STAFF REPORT
Over the last several months, discussions have been held between
Planning, Community Development, Redevelopment Agency staff and
certain property owners regarding inconsistencies between current
zoning and the General Plan/Northwest Redevelopment Project Area
Plan. An item requesting a discussion of this issue was placed on
the October 6, 1986 agenda of the Mayor and Common Council and
continued twice to October 20 and November 3, 1986, respectively.
The predominent zoning for the affected area, Mt. Vernon Avenue from
4th Street to Highland Avenue, is C-3A, Limited General Commercial
(identified as Map No.4 -- Existing Zoning). The General Plan and
Northwest Redevelopment Project Area Plan (Map No.8) propose
multiple family development at a density ranging from four (4) to
twenty-four (24) units per acre.
Any individual, company or corporation requesting changes of zone
from existing zoning would be subject to all rules and regulations
relative to consistency with the General and Northwest Redevelopment
Project Area Plans. Moreover, the commercial-designated area of the
Enterprise Zone, Mt. Vernon Avenue from 4th Street to Highland
Avenue, and associated incentives would be destroyed if rezoning of
property consistent ~lith General/Northwest-Redevelopment Project Area
Plan was to take place.
It should be noted that the inconsistency exists only between the
General/Northwest-Redevelopment Project Area Plan and current
zoning/Enterprise Zone. The status quo of differences between the
General Plan/Northwest Redevelopment Project Area Plan and current
zoning allows the development community the greatest degree of flexi-
bility in meetng the development objectives of the Northwest Re-
developmentProject Area and the Enterprise Zone.
It is for these reasons and others noted earlier. particularly with
respect to the negative impact on the Enterprise Zone, that staff
recommends against reconciling the zoning and plan differences
described above. It would be difficult for the City to justify
approval of inconsistent zoning requests.
