Prince Phone: 5255 Supporting data attached: Yes Ward: N/A NIA FUNDING REQUIREMENTS: Amount: None Sou rce: Finance: Council Notes: 75-0262 Agenda Item No, d3 ~ll " o o o 1 ORDINANCE NO. 2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SAN BERNARDINO MUNICIPAL CODE SECTION 2.42.010 TO DELETE MEMBER 3 AFFILIATED WITH A CABLE TELEVISION OPERATOR FROM THE MEMBERSHIP OF THE COMMUNITY TELEVISION COMMISSION, AND AnDING SECTION 2.42.030 4 TO PROVIDE FOR INDUSTRY NONVOTING LIAISON 'PERSONS. 5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO 6 ORDAIN AS FOLLOWS: 7 SECTION 1. Section 2.42.010 of the San Bernardino Municipal 8 Code is amended to read as follows: 9 "2.42.010 Members - Appointment. 10 The Community Television Commission shall consist of nine 11 members who shall serve at the pleasure of the Mayor and Common 12 Council, and who shall be and shall remain users of cable 13 television service within the City. The Mayor and Common Council 14 declare that the indiv,iduals appointed to the Commission are 15 intended to represent and further the interests of the consumers 16 and to assist the providers of cable television services in 17 furthering and serving the public interest. Members of the 18 Commission shall be appointed and serve pursuant to the provisions 19 of Chapter 2.17." 20 SECTION 2. Section 2.42.030 is hereby added to the San 21 Bernardino Municipal Code to read: 22 "2.42.030 Industry liaisons - nonvoting. 23 Any representative affiliated with a cable television 24 operator holding a valid franchise to provide cable television 25 services within the City shall be appointed by the Mayor and 26 Common Council to serve in a nonvoting capacity to provide liaison 27 between the cable television operators and the COmmission. Said 28 representatives shall not attend executive sessions of the c -- 1 o o o 1 Commission except in compliance with the Ralph M. Brown Act and 2 upon an affirmative vote of a majority of the voting members in 3' attendance at Commission meetings." 4 I HEREBY CERTIFY that the foregoing ordinance was duly 5 adopted by the Mayor and Common Council of the City of San 6 Bernardino at a meeting thereof, held 7 on the day of , 1986, by the following 8 vote, to wit: 9 10 AYES: Council Members 11 NAYS: 12 ABSENT: 13 14 15 16 17 18 19 20 City Clerk The foregoing ordinance is hereby approved this day of , 1986.
