1. REQUEST TO DISCUSS INTERNAL PROCEDURE CURRENTLY
BEING USED BY CITY IN CONNECTION WITH MEASURE HH The
Committee received reports from the citizens For Responsible
Research, The Humane Society and the Animal Advisory Commis-
sion (attached). The Committee recommended, if not already
on the books, the motion made and approved by the Animal
Advisory commission to officially endorse the current avail-
ability and adoption policies of the City of San Bernardino
Animal Control Division. This resolution, if necessary, will
be on the August 15, 1988 Council Agenda. A commendatory
resolution from the Humane Society was presented to the
Committee. The Committee requested it be placed in Ms.
Deborah Biggs personnel records and that it be read at the
August 1st Council meeting. Accusations regardihg the Fifth
Ward appointee, made by letter from the Citizens For Respon-
sible Research, was vehemently refuted by Councilman Minor.
The members from that organization had already departed after
reading their letter into the record.

2. ORDINANCE TO LIMIT CAMPAIGN CONTRIBUTIONS - Con-
tinued to second meeting in August. The City Attorney
briefed on a new law regarding campaign funds. Although a
clarification has been requested from the Fair Political
Pract~ces Commission, Mr. Penman advised that the law will
require all campaign chests to be depleted by the end of
December. The Fair Political Practices Commission will render
a ruling the week of July 25.
3. MUNICIPAL CODE CHANGES RELATIVE TO CABLE TELEVISION
- Item continued.
4. PARKING TRUCKS ON RESIDENTIAL STREETS - Item con-
tinued.
5. GENERAL PLAN INTERIM POLICY DOCUMENT DISCUSSION
Item continued. The recommended amendments to the Interim
Policy Document made by the City Attorney (attached) will be
forwarded for approval on the August 1, 1988 Agenda. Because
of continuing changes and reviews of policy regarding this
issue, it was determined that the Interim policy Document
remain on the Legislative Review agenda.
6. SPRINKLER ORDINANCE - Item continued to September
8th. The Committee requested additional information on the
cost to retrofit and life expectancy of the system.
7. PROPOSED NEWSRACK ORDINANCE - Item continued.
8. PROPOSED ORDINANCE PROHIBITING CARRYING
WEAPONS - The Committee determined to forward the
ordinance amendment to the full Council without
.endation. The ordinance will be on the August
agenda.

9. PROPOSED CHARTER AMENDMENT - PROSECUTION OF STATE
LAW VIOLATIONS (MISDEMEANORS AND INFRACTIONS). The Committee
agreed to forward this item for hearing by the full Council.
Councilman Minor stated his opposition to amending the
charter. He expressed concern that additional staff would be
required. The item will be heard on July 27 so that, if
passed, there will be time to process the resolution in time
for the November election.

r Mayor and Council Members:
In San Bernardino, the Mayor and City Council have long been pre-
occupied with matters of image. You have shown particular concern
wi th the impre~sion the City makes on prospective employers and
investors. Amid recurring civic scandals, during the course of
drastic changes in both political and administrative personnel, the
themes of beautification and economic enhancement carry top priori-
ties,
Why then hasn't San Bernardino's quest for regional recognition
included more positive steps toward local resolution of the animal
rights versus scientific research question? Our area continues to
evolve rapidly toward world prominence as a center for medical
treatment and research. The possibilities for major economic gain
through local development of bio-medical industries and support
services seem limitless.
San Bernardino's leadership in these vi tal fields could mean an
increased share of the billions of dollars now generated annually
in medical research and treatment-related activities.
San Bernardino spends millions trying to attract new jobs. Well.
potentially, here they are!
Doesn't it occur to you that your foot-dragging on the issue of
support for medical research is exacting a price? Your credibility
is on the line, You cannot continue to allow radical animal rights
activists to make civic policy in San Bernardino and not expect the
City's (and the region's) reputation to suffer.

Major medical centers, pharmaceutical firms, laboratories,
suppliers of bio-medical services and products, and the physicians,
researchers, technicians, and managers who run them do not view San
Bernardino as a potentially supportive environment. This is your
responsibility. You have placed at least one person with a dubious
background in illegal pro-animal rights activism in an important
policy role in the city animal control. The obvious biases of most
others on these bodies should also disqualify them from serving.
Recently, the Director of the City Pound testified (during work
hours?) against the scientific community before San Diego's City
Council - which then wisely voted unanimously to disregard her
testimony.
When are you going to match your words with deeds? San Bernardino
has decades of negative impressions to overcome. Civic involvement
with pro-animal rights activists is the last thing the City needs
now.
You should act immediately to remove radical animal rights
activists from City boards and commissions and from City employment
where their views are incompatible with carrying out City policies.
The people voted, albeit narrowly, in 1986 to maintain sales of
unwanted animals to research institutions. Massive and unreported
amounts of outside money accompanied by shrill and inaccurate
animal rights arguments failed to sway public opinion, and these
individual lost their case at the polls.
Now, do your duty and enforce the will of the majority. In the
process you will have a positive influence on San Bernardino's
image and economic future.

No doubt your tlme lsvery valuable. It is with regret that I write thls
letter. knowing full well that more of your time and mlne wl1l be wasted
on an issue that I thought had been resolved appropriately and to the
satisfaction of the citizens of the City of San Bernardino.
Attached for your information is a summary statement generated by the
committee "Citizens For Responsible Research" which outlines the sequence
of events that brought the animal issue into sharp focus here in San
Bernardino. the efforts of the committee and the result of ballot Measure
HH. . Clearly. the committee and others invested a tremendous amount of
time. energy. effort and resources in reaffirming the wlll of the citizens
of San Bernardino to contlnue the long standing polley of making anlmal
models available to approved research instltut1ons.
Of concern to me was the recent appointment of Ms. Margo Tannenbaum as a
member of the Animal Control Commission. an appolntment you proposed and
approved by the City Council. You qualify your reason for proposlng her
appointment as wanting to hear from the other side; it appears to me that
your intent was to circumvent the will of the people. '
Shortly.after Tannenbaum's appointment. Mr. Paul Turner. Director of the
Animal Shelter. in a memorandum dated August 6. 1986 issued a revised
policy for animals available for sale to Research, The poliCY as I
understand it. was the result of suggestions from Ms. Tannenbaum which by
the way. has drastically reduced the number of animals available to
researchers if you look at sales in August and September which represents
the period following adoption of the new polley.
Since Ms. Tannenbaum was the leading spokesperson for the animal rights
movement here in San Bernardino during their futile attempt at denying
needed animals for important research. and since you appointed her to the
Animal Control Commission. and the fact that she is allowed to place
volunteers at the shelter to harass workers and research personnel who
come there to buy animals. I cannot help but assume that your aim in
appointing her to the commission was to circumvent the policy approved by
the citizens that you represent, thus denying scientists the tools they
need,. to continue to perform important medical research.
Measure HH won at the ballot box. Margo Tannenbaum. a staunch supporter
of animal rights, vowed to deny animals to researchers by whatever means
were available. It appears to me that she has in fact succeeded to .a

Dear Mr. Quinto,
As a follow up to our phone conversation yesterday, I have check my
records on who testified at the San Diego County' Animal Control Advisory
Board Public Hearing on September 9th, 1987. Debbie Biggs did testify as a
representative from the San Bernardino Department of Animal Control
supporting the Animal Rights Coalition which was urging San Diego County to
discontinue the release of unclaimed and unadopted animals to UCSD for
medical research.
I remember I was surprized to here her testimony considering that on the
previous day (Sept. 8th) the San Bernardino City Counsel reaffirmed their
support for the release of animals to medical research institutions, I guess I
was naive in my assumption that Ms, Biggs would abide by the City's wishes
and likewise support mediCal research,
If iiFAR can be of any assistance to the Committee in your efforts secure
the continued supply of random source animals for research in your area,
please let me know. We take this matter very seriously because we realize
the future medical breakthroughs our members are waiting for will come
about only through the continued responsible use of animals in medical
research, and any attempts to restrict the supply of needed research animals
is an attempt to retard medical progress.

At a meeting of the Animal Advisory Commission on July 20,
1988, the "aval lability policy" and Internal procedures of
animals for research was discussed.
Loren Mc Queen of the City Attorney's office stated that
Advisory Measure HH was a voter opinion "having no legally
controlling effect over the legislative acts of the Mayor and

It is important to our organization that the San Bernardino
City Animal Shelter be well run and that animal control efforts
in our city be purposive and effective.
We believe these interests to be consistent with your own.
The choice of your current Animal Control Director reflects these
goals. Since that choice was made, there have been important,
positive changes in the operation of the Animal Shelter, and
there have been proposals made by the Director, and endorsed by
the City, which reflect not only a progressive approach to Animal
Control, but also reflect an expert and professional approach to
the running of this department.
An effort is currently being made by Citizens For
Responsible Research which we believe challenges the authority of
your Animal Control Director and threatens the integrity of your
Animal Control Program.
We hope that in deciding the issues which have been raised
you will give credence to the professional recommendations of
your Director, and will, in fact, give them priority over the
recommendations of a special interest group outside the community
who have no vested interest in the quality of your Animal Control
program. We hope that you will take steps to protect the
effectiveness of the Animal Control Department as you would to
protect that of any other department in City government.
In recognition of the achievements and qualifications of
your current Director, the Humane SOciety of San Bernardino
Valley has adopted a resolution in her support which we
respectfully submit to you at this time.

Bernardino Valley, Inc. recognizes the substantial improvements
in the operation of the San Bernardino City Animal Shelter under
the Direc~orship of Deborah Biggsl
WHEREAS, these improvements include: Better care of the
animals, a higher rate of adoption, improved sanitation, general
improvement of the physical facility at the shelter, improved
staff morale, and better relations with the San Bernardino
community 1 therefore, be it
RESOLVED, the Board offers it's highest endorsement of
Director Biggs' professional abilities and urges the City to give
priority to her professional judgment over those of groups or

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING THE
INTERIM POLICY DOCUMENT RELATING TO DEVELOPMENT STANDARDS PENDING
ADOPTION OF A FINAL GENERAL PLAN.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Section 44 of the Interim Policy Document is
hereby amended to read as follows:
"44. Zone changes need not be made, and development
consistent with this document despite the requirements of the
underlying zone district may be processed, during the life of the
Interim Policy Document."
SECTION 2. Section 47 of the Interim Policy Document is
hereby amended to read as follows:
"47. All of the standards of the existing zone districts
as specified in Title 19 of the San Bernardino Municipal Code
which are deemed compatible by Attachment C with the land use
designations adopted by this document and the Preferred Land Use
Alternative are hereby incorporated into this document and shall
apply to development within the specific land use designation
unless otherwise specified in this Interim POliCY Document. In
any conflict between the requirements of this document and Title
19, the provisions of this document shall take precedence. If
more than one zoning district is listed on Attachment C as
compatible with specific land use designation, the most
restrictive zone district and its standard shall apply. Any
question as to which zone district is most restrictive shall be
decided by the Planning Commission with right of appeal to the

SECTION 3.
Section 71 is hereby added to the Interim
Policy Document to read as follows:
"71. Any residential land use designation outlined in the
Preferred Land Use Alternative shall also allow development
consistent with this document less dense than the density
standard specified for such land use designation; provided,
however, that multi-family designations shall not allow single-
family development unless otherwise specifically allowed herein."
