STAFF REPORT
In 1970 the RedeveloplleD.t Aaency acquired title to the City Hall, Ezhibit Hall and the
Plaza Parcel East and West Portion (see attached Map 12). The City Ball and Exhibit
Hall parcels were deeded to the City.
In May 1970 the City ground leased the City Ball and Exhibit Ball parcels to the San
Bernardino Civic Center Authority who subleased these parcels to the City of San
Bernardino.
The City subleased the Exhibit Ball parcel to the Marulto Hotel in 1987.
Staff recently becalle aware that although the City has been lI&intaining the Plaza
Parcels, the Parcels were never actually leased or dedicated to the City and are still
owned by the Redeveloplle11t Aaeney.
The Owner's Participation and DeveloP\llent Aareeaent (OPA) between the City, the
RedeveloP\llent Aaency and Marulto, Iuc" II&kes the Redeveloplllent Aaeney responsible for
lIaintenance and operation of the West Portion Plaza area, Counsel advises that
section 33445 .of the Health and Safety Code specifically prohibits the Redevelopment
Aaency froll lI&intaining publicly owned facilities. The RedeveloP\llent Aaency thus
finds itself in the position of being obligated under the OPA to do sOllething that it
is legally prohibited from doing.
The recollllended solution to this problell is to sell the Plaza areas to the City for
$1.00, The Co..ission previously authorized a lot line adjustment and the transfer
would take place after the adjustment is recorded.
The COIIIII1JI1i ty DeveloJllleD.t Co_ission can find that the sale is consistent with the
Interilll Policy Document because the up designation is PF (Public Facilities).

OF A PROPOSED AGREEMENT WITH THE
REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO

It is proposed that the Redevelopment Agency of the City of San Bernardino
sell to the City of San Bernardino the property described on the attached
Exhibit "A".
1) The.cost.of the agreement to the Agency, including land acquisition cost,
clearance costs, relocation costs, the cost of any improvements to be
provided by the Agency, plus the expected Interest on any loans or bonds
to finance the sale Is $235,430.
2) The estimated value of the Interest to be conveyed or leased, determined
at the highest uses permitted under the plan is not less than $860,040.
3) The purchase sale Is $1.50. The reason this is less than the fair market
value is.: Benefits the public by providing public access to City Hall and
Convention Center.
The attached Exhibit "B" described the transaction.

S89.SS'49"E along the South line at said Parcel 21 68.64 feet; thence SO.04'U"W 14.08
feet; thence S4S.04'U"W 11.S5 feet: thence SO.04'l1"W 70.84 feet: thence S45.04'U"W

SAN BERNARDINO.
BE IT RESOLVED BY THE COMMUNITY DEVELOPMENT COMMISSION OF
THE CITY OF SAN BERNARDINO AS FOLLOWS:
. SECTION 1. Recitals.
A. State law provides that Redevelopment Agencies may
acquire and own real property for redevelopment purposes.
B. Certain property near the City Hall of the City of San
Bernardino has been inadvertently retained by Agency following
its development.
C. Transfer of this property to the City is more in
keeping with the purpose and intent of the redevelopment law.
D. Notice of this public hearing has been given as
required by law.
SECTION 2. Determination.
It is therefore determined, directed and ordered that the
Chairman be authorized to execute a Deed of the properties to be
executed and delivered to the City of San Bernardino in
consideration for the payment of One Dollar ($1.00).
