provide such increased
services pursuant to the terms and conditions of this Agreement.
NOW, THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS:
1. Agency hereby retains City to provide the services of
the Building and Safety Department and various staff therein, in
connection with code enforcement services over and above that
level which is currently being provided within the currently
designated redevelopment project areas and such project areas as
may be designated in the future.
2. City hereby agrees to perform such services within said
designated redevelopment project areas over and above the level
of three-fifths (3/5) of one man year which level is currently

being provided.
3. City shall be compensated for such services at a rate
representing the actual cost of providing said additional code
enforcement services, including all fringe benefits, overhead,
and administration costs on a pro-rate basis, on an hourly basis
for all work performed on behalf of the Agency, within such
proj ect areas.
Such additional work shall be initiated by
written request from the Agency Executive Director or as may
otherwise be agreed between the parties.
4. City shall provide to the Agency an invoice for payment
specifying the work performed, the project area in which such
work was performed, the actual hourly rate of the staff persons,
including fringe benefits, overhead and administrative costs. on
a monthly basis.
5. The parties hereto agree that such compensation for
said services shall not exceed $84,000 for 1988-89 fiscal year,
and $84,000 for 1989-90 fiscal year.
6. The term of this Agreement shall begin on July 1, 1986.
and shall terminate on June 30, 1990, unless earlier terminated
by written notice from one party to the other.
6. All notices to be given from one party to the other
shall be in writing, deposited with the United States Postal
Service. postage prepaid, and addressed as follows:
