RESOLUTION NO. 85-261
RESOWTION OF THE CITY OF SAN BERIWlDINO AUTHOJUZDlG THE
EXECUTION OF AN AGIEEIIEJIT WITH THE COUNTY OF SAN BERIWlDINO
AND COIMUNITY HOUSING IESOUllCE BOARD, INC,
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Recitals. The City of San Bernardino has appropriated
8 $25,000 of its Community Development Block Grant funds, and the San Bernardino
9 County BOllrd of Supervisors has committed $55,000 of the County's Community
10 Development Block Grant funds, to provide for the services of the Community
II Housing Resource Board, Inc., to promote fair housing opportunities and
12 educational programs in conjunction therewith within the City and County of
13 San Bernardino. The County of San Bernardino has agreed to act as lead agent
14 in this matter, and to review all advances to and documentation of funds
15 expended by the Community Housing Resource Board, Inc., and to bill the City
16 of San Bernardino for its proportionate share of advanced expenses.

SECTION 2. Implementation. The Mayor of the City of San Bernardino
18 is hereby authorized and directed to execute on behalf of the City of San
19 Bernardino that certain agreement among the County of San Bernardino, the City
20 of San Bernardino, and the Community Housing Resource Board, Inc., a copy of
21 which agreement is annexed hereto as Exhibit "I" and incorporated herein by
22 reference.

AGREEMENT
This agreement is made and entered into this day of
, 19 , by and between the County of San Bernardino,
hereinafter referred to as "COUNTY", the Community Development Commission of
the City of San Bernardino, hereinafter referred to as "CITY", and the
Community Housing Resource Board, Inc., a non-profit organization, hereinafter
referred to as "OPERATING AGENCY".
WITNESSETH
WHEREAS, COUNTY and CITY have entered into a contract with the United
States of America through its Department of Housing and Urban Development (HUD)
to execute the COUNTY'S and CITY'S Community Development Block Grant (CDBG)
Program which include fair housing activities under the Housing and Community
Development Act of 1974, as amended, hereinafter referred to the "Act"; and
WHEREAS, Title VIII of th~ ~jvil Rights Act of 1968, hereinafter referred
to as "Title VIII", as amended, established the policy of the United States to,
within constitutional limitations, provide for fair housing and prohibit any
person from discrimination in the sale or rental of housing, the financing of
housing or in any way making unavailable or denying a dwelling to any person
because of race, color, religion, sex or national origin; and
WHEREAS, pursuant to Title VIII, as amended, the Department of Housing and
Urban Development (HUD) has entered into a Voluntary Affirmative Marketing
Agreement (V.A.M.A.) with the National Association of Real Estate Brokers, to
fulfill the fair housing policy of the United States of America; and
WHEREAS, OPERATING AGENCY was organi zed by HUD under the provi si ons of
Section 809 of Title VIII, as the citizen participation component of the
V.A.M.A. for San Bernardino County, to assist in assuring that the fair housing
and the affirmative marketing provisions of the V.A.M.A. are implemented
locally; and
WHEREAS, OPERATING AGENCY is serving in an advisory and resource capacity
to the eight Real Estate Boards of the 15 District, California Association of
Realtors, who are signatory of the V.A.M.A. in San Bernardino County; and
WHEREAS, COUNTY, CITY and OPERATING AGENCY recognize the need to promote
fair housing programs and the affirmative marketing of homes in the County
through the eight signatory Real Estate Boards;
NOW THEREFORE, in consideration of the mutual convenents herein set forth
and the mutual benefits to be derived therefrom, the parties agree as follows:
1. SCOPE OF SERVICES. OPERATING AGENCY wi 11 provide service in an
advisory and resource capacity to the local real estate board and brokers,
financial institutions and home builders association who are signatory to the
V.A.M.A. with HUD for the purpose of providing fair housing opportunities and

the affirmative marketing of housing and services. These services which are
described in Exhibit 1 of 4. will include. but are not limited to:
(a) Advertising/Marketing
(b) Training and Evaluation
(c) Minority and Women Involvement
(d) Outreach and Recruitment
2. DURATION AND PERFORMANCE. OPERATING AGENCY shall perform services as
outlined in Section 1. Scope of Service, during the duration of this agreement
which shall be in effect from July 1. 1985 through June 30. 1986.
3. COMPENSATION AND METHOD OF PAYMENT. For performance of such
services, COUNTY and CITY agree to pay OPERATING AGENCY an amount of money not
to exceed that specified below:

This payment shall constitute, full and complete compensation for OPERATING
AGENCY's services under this -contract. Said compensation will be paid by
COUNTY and CITY out of CDBG funds received from the Federal Government under
the provisions of the ACT.
For the purpose of this agreement. COUNTY shall act as the lead agency for the
disbursement of compensation and the monitoring of performance. Disbursement
shall be in the form of Advancement of Funds. The payment schedule and payment
amount for said advancements under the terms of this contract are as follows:

All advancement of funds shall be paid by COUNTY with COUNTY being reimbursed
by CITY for its proportionate share of said advancement. CITY's proportionate
share of said advancement shall be thirty-one and twenty-five hundreth (31.25)
percent of the actual advancement paid by COUNTY. CITY shall reimburse COUNTY
within fifteen (15) days after each payment by COUNTY to OPERATING AGENCY.
Within fifteen days of the contract. OPERATING AGENCY shall be paid the first
advancement of funds. Within 45 days from the release of said funds OPERATING
AGENCY wi 11 submit to COUNTY a summary statement with supporting evidence of
expenditures. All subsequent releases of Advancement of Funds shall be
conti ngent upon COUNTY'S recei pt of proper documentati on of expenditures for
the previous advances. In accordance with HUD regulations. "Audit Ready"
supportin9 documentation of expenditure. plus proof of payment for each

expenditure must be submitted. For all subsequent release of funds, OPERATING
AGENCY shall be required to submit to COUNTY supporting documentation of
expenditures 45 days from the date the Advancement of Funds is disbursed.
Supporting statements shall give the total of said expenses and shall also
itemize the same in detail conforming to the budget required by Section 4,
Budget Section, of the Contract. After receipt and approval by COUNTY of each
supporting statement, COUNTY will draw a warrant in favor of OPERATING AGENCY
for the total of the subsequent Advancement of Funds. In the event OPERATING
AGENCY does not expend all of the funds received pursuant to any advancement,
it shall be noted and make due credit and allowance therefore upon its
advancement for the following month. Any money received by OPERATING AGENCY
hereunder and not expended for expenses incurred pursuant hereto and during the
term of this contract shall be promptly returned to COUNTY upon the expiration
of the term of this contract. COUNTY agrees to reimburse CITY its
proportionate share of any returned monies under the terms of this contract.
4. BUDGET SECTION. No more than the amounts specified in the Budget,
Exhibit 2 of 4, which is attached hereto and incorporated herein by this
reference, may be spent for the separate cost categories speCified in Exhibit 2
of 4 without prior written apprgv~l of COUNTY.
5. COMPLIANCE WITH LAWS. All parties agree to be bound by applicable
federal, state, and local laws, ordinances, regulations, and directives as they
pertain to the performance of this Contract. This Contract is subject to and
incorporates the terms of the Act; 24 Code of Federal Regulations, Part 570,
Chapter V; U.S. Office of Management and Budget Circulars A-87, and A-I02
revised as modified by 24 CFR 570.310.
6. PROGRAM EVALUATION AND REVIEW. OPERATING AGENCY agrees to prepare
and submit financial, program progress. evaluations, and other reports as
required by HUD, COUNTY or CITY directives. OPERATING AGENCY shall maintain
such property, personnel, financial and other records and accounts as are
considered necessary by HUD, COUNTY or CITY to assure proper accounting for all
Contract funds. OPERATING AGENCY will permit on-site inspection by COUNTY,
CITY and HUD representatives, and insure that its employees and board members
furnish such information, as in the judgement of COUNTY, CITY and HUD
representatives, may be relevant to a question of compliance with contractual
condition's and HUD directives, or the effectiveness, legality, and achievements
of the program. All OPERATING AGENCY records, with the exception of
confidential client information, shall be made available to representatives of
County, City, and the appropriate federal agencies. OPERATING AGENCY is
requi red to submi t data necessary to complete the Annua 1 Grantee Performance
Report in accordance with HUD regulations in the format and at the time
designated by CITY, and COUNTY Director of HCD or his designee.
7. NONEXPENDABLE PROPERTY. A record sha 11 be ma i nta i ned for each item
of nonexpendable property acquired for this program with HUD CDBG funds. This
record shall be provided to COUNTY and CITY upon request. Nonexpendable
property shall include tangible personal property, including but not limited to
office equipment, and real property and any interest in such real property,
i nc ludi ng any mortgage or other encumbrance of rea 1 property as well as any
funds deri ved from the sa 1 e or di spos it i on of nonexpendab le property. Any
utilization of funds derived from the sale or disposition of nonexpendable
property must have prior approval of COUNTY and otherwise comply with all
applicable laws and regulations. Upon termination of this contract, COUNTY

reserves the right to determine the final disposition of said nonexpendable
property acquired for this program with HUD CDBG funds, including funds derived
therefrom. Said disposition may include COUNTY and CITY taking possession and
title of said nonexpendable property. Nonexpendable personal property means
tangible personal property having a useful life of more than one (1) year and
an acquisition cost of $300 or more per unit.
8. EXPENDABLE PERSONAL PROPERTY. Expendable personal property refers to
all tangible personal property other than nonexpendable personal property. All
purchased expendable personal property with a unit value of $300 or more per
unit must have the prior written approval of the COUNTY Department of Housing
and Community Development Director, or his designee. The printing of the
OPERATING AGENCY's quarterly news letter is exempt from this clause.
9. PURCHASE OR LEASE OF NON-EXPENDABLE PROPERTY OR EQUIPMENT. OPERATING
AGENCY shall obtain three documented bids prior to purchasing or leasing any
nonexpendable personal property or equipment over $300 in unit value as
approved in the Budget, Exhibit 2 of 4 and 3 of 4 upon approval by COUNTY.
OPERATING AGENCY must purchase or lease the equipment from the lowest
responsive bid of a responsible bidder. All equipment that has a purchase or
lease price of over $50 in unit~value and having a life expectancy of more than
one (1) year shall be properly identified and inventoried and shall be charged
at its actual price deducting all cash discounts, rebates, and allowances
received by OPERATING AGENCY. This inventory shall be provided to COUNTY and
CITY upon request.
10. ACCOUNTING. OPERATING AGENCY must establish and maintain on a
current basis an adequate accrual accounting system in accordance with
generally accepted accounting principles and standards.
11. AFFIRMATIVE ACTION. OPERATING AGENCY shall make every effort to
ensure that all projects funded wholly or in part by HUD CDBG funds shall
provi de equa 1 employment and career advancement opportuni ti es for mi nori ti es
and women. In addition, OPERATING AGENCY shall make every effort to employ
residents of the area and shall keep a record of the positions that have been
created directly or as a result of this program.
12. 'CHANGES IN GRANT ALLOCATION. COUNTY and CITY reserves the right to
reduce the grant allocation when COUNTY'S and CITY'S fiscal monitoring
i ndi cates that OPERATING AGENCY'S rate of expendi ture wi 11 resul tin unspent
funds at the end of the program year. Changes in the grant allocation will be
done after consultation with OPERATING AGENCY. Such changes shall be
incorporated into this Contract by written amendments.
13. REVENUE DISCLOSURE REQUIREMENT. By its execution of this Contract,
OPERATING AGENCY certifles that it has previously filed with the County
Department of Hous i ng and Community Development, a wri tten statement 1 i s ti ng
a 11 revenue recei ved, or expected to be recei ved, by OPERATING AGENCY from
Federa 1, State, Ci ty or County sources, or other governmenta 1 agenci es, and
applied or expected to offset in whole or in part any of the costs incurred by
OPERATING AGmCY in conducting current or prospective projects or business
activities, including, but not necessarily limited to, the prOject or business
activity which is the subject of this Contract. Such statement shall reflect
the name and a description of such project or business activity, the dollar
amount of funding provided, or to be provided, by each and every governmental

agency to each such project or business activity, and the full name and address
of each such governmental agency. During the term of this Contract, OPERATING
AGENCY shall prepare and file a similar written statement each time it receives
fundi ng from any governmE:nta 1 agency whi ch is in addition to that revenue
disclosed in OPERATING AGENCY'S initial revenue disclosure statement hereunder.
Such statement shall be filed with the County Department of Housing and
Community Development within fifteen (15) calendar days following receipt of
such additional funding. OPERATING AGENCY shall make available for inspection
and audit to COUNTY'S and CITY'S representatives, upon request, at any time
during the duration of this Contract and during a period of five (5) years
thereafter, all of its books and records relating to the operation by it of
each project or business activity which is funded in whole or in part with
governmental monies, whether or not such monies are received through COUNTY and
CITY. All such books and records shall be maintained by OPERATING AGENCY at a
location in San Bernardino County. Failure of OPERATING AGENCY to comply with
the requirements of this section of the Contract shall constitute a material
breach of contract upon which COUNTY and CITY may cancel, terminate, or suspend
this Contract.
14. JOINT FUNDING. For programs in which there are sources of funds in
addition to HUD CDBG funds, OPERATING AGENCY shall provide proof of such
funding. COUNTY and CITY shall not pay for any services provided by OPERATING
AGENCY which are funded by other sources. All restrictions and/or requirements
provi ded in thi s Contract relative to accounting, budgeti ng, and reporti ng
apply to the total program regardless of funding sources.
15. PROGRAM INCOME. Program income represents gross income earned by
OPERATING AGENCY as a resul t of the activity funded under the terms of thi s
contract. Such earnings with the exception of interest earned on advancement
of funds, shall be used first for eligible program activities, and credited
towards the subsequent advancement, or shall be remitted to COUNTY. Interest
earned on funds advanced under this contract shall be paid to COUNTY.
16. NOTICES. All notices shall be served in writing. The Notices to
COUNTY and CITY shall be sent to the following address:

17. ASSIGNMENT. This Contract is not assignable by OPERATING AGENCY
without the express written consent of COUNTY. Any attempt by OPERATING AGENCY
to assign any performance of the terms of this Contract shall be null and void
and shall constitute a material breach of the Contract.

18. TERMI NATION AND TERMINATION COSTS. Thi s Contract may be termi nated
at any time by either party upon giving their (30) days notice in writing to
the other party. COUNTY Department of Housing and Community Development is

hereby empowered to give said notice subject to ratification by the COUNTY
Board of Supervisors. COUNTY and CITY may immediately terminate this Contract
upon the termination, suspension, discontinuation or substantial reduction in
HUD CDBG funding for the Contract activity, or if for any reason the timely
completion of the work under this Contract is rendered improbable, infeasible
or impossible. In such event, OPERATING AGENCY shall be compensated for all
services rendered and all necessarily incurred costs performed in good faith in
accordance with the terms of this Contract that have not been previously
reimbursed, to the date of said termination to the extent HUD CDBG funds are
ava i1 ab 1 e.
19. FISCAL LIMITATIONS. The United States of America through HUD may in
the future place programmatic or fiscal limitation(s) on CDBG funds not
presently anticipated. Accordingly, COUNTY and CITY reserves the right to
revise this Contract in order to take account of actions affecting HUD program
funding. In the event of funding reduction, COUNTY and CITY may reduce the
budget of this Contract as a whole or as to cost category, may limit the rate
of OPERATING AGENCY'S authority to cOmmit and spend funds, or may restrict
OPERATING AGENCY'S use of both its uncommi tted and its unspent funds. Where
HUD has directed or reauested COUNTY to implement a reduction in funding, in
whole or as to cost category, wltn respect to funding for this Contract, COUNTY
Department of Housing and Community Development may act for COUNTY in
implementing and effecting such a reduction and in revising the Contract for
such purpose. Where COUNTY and CITY have reasonable grounds to question the
fiscal accountability, financial soundness, or compliance with this Contract of
OPERATING AGENCY, COUNTY and CITY may act to suspend the operation of this
Contract or up to sixty (60) days upon three (3) days notice to OPERATING
AGENCY of his intention to so act, pending an audit or other resolution of such
questions. In no event, however, shall any revision made by COUNTY and CITY
affect expenditures and legally binding commitments made by OPERATING AGENCY
before it received notice of such revision, provided that such amounts have
been committed in good faith and are otherwise allowable and that such
commitments are consistent with HUD cash withdrawal guidelines.
20. USE OF FUNDS FOR ENTERTAINMENT, MEALS OR GIFTS. OPERATING AGENCY
certifies and agrees that it will not use funds provided through this Contract
to pay for entertainment, meals or gifts.
21. TRAVEL AND CONFERENCE RESTRICTIONS. OPERATING AGENCY certifies and
agrees that travel and conference expenses for persons other than employees of
OPERATING AGENCY, will not be paid by funds provided through this contract. No
travel expenses for out-of-state travel shall be included in this contract
unless specifically listed in the Budget Exhibit 3 of 4, which is attached and
incorporated herein. OPERATING AGENCY further agrees that any travel expense
incurred by OPERATING AGENCY which is not listed in the Budget Exhibit 3 of 4
shall not be paid by funds provided through this contract unl~ss prior written
approval of the Director of COUNTY Department of Housing and Community
Development has been obtained.
22. HOLD HARMLESS. OPERATING AGENCY shall indemnify and hold the COUNTY
and CITY, its offi cers, agents and employees, harmless from and aga i ns t any
loss, liability, claim, or damage that may arise or result from activities of
OPERATING AGENCY, its offi cers, agents, and employees; and, OPERATH.G AGENCY
shall, at its own cost, expense and risk, defend any legal proceedings that may
be brought a9ainst County and CITY, its officers, agents and employees, on any

liability, claim or demand and satisfy any judgement that may be rendered
against any of them arising or resulting from activities of OPERATING AGENCY,
its officers, agents and employees. OPERATING AGENCY shall assume liability
for all and any direct expense incurred in providing services pursuant to this
Contract and shall assume any and all responsibilities for loss or damage
resulting from negligence, injury, illness or disease arising out of the
provision of services. OPERATING AGENCY, however, is obligated to promptly
notify COUNTY and CITY in writing of the incident of any such adverse
situation.
OPERATING AGENCY shall indemnify and hold harmless COUNTY and CITY against any
liability, claims, losses, demands, and actions incurred by COUNTY and CITY as
a result of the determination by the United States Department of Housing and
Urban Development or its successor that activities undertaken by OPERATING
AGENCY under the program or programs fail to comply with any laws, regulations
or pol i cies app 1 i cab Ie thereto or that any funds bi 11 ed by and di sbursed to
OPERATING AGENCY under this agreement were improperly expended.
23. CONFLICT OF INTEREST. OPERATING AGENCY, its agents and employees
shall comply with all applicable Federal, State, COUNTY and CITY laws and
regulations governing conflict of.interest. To this end, OPERATING AGENCY will
make available to its agents and employees copies of all applicable Federal,
State and COUNTY and CITY laws and regulations governing conflict of interest.
OPERATING AGENCY shall furnish to COUNTY, prior to execution of this Contract,
a written list of all current or proposed subgranteesisubcontractors, vendors,
or personal service providers, including subsidiaries of OPERATING AGENCY.
Thi s list shoul d be 1 imi ted to those subgrantees/subcontractors, vendors or
personal service providers, including subsidiaries of OPERATING AGENCY, which
will receive $10,000 or more during the term of this Contract. Such a list
shall include the names, address, telephone numbers and identification of
principal party(ies) and a description of services to be provided. During the
term of this Contract, OPERATING AGENCY shall notify COUNTY in writing of any
change in the 1 i st of subgrantees/subcontractors, vendors, personal servi ce
providers or subsidiaries of OPERATING AGENCY within fifteen (15) days of any
change.
24. 'DISCRIMINATION. No person shall, on the grounds of race, sex, creed,
color, religion, or national origin, be excluded from participating in, be
refused the benefi ts of, or otherwi se be subjected to di scrimi nati on in any
activities, programs, or employment supported by this Contract.
25. BUDGET MODIFICATIONS. COUNTY Department of Housing and Community
Development Director or his designee may grant budget modifications to this
contract for the movement of funds within the budget categories identified in
Budget Exhibit 2 of 4, when such modifications:

f. Related to salaries, are in accordance with applicable
salary ordinances or laws.
26. TIME OF PERFORMANCE MODIFICATIONS. COUNTY Department of Housing and
Community Development Director may grant time of performance modifications to
this Contract when such modifications:
a. In aggregate do not exceed twelve (12) calendar months;
b. Are specifically requested by OPERATING AGENCY;
c. Will not change the project goals or scope of services;
d. Are in the best interests of COUNTY, CITY and OPERATING
AGENCY in performing the scope of services under this
contract; and
e. Do not alter the amount of compensation under this contract.
27. INDEPENDENT CONTRACTOR. All parties hereto in the performance of
thi s Contract wi 11 be acti ng in an independent capaci ty and not as agents,
employees, partners, joint ventures, or associates of one another. The
emp 1 oyees or agents of one party shall not be deemed or construed to be the
agent or employees of the other "p~rty for any purpose whatsoever.
28. AMENDMENTS: VARIATIONS. This writing with attachments, embodies the
whole of the agreement of the parties hereto. There are no oral agreements not
contained herein. Except as herein provided, addition or variation of the
terms of this Contract shall not be valid unless made in the form of a written
amendment to this Contract formally approved and executed by both parties.
29. PURCHASE AND INVOICE DEADLINES. Purchase of equipment or property
must be completed before the last three (3) months of the initial performance
period period and all equipment bills are to be paid before the last two (2)
months of this period. No expendable or non-expendable property or equipment
is to be purchased during the final three (3) months of the initial performance
period. OPERATING AGENCY must complete all purchases of suppl ies before the
last two (2) months of the initial performance period and pay all supply bills
before the final month of the initial performance period. Invoices for all
obligations incurred under this Contract must be submitted to COUNTY'S
Department of Housing and Community Development Fiscal Division within sixty
(60) days from when the indebtedness is occurred or they may be subject to
disallowance. Invoices which have not been submitted for payment prior to the
termination date of the initial performance period, must be forwarded to
COUNTY'S Department of Housing and Community Development Fiscal Division within
sixty (60) days after the initial performance period termination date or they
may not be honored. Exceptions to the preceding limitations require prior

The initial performance period commences upon execution of this contract and
terminates June 30, 1985, unless extended under provisions of section 26, Time
of Performance Modification.
30. ACQUISITION OF SUPPLIES AND E UIPMENT. OPERATING AGENCY may purchase
from a relatea agency organlzatlon on y 1: a prior authorization is obtained
in writing from COUNTY, (b) no more than maximum prices of charges are made and
no less than minimum specifications are met as provided in writing by COUNTY,

(c) a community related benefit is derived from such OPERATING AGENCY related
acquisition. and (d) no conflict of interest for private gain accrues to
OPERATING AGENCY or its employees. agents or officers.
COUNTY reserves the right to disallow any purchase from any vendor of supplies,
equipment. non-expendable property or expendable property which is purchased in
whole or in part with funds provided by this contract. OPERATING AGENCY may
seek pri or approval of COUNTY for any such expendi tures. and pri or approval
which is granted shall be binding on COUNTY unless such expenditure violates
federal law or regulations or is disallowed by HUD.
31. MONITORING AND EVALUATION. COUNTY will monitor. evaluate and provide
guidance to the OPERATING AGENCY in the performance of this Contract.
Authorized representatives of COUNTY. CITY and HUD shall have the right of
access to all activities and facilities operated by OPERATING AGENCY under this
Contract. Facilities include all files. records. and other documents related
to the performance of this Contract. Activities include attendance at staff.
board of directors. advisory committee and advisory board meetings and
observation of on-going program functions. OPERATING AGENCY will insure the
cooperation of its staff and board members in such efforts. COUNTY Department
of Housing and Community Development Director or his designee will conduct
periodic program progress reviews. These reviews will focus on the extent to
whi ch planned program has been impl emented and measurable goals achieved.
effectiveness of program management. and impact of the program. By the first
of each month, OPERATING AGENCY shall submit a Monthly Status Report on
progress of said project to COUNTY Department of Housing and Community
Development.
32. USE OF FUNDS. Funds allocated pursuant to this Contract shall be
used exclusively for costs included in OPERATING AGENCY'S program budget.
Contract funds shall not be used as security or to guarantee payments for any
non-program obligations. nor as loans for non-program activities.
33. RELIGIOUS PROSELYTIZING OR POLITICAL ACTIVITIES. OPERATING AGENCY
agrees that lt will not perform or permlt any religious proselytizing or
political activities in connection with the performance of this Contract.
Funds under this Contract will be used exclusively for performance of the work
required 'under this Contract and no funds made available under this Contract
shall be used to promote any religious or political activities.
34. AUDITS. OPERATING AGENCY"S program will be audited in accordance
with COUNTY'S and CITY'S policy and funding source guidelines. Audit may also
be conducted by Federal, State or local funding source agencies. COUNTY or its
authorized representatives shall, at all times. have access for the purpose of
audit or inspection to any and all books, documents papers, records, property,
and premises of OPERATING AGENCY. OPERATING AGENCY'S staff will cooperate
fully with authorized auditors when they conduct audits and examinations of
OPERATING AGENCY'S program. If indications of misappropriation or
misapplication of the funos of this Contract cause COUNTY to require a special
audit. the cost of the audit will be encumbered and deducted from this Contract
budget. Should COUNTY subsequently determine that the special audit was not
warranted, the amount encumbered will be restored to the Contract budget.

The San Bernardino County Community Housing Resource Board (CHRB) will assist the local
Real Estate Boards of the 15th California Association of Realtors (CAR) in achieving the
goals of the Voluntary Affirmative Marketing Agreement (VAMA).
These goals will principally benefit low'and moderate income people by insuring equal
housing opportunities.
The CHRB will assist the Board of Realtors who are signatories of the VAMA by providing
services in the following areas:
~Advertising and marketing;
~ (making information public regarding the goals of fair housing and all services related to
housing). Expanding public awareness of housing opportunities.
-Training and evaluation;
Assessing community fair housing needs; developing cooperative solutions to problems
associated with the implementation of the VAMA.
-Minority and Women Involvement;
Expanding minority involvement in the industry realtor boards and housing industry to
sponsor educational component.
-Outreach and recruitment;
Assessing the effectiveness of the VAMA assistance in identification of local problems
and issues that impede equal housing opportunities;

Participation on the Community Housing Resource Board:
-Promotes understanding and goodwill between the housing industry, minority groups and the
community at large;
-Establishes an additional resource through which to gain greater access to the minority
communities throughout the County of San Bernardino;
4C>-Wil1 enhance the image of the participating cities and the county for prospective
businesses and industries planning to locate in the area;
-Promotes voluntary compliance with Civil Rights Laws, thereby creating and fostering a
greater awareness of Fair Housing Laws.
The CHRB will work with state and local governments, Realtor Boards, and local citizens to
develop a voluntary fair housing strategy for the County of San Bernardino.
The CHRB's approach is to strengthen the education efforts of the Fair Housing Laws.
The CHRB will assist the Baldy View Region of the Building Industry of Southern California,
Inc. in implementation of the Voluntary Affirmative Marketing program and its signatories
in the following areas:
1. Development and maintenance of a public information program to inform the entire
community served of the objectives of the VAMP; including information directed
specifically to the minority communities.
2. Coordination of advertising and marketing for areas; provide assistance with quarterly
reports to HUD; analysis of marketing data for each signatory builder; and to assist
the Community Liaison Officer of the Baldy View Region BIA in complying with the VAMP.
