Authorization is hereby granted to execute, on b e half 0 f the C i t y, aCe r t i f i cat ion 0 f Rig h t- 0 f- Way i n con for m - ance with Statement No. (2) relative to Construction of a bridge, traffic signals and extension of Del Rosa Drive, from 9th Street to Baseline Street, under FAU Project No. R063, a copy of which is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length herein. SECTION 2. The City of San Bernardino agrees to hold the State of California harmless from any liability which may result in the event the Right-of-Way is not clear as certified; the City of San Bernardino agrees that, at the request of the State, it will assume full responsibility for the conduct of the defense or provide such assistance as the State may require and will pay any judgements issued against the State and all costs in connection with the defense.
