A) Move to Set Joint Public Hearing of the Mayor and Co_on Council at 11 a.m. on
July 5, 1988 to consider the sale of certain real property owned by the
RedeVelopment Agnecy within the Central City Project Area to the City of San
Bernardino.

BACKGROUND
The Redevelopment Agency owns the 1.97 acre parcel at the Southeast Corner of Court
and "E" Streets which is adjacent to Plaza and Exhibit Hall parcels (see attached map
#1).
The Redevelopment Agency is currently negotiating with the Simchowitz Corporation
(Developer) to develop an eight story office building and parking structure on this
parcel.
The Redevelopment Agency is requiring that the Developer replace the eUsting 184
parking places. To do this will require marlmUID utilization of available land.
Approximately 2800 square feet can be added to the 1.97 acre parcel by processing a
lot line adjustment which would move the southerly boundary of Parcel 22 (See attached
map #1). While this addition appears small in relation to the size of the parcel it
would enable development of the proposed project in the most efficient _yo
The Redevelopment Committee and staff recommend that staff be authorized to process a
lot line adjustment with the City.
In 1970 the Redevelopment Agency acquired title to the City Hall, Exhibit Hall and the
Plaza Parcel East and West Portion (see attached Map #2). The City Hall and Exhibit
Hall parcels were deeded to the City.
In May 1970 the City ground leased the City Hall and Exhibit Hall parcels to the San
Bernardino Civic Center Authority who subleased these parcels to the City of San
Bernardino.
The City subleased the Exhibit Hall parcel to the Maruko Hotel in 1987.
Staff recently became aware that although the City has been maintaining the Plaza
Parcels, the Parcels were never actually leased or dedicated to the City and are still
owned by the Redevelopment Agency.
The Owner's Participation and Development Agreement (OPA) between the City, the
Redevelopment Agency and Maruko, Inc., makes the Redevelopment Agency responsible for
maintenance and operation of the West Portion Plaza area. Counsel advises that
section 33445 of the Health and Safety Code specifically prohibits the Redevelopment
Agency from maintaining publicly owned facilities. The Redevelopment Agency thus
finds itself in the position of being obligated under the OPA to do something that it
is legally prohibited from doing.
The easiest solution to this problem is to dedicate the entire Plaza areas to the City
by resolution of the Community Development Commission.
The Redevelopment Committee and staff recommend that Public Hearings be held in order
to convey the property to the City after the lot line adjustment has been processed.
