Synopsis of Previous Council action:
No previous Council action.
On May 17, 1988, the Planning Commission voted to deny the request
for Conditional Use Permit No. 88-19 for the sale and off-site con-
sumption of alcoholic beverages in a C-2 Community Commercial zone.
The vote was 7 to I, with one Commissioner absent.
Recommended motion:
That the Mayor and Council deny the appeal and deny Conditional Use
Permit No. 88-19.

Subject: Appeal of Planning Commission Denial of Conditional Use
Permit No. 88-19
Mayor and Council Meeting of July 5, 1988
REQUEST
Mr. Maurice Alfi is appealing the May 17, 1988 Planning Commission
denial of Conditional Use Permit (CUP) No. 88-19.
BACKGROUND
The CUP application is for the sale and off-site consumption of
alcoholic beverages in a C-2 Community Commercial zone. This was
proposed for an existing 836 square foot mini-market located at
4276 North Sierra Way. (See Location Map "F")
The Police Department submitted a protest on this application due
to the over concentration of outlets for alcoholic beverage sales
in this area. Detective Rice of the San Bernardino Police Department,
indicated at the May 17, 1988 Planning Commission meeting that there
were 13 on-site and 6 off-site liquor licenses in the area, as well
as 24 off-site beer and wine licenses. He also noted a 50 percent
increase in crime statistics in the area. In general, Detective
Rice indicated that the Police Department was very concerned about
the crime in this area and protested the issuance of the CUP.
There was no public comment made during the May 17, 1988 Planning
Commission meeting. Mr. Maurice Alfi (applicant) spoke in favor of
the application. Mr. Alfi's appeal is based on the contention that
crime in the area is not that bad. He has also submitted a petition
(270 signatures) in favor of the issuance of the CUP (see Attachment
D) .
MAYOR AND COUNCIL OPTIONS
Uphold appeal and approve Conditional Use Permit No. 88-19 subject
to the Council's direction to prepare the appropriate Findings of
Fact and Conditions.

1. The proposed conditional use permit is consistent with

5. The granting of this Conditional Use Permit under the
conditions imposed will be detrimental to the peace,
health, safety, and general welfare of the citizens of
San Bernardino in that there's an over concentration in
the area and the site is less than 100 feet from a
residential district.
ALCOHOLIC BEVERAGE SAl,PS - REQUIRED FINDINGS
1. The introduction of alcoholic bevelages sales at the
proposed :ocation wil: pose significant impacts to the
surrounding land uses as the site is less than 100 feet
from a .esidential structure.
2. The introduction of alcoholic beverage sales at the
proposed location will not create an adverse impact on
the surrounding traffic pattern nor will a parking
congestion be generated in that the facility was
developed as a commercial cente~ with sufficient
planning for traffic circulation and adequate parking.
3. The proposed sales of alcoholic beverage will be within
a development which is consistent with the objectives of
the City's General Plan. The proposed conditional use
permit is consistent with the letters dated June 11,
1987, July 3, 1987, August 18, 1987, January 20, 1988,
February 5, 1988 and March 16, 1988 from the State
Office of Planning and Research to the City of San
Bernardino which stipulate that n land uses

concentration of alcohol outlets in the area in that
nine outlets exist in the immediate area fer off-sale.

distance of alcohol outlets to residential buildings,
churches, schools, hospitals, playgrounds, parks, or
other existing alcohol outlets as the existing
commercial center is less than 100 feet from the

The proposed use is permitted in the C-2 zone, subject
to a Conditional Use Permit. It is consistent with the
letters dated June 11, 1987, June 3, 1987, August 18,
1987, January 14, 1988, February 5, 1988 and March 16,
1988, from the State Office of Planning and Research to
the City of San Bernardino which stipulate that ....land
uses proposed during the period of the extension will be
conEistent with the purpose of the updated general plan
plovisions....., and with the City of San Bernardino
Housing and Scenic Highways Elements.
The proposed project is in conformance with the San
Bernardino Municipal Code. See Attachment "A.,
Municipal Code and General Plan Conformance.

The 7564 square foot commercial center in which the
mini-market is located was approved by the Development
Review Committee with Review of Plans 85-104 on November
24, 1985. That project met all City requirements for

parking, landscaping and circulation. The applicant
applied for a Conditional Use Permit on October 14, 1987
but withdrew the application after discussions with the
Police Department revealed that similar applications had
been denied in the area.
The Planning commission denied and the police protested
the last two applications for off-site consumption of
alcoholic beverages in this area, Conditional Use Permit
87-3 and Conditional Use Permit 87-41, because of over
concentration. The new Lucky's, located approximately
600 feet south of this application, has off-site
alcoholic beverage sales. It was exempt from the City
ordinance which requires a conditional use permit
because of its size.

developffient that encompasses 40th Street between

general area are eleven restaurants or bars which sell
alcoholic beverages for on-site consumption. There are
nine locations for off-site consumption in this same
area. Alcoholic Beverage Control would allow ten off-
sale licenses based on their census tract ratio.
The site is one-half mile from the nearest Church and
school. It is .3 miles from the park at Waterman and

west of this site. There is an alley and a parking lot
between the residential use and the commercial center.
However, the apartment building is only 85 feet from the
proposed location. The Alcoholic Beverage Control
requirements are that the site be at least 100 feet from
a residence.

The size and shape of the site proposed for the use are
adequate to allow the full development of the proposed
use n a mannel not detrimental to the palticular area
nor to the peace, health, safety ar.d general welfare in
that the comr.lercial center met the City's requirements
for landscaping, parking and circulation at the time of
development, the area is zone for commercial uses, and
has been developed consistently for com~ercial uses.
4.
The traffic generated by the proposed project will not
impose an undue burden upon the streets and highways
designed and improved to carry the traffic in the area
in that the sale of alcohol for off-s:t~ consumption
will not intensify traffic generation.
5.
The granting of this Conditional Use Permit under the
conditions imposed will be detrimental to the peace,
health, safety, and general welfare of the citizens of
San Bernaldino in that there is an over concentration in
the area and the site is less than 100 feet from a
residential district.

1. The introduction of alcoholic beverages sales at the
proposed location will pose significant impacts to the
surrounding land uses as the site is less than 100 feet
from a residential structure.
2. The introduction of alcoholic beverage sales at the
proposed location will not create an adverse impact on
the surrounding traffic pattern nor will a parking
congestion be generated in that the facility was
developed as a commercial center with sufficient
planning for traffic circulation and adequate parking.
3. The proposed sales of alcoholic beverage will be within
a development which is consistent with the objectives of
the City's General Plan. The proposed conditional use
permit is consistent with the letters dated June 11,
1987, July 3, 1987, August 18, 1987, January 20, 1988,
February 5, 1988 and March 16, 1988 from the State
Office of Planning and Research to the City of San
Sernardino which stipulate that ....land uses proposed
during the period of the extension will be consistent
with the purpose of the updated general plan
provisions.... n
4. The proposec use will contribute to an undue
concentration of alcohol outlets in the area in that
nine outlets exist in the immediate area tor off-sale.
Eleven other outlets for on-site sales exist within the
census tract.
5. There will be detrimental effects on nearby
residentially zoned neighborhoods considering the
distance of alcohol outlets to residential buildings,
churches, schools, hospitals, playgrounds, parks, or
other existing alcohol outlets as the existing
commercial center is less than 100 feet from the
residential district and within one-half mile of
schools, churches and parks.

POLICE DEPARTMENT RECOMMENDATIONS:
The recommendations of the San Bernardino police Department, is
to protest this CUP 88-19 to Alfi's Mini Mart. 4276 Sierra Way.
San Bernardino. In addition to the form .police concern" which
has been filled out indicating the number and name of on-sale and
off-sale licenses in census tract #45. taking into account the total
shopping area of 40th Street and Sierra Way, there are 23 ABC
licenses that sell beer and wine to go. Five of which are off-sale
beer and w~ne, s~X are off-sale general and the remainder, thirteen
are on sale. The on-sale l~censes include Type 41, 47 and 48. which
all have off-sale privileqes.
In addit~on, there have been three establishments in the last year
and a half that have attempted to go into the same geographic area.

It has come to my attention that application has been made by a business
dba. Alphies Market.
My understanding is that the business wants a beer and wine off-sale
license.
The primary concern is that there are already a total of 20 on- and
off-sale licenses in this area located between Waterman Ave. and Mt.
View, and from 40th Street to about 48th Street.
The "D" and "F" Areas have exper~enced an increase of alcoholic beverage
container litter~ng as well as loitering and drinking in public areas,
such as parking lot and public parks.
With this large number of licensees located in a relatively small
concentrated geograph~c area, the public is well served as a matter
of convenience.
In adding any more such places for the distribution of alcoholic
beverages is counter productive regarding public health and safety.
The saturation point has been reached.
As the Area Commander responsible for all police related law enforcement
efforts, ~t ~s ny opinion that granting ~ additional permits in
tr.e 3lea would negat~ve~y ~mpact public safety and the public health.
