Synopsis of Previous Council action:
Previous Planning Commission action:
At the meeting of the Planning Commission on August 6, 1985. the
following recommendation was made:
The application for Change of Zone No. 84-12 was unanimously
recommended for approval of PRO-3U Planned Residential Development
Zoning at three units per acre. The Negative Declaration for
environmental review was also approved.
Recommended motion:
To approve the responses to comments and to adopt the Negative
Declaration for environmental review which has been reviewed
and considered.
To approve. modify or reject the findings and the recommendation
of the Planning Commission and to direct the City Attorney to
prepare the necessary amendments to the Zoning Ordinance.

Subject: Change of Zone No. 84-12
August 19, 1985
The Planning Commission, at their meeting of August 6, 1985,
reviewed Change of Zone No. 84-12, a proposal to rezone
approximately 8.5 acres of land from R-1-20,000 to R-l-
10,800. This item was continued by the Planning Commission
on several occasions to allow both the Department and the
Verdemont Area Citizen Advisory Committee sufficient time to
complete the Verdemont Area Plan.
The Planning Commission has reviewed
Verdemont Area plan and is currently
the plan which should be transmitted
by October, 1985.
The Planning Commission, in reviewing the proposed applica-
tion at their meeting of August 6, 1985, considered, at the
request of the applicant, Joseph Bonadiman, a proposal to
amend the original request from R-l-lO,800 Single-Family
Residential <minimum lot size 10,800 square feet) to PRO-3U
Planned Residential Development zone at three units per acre.
After reviewing the proposed amendment, it was the opinion of
the Commission that the request was reasonable, since it was
in compliance with the existing Comprehensive General Plan
and the proposed alternative being finalized. Therefore, it
was the Commission's opinion that this recommendation should
be transmitted on to the Mayor and Council for adoption.

Change of Zone No. 84-12 was originally continued from the Planning Commission
meeting of July 17, 1984, pending the completion of the Verdemont Study. At the
Planning Commission meeting of April 9, 1985, the Commission recommended cer-
tification of the Verdemont Study EIR and approval of land use Alternative V.
Alternative V indicates a land use of residential with a density of 3 dwelling
units per acre on the property requested for rezoning. Change of Zone No. 84-12
requests a zoning of R-I-I0,OOO, which would allow a density of 4.3 dwelling
units per acre. Therefore, the proposed zone change would exceed a density of 3
units per acre and would be inconsistent with the Verdemont Area Plan
Alternative V. The original staff report has been updated to reflect the action
taken by the Commission on the Verdemont Area Plan. Staff maintains its origi-
nal recommendation for denial of Change of Zone No. 84-12 from R-I-20,OOO to
R-1-10,DOO.
Should the Mayor and Common Council not adopt or amend Alternative V of the
Verdemont Plan, the applicant will have the option to file a new change of zone
application on the property. However, at this time it is unknown when such
action by the Mayor and Council is expected.
Staff therefore recommends that action be taken on Change of Zone No. 84-12 at
this time. Further, based upon the observations contained in the the staff
report and the inconsistency of the proposed zoning with the surrounding zoning.

of Change of Zone No. 84-12 from R-1-20,000 to R-1-10,ODO.

approximately 8.5 acres havinq a frontage of approximately 560 feet on the
east side of Palm Avenue and being located approximately 588 feet north of the
centerline of Ohio Avenue. The proposal is to change the land use zoning
district from R-1-20,000, Single-Family Residential (minimum lot area of
20,000 square feet) to R-1-10,OOO Single-Family Residential (minimum lot area

1. The applicant requests approval to change the zoning from
R-1-20,OOO square feet to R-l-10,OOO square feet on a parcel of
land encompassing 8.5 acres, located on the east side of Palm
Avenue approximately 580 feet northerly of Ohio Avenue in the
Verdemont Area. The proposed zone change would permit up to 37
parcels on the property at a density of 4.3 units per acre.
2. The property is currently vacant and is located at the base of the
foothills sloping to the southeast at 10%. Relatively extensive
grading would be required to develop the property with 10,000
square foot parcels. The higher density and smaller lot sizes
that would be permi tted through the subject zone change should be
located in the flatter areas in Verdemont to avoid the degradation
of the slopes areas through grading.
3. The surrounding land uses include: single-family dwellings to the
west and vacant property to the north, south, and east. The sub-
ject property is currently zoned R-1-20,OOO square feet which is
consistent with the zoning to the south and east.
The zoning to the west is R-l, 1 acre minimum lot size and
R-l-10,800 square feet to the north. It is the intent of the San
Bernardino Municipal Zoning Code to maintain uniformity and con-
sistency of zoning designations in a particular area to avoid the
creation of spot zoning. The proposed zoning would represent a
higher density and allow a smaller lot size than any of the pro-
perty surrounding it.
4. The existing R-1-20,OOO square foot lot size provides a buffer
area between the lower density R-l, 1 acre to the west and the
R-l-10,800 to the north. Approval of this proposed zone change
would eliminate the buffer area and create nonconforming lot sizes
on the east and west sides of Palm Avenue.
5. The City of San Bernardino General Plan designates the property
as residential at four to seven dwelling units per acre. The pro-
posed zone change is consistent with the existing General Plan
designation. However, the Verdemont Area Plan and associated
Environmental Impact Report adopted by the Planning Commission at
their meeting of April 9, 1985, indicates a land use for this spe-
cific area of residential at a density of 3 units per acre. The
proposed zone change to R-l-10,OOO represents a density of 4.3
units per acre, i nconsi stent wi th the density adopted through the
Verdemont Area Plan.

Alternative V of the Verdemont Area Plan may be altered or not
adopted at the Mayor and Common Council level, however it is
unknown at this time when final action on the Verdemont Area Plan
may be taken. Therefore, Staff recommends that appropriate action
be taken on th is item at th is ti me. Shoul d the density a lter-
native be amended by the Mayor and Common Council, the applicant
will have the option to file a new zone change application.
6. The Environmental Review Committee at their meeting of May 31,
1984 issued a negative declaration for Change of Zone No. 84-12.
The Committee mentioned concern over the proposed lot size, indi-
cating that problems with grading and access may be created if the
zoning is approved.
RECOMMENOA TI ON
Based upon the observations above and the inconsistency of the pro-
posed zoni ng wi th the surroundi ng zoni ng, lot si zes and A lternati ve V
of the Verdemont Area Plan, staff recommends denial of Change of Zone
No. 84-12.
