A total of 3 bids were received, for the 8 month period from 11-1-86 to 6-30-87, ranging from $23,000.00 to $57,744.00. The low bid of $23,000.00 did not contain a proper bid security. This bid has been reviewed by the City Attorney's Office, and a determination made that it can not be accepted. The second low bid was in the amount of $34,773.68 or $4,346.71,per month. All 3 bidders were pre-qualified by the Public Buildings Superintendent. An amount of $27,242 was included in the 1986-87 Budget, under Account No. 001-323-53115, "Custodial Services". Approximately $8,483 will be paid to American Sweeping for the 120 day extension to their contract. The total estimated cost for sweeping services during the 1986-87 fiscal year is $43,257, which is $16,015 over the budgeted amount. We recommend that the low bid be rejected and a contract awarded to the second low bidder. URGENCY CLAUSE: The 120 day extension to the contract with American Sweeping Service will expire on about 10-31-86. RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO IPS SERVICES, INC. FOR PROVIDING SWEEPING SERVICES FOR CENTRAL CITY MALL SURFA~~ARKING SPACES AND THREE-LEVEL PARKING STRUCTURE AND REJECTING THE LOW BID. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: Section 1, IPS Services. Inc. is the lowest responsible bidder for providing Sweeping Services for Central City Mall Surface Barking Spaces and Three-Level Parking Structure, in accordance with Plan No, 7085, for the total amount of $34,773.68, for an 8 month period from 11-1-86 to 6-30-87. a contract is awarded to said bidder accordingly, but such award shall be effective only upon the contract being fully executed by the parties; all other bids therefor are hereby rejected; and the Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. Section 2. Execution and Amendments. This contract and any amendments or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements. amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. Section 3.
