Council Notes: 1 75-0262 Agenda Item No:""- :JcB, . , CIIf OF SAN BERNARDI~ - REQU.9r FOR COUNCIL AC~ON STAFF REPORT As a part of the development of Del Rosa Drive, between 9th and Baseline Streets, the plans call for the installation of a traffic signal, A portion of this intersection is within the County and, as such, the City needs a cooperative agreement for the installation of the signal and to cover the future costs associated with the operation and maintenance, In addition to funds already in Account Number 242-362-57342, ($84,928), the City will receive $342,796 of Regional FAU Funds for the construction of Del Rosa Avenue from 9th to Baseline, including the installation of the signals, The FAU funds have been approved by SANBAG, The agreement provides for County participation in the maintenance but not in construction costs, Total funds available should be adequate for all portions of the required work, Staff has prepared a cooperative agreement, and it has been reviewed and accepted by the County as to form, It is, therefore, recommended that the Mayor and Council authorize the execution of this document allowing the installation and maintenance on an equitable basis between the City and County, 75-0264 , 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 o o o RESOLUTION NO. RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF A COOPERATIVE AGREEMENT FOR TRAFFIC SIGNAL INSTALLATION AND MAINTENANCE AT DEL ROSA AND BASELINE WITH THE SAN BERNARDINO COUNTY DEPARTMENT OF TRANSPORTATION. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Director of Public Works/City Engineer of the City of San Bernardino is hereby authorized and directed to execute on behalf of said City a Cooperative Agreement for Traffic Signal Installation and Maintenance at the Intersection of Del Rosa and Baseline with the San Bernardino County Department of Transportation, a copy of which is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. , I HEREBY CERTIFY that the foregoing resolution was duly adopted by the Mayor and Common Council of the City of San Bernardino at a meeting thereof, held on the the following vote, to wit: AVES: Council Members day of , 1985, by NAYS: ABSENT: City Clerk The foregoing resolution is hereby approved this , 19B5. day of Mayor of the City of San Bernardino Approved as to form: N~W~ City Attorney . o o o o COOPERATIVE AGREEMENT .-. ... ~. ) This Agreement, entered into on this _day of 1985, by and between the County of San Bernardino, hereinafter referred to as "County," and the City of San Bernardino, a muni- , cipal corporation; hereinafter referred to as "City." WITNESSETH: WHEREAS, City has a project to construct Del Rosa Drive between 9th Street and Baseline Street; and WHEREAS, it has been determined that traffic signals will be needed at the intersection of Baseline Street, upon opening this last section of Del Rosa Drive to traffic, and WHEREAS, two of the four approaches to this intersection are under jurisdiction of the County; and WHEREAS, County and Ci ty desire to mutually cooperate in the installation of traffic signals, in conjunction with the City's Federal-Aid Urban Project to construct this section of Del Rosa Drive; and WHEREAS, City has applied for regional Federal-Aid Urban Funds for the project; and WHEREAS, County and City desire to set forth the responsibilities and obligations of each agency in respect to the installation of traffic signals at this intersection. 1.0 f!!l Agrees: 1.1 To act as lead agency for the installation of these traffic si gnal s. 1.2 To contact the various utility companies that may have 1 . . Q o o o facilities in conflict with the proposed construction, and make the necessary arrangement.,for relocation to facilitate the work. 1.3 To have these traffic signals installed under the con- struction contract for the extension of Del Rosa Drive. 1.4 To finance the total cost of installation of these traffic signals, with regional Federal-Aid Urban Funds, at an estimated cost of $80,000.00. 1.5 To comply with all applicable provisions for expendi- ture of Federal-Aid Urban Funds. 1.6 To secure approval from County of the plans, specifica- tions and estimate prior to advertising for bids. 2.0 County Agrees: 2.1 To allow City to have traffic signals installed at this intersection under a construction contract. 2.2 To assume County's proportionate share of the mainten- ance and operation costs (estimated at 50S of total cost) upon completion and acceptance of the traffic signals. 3.0 11 i! Mutually Agreed as Follows: 3.1 Neither party to this Agreement nor officers nor employees thereof shall be responsi~le for any damage or liability occurring by reason of anything done or omitted to be done by the other party to the Agreement under or in connection with any work, authority or Jurisdiction not delegated to the parties under this Agreement. It is also agreed that, pursuant to Govern- 2 . Q ment Code SecOon 895.4, eacOparty shall fully' indemnify and hold the other party hafmless from any liability imposed for injury (as ~~fined by Government Code Section 810.8) occurring by reason of anything done or omitted to be done under or in connection with o any work authority of jurisdiction under this Agreement. 3.2 This Agreement may be amended or modified at any time upon mutual agreement of the parties hereto.
