CIIf OF SAN BERNARDio - REQU& FOR COUNCIL ACQON STAFF REPORT On April 6, 1981, the Honorable Mayor and Common Council adopted Resolution No. 81-151, authorizing the then Risk Management Coord- inator to reimburse volunteers up to $100. for out of pocket losses incurred while assisting with emergency situations. In August, 1985, the Director of Emergency Services & Risk Management experienced his first claim under this Resolution. In reviewing the Resolution, it was determined the contents of the claim were vague, and the account payment was to be made from, was not specified. This Resolution would correct these concerns, and would cause better control, Changes and corrections include an increase from $100, to $250, due to inflation; using a standard liability claims form which requires all necessary information; filing with the City Clerk rather than Risk Management, as with all other claims; and specifies the account the funds should be paid from, It is estimated that at a maximum two claims per year under this Res- olution will be filed. 75-0264 . o o o o 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO REIMBURSE VOLUNTEERS FOR OUT OF POCKET LOSSES 3 INCURRED IN ASSISTING PERSONS IN EMERGENCY SITUATIONS INVOLVING ACTIVITIES NORMALLY PERFORMED BY CITY GOVERNMENT OR ACTIVITIES 4 RELATING THERETO, AND REPEALING RESOLUTION NO. 81-151. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 6 7 SECTION 1. It is declared to be a municipal and public 8 purpose that volunteers be encouraged to assist others in 9 emergency situations involving danger to life or property. One 10 method to encourage vo1unteerism in emergency situations is to 11 reimburse such volunteers for out of pocket losses incurred in 12 assisting others when such assistance involves government related 13 activities and the loss is not otherwise compensable. 14 SECTION 2. The Mayor and Common Council of the City of San 15 Bernardino.dec1are their intention to reimburse volunteers in 16 meritorious instances for out of pocket losses incurred in 17 assisting persons in emergency situations involving activities 18 normally performed by City government or activities directly 19 related thereto. 20 SECTION 3. Except as otherwise authorized by state law, a 21 volunteer may be reimbursed in meritorious instances by the Mayor 22 and Common Council for out of pocket losses not otherwise 23 compensable, which are incurred in assisting another person in an 24 emergency situation involving an activity dangerous to life and 25 property and for a municipal and public purpose which is normally 26 performed by the City government, or any activity directly related 27 thereto.
