Commission Staff Report - Attachment B) may waive the City's
requirement to connect employment premises directly to the
City sewer's system where:
1) the proposed project is on a lot one-half acre or
larger;

2) the Planning Commission makes a finding that a natural
obstruction prevents the extension of the sewer line.
The site is a .67 acre in area, and thus meets condition
number one. However, the staff and Planning Commission could
not make a finding that there was a natural obstruction
preventing the extension of the sewer line.
There are four possible sewer line connection locations. The
sewer lines to the west on Orange and to the south on 21st
Streets would necessitate that an easement be obtained
because of the intervening private property. These are not
"natural" obstructions preventing connection. The sewer
lines to the north on Highland Avenue and to the east on Palm
Avenue would require pumping of the sewage uphill with a lift
station. Again, this is not a "natural" obstruction
preventing connection. The problem is one of economics and
not one of "natural" obstructions.

1. REQUEST
In accordance with Ordinance MC-6l4, Mr. Jack Reynolds
requests a waiver of the mandatory sewer connection.
(See attached letter, Attachment "B".)
2. LOCATION
The property in question is a .67 acre parcel located on
the south side of East Highland approximately 700 feet
west of Palm at 3499 East Highland. (See Location Map,
Attachment "0".)
3. MUNICIPAL CODE
Ordinance MC-614 (Attachment "E") states that the
Planning Commission may waive the requirements to
connect all premises directly to the City sewer system
where (1) the proposed project is on a lot one-half acre
or larger, and (2) where the Planning Commission makes a
finding that a natural obstruction prevents the
extension of the sewer line in the manner rp.quired by
the ordinance.
4. BACKGROUND
The Development Review Committee approved Review of
Plans Number 88-25, for the establishment of a used car
lot, on April 14, 1988. The site was brought up to most
of the current Municipal Code requirements. The
approval was for the building, parking, signage,
landscaping and the necessary street improvements. A
six-foot wall was required on the south property line.
During the plan check process it was determined that the
site did not have the required sewer connection.

The Planning Commission has approved two sewer waivers,
San Bernardino Steel and Hiles-Osborn, Inc., both in the
H-l, Light Industrial Zone. The approval of these two
applications was conditioned that the applicant connect
to the sewer when it was within 200 feet of the property
and that they not protest an assessment district being
formed. A third request for a waiver is under
consideration on this agenda.
5. ANALYSIS

The project is located on a .67 acre site which meets
the one-half acre requirement of the ordinance.

The site is separated from sewer connections to the west
and south by private property. The City's requirement
for a sewer connection would necessitate that an
easement be obtained across that property for the
connection.
Another sewer line is located across Highland Avenue,
north of the site and at Palm Avenue east of the site.
However, both of those locations would require pumping
of the sewage uphill with a lift station.
6. AGENCY COMMENTS
The attached memo from the City Engineering Department
recommends temporary approval of the request for two
years, as the site meets the size requirement, and
existing developments preclude construction of the sewer
line to the west and to the south, and the site is
downhill from the sewer line in Palm Avenue. See
Attachment "D".
7. CONCLUSION
The site is larger than one-half acre as required by the
ordinance. The site is downhill from sewer lines in
Palm Avenue and Highland Avenue and would require a lift
station, and private propety prevents public access to
the south and west sewer lines.

8. RECOMMENDATION
Based upon not being albe to make the required
of Fact (Attachment "An) concerning a
obstruction, it is recommended that the
Commission deny the request for waiver
