ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SAN BERNARDINO MUBICIPAL CODE SECTION 15.57.040 SUBSECTION B RELATING TO CULTURAL-n!VELOPMENT CONSTRUCTION FEES AND FIXING A DATE UPON WHICH DEVELOPMENT PERMITS WILL BE SUBJECT TO SUCH FEES AND DECLARING THE URGENCY THEREOF. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1. San Bernardino Municipal Code Section 15.57.040 Subsection B is amended to read as follows: "B. Notwithstanding the foregoing provisions, the fee shall not be imposed and charged for any application together with two sets of complete specifications as required by Sections 301 and .:..... ..1'.,' Building Code are filed with and approved by the Cit,t,prior to October 9, 1986, provided that the applicant has paid~.if7p~iY; check fees prior to that date." SECTION 2. This ordinance is an urgency measure, which shall take effect and become operative upon its adoption and approval. The facts constituting such urgency are that the present ordinance's effective date is September 8, 1986, and there are projects already in the development process which will be unfairly burdened with this assessment fee. In order to ~t, fairly implement this measure the effective date should be October 9, 1986.
