Synopsis of Previous Council action:
On June 6, 1985, the Legislative Review Committee recommended the
following traffic control restrictions in the Commercenter
Business Complex:
1. Adopt an ordinance establishing commercial vehicle weight
limi ta tions.
2. Establish a tow-away zone on commercial vehicle weight
limitations.
Recommended motion:
1. Adopt resolution.
2. Waive further first reading of ordinance and layover for
final adoption.

JUSTIFICATION FOR PLACEMENT ON SUPPLEMENTAL AGENDA
This item was recommended for approval by the Legislative Review
Committee at its June 6, 1985 meeting, thereby not allowing
sufficient time to prepare it for the regular agenda deadline of
June 7, 1985.

STAFF REPORT
The attached resolution amends Resolution No. 3985 to provide a
tow-away zone for vehicles exceeding a weight limit of ten
thousand pounds in the Commercenter Business Complex. Vehicle
Code Section 22651, establishing circumstances permitting
removal of vehicles, provides for removal .Whenever any vehicle
is parked or left standing where local authorities; by
resolution or ordinance, have prohibited parking and have
authorized the removal of vehicles. No vehicle may be removed
unless signs are posted giving notice of the removal.. It is
necessary, therefore, to prohibit parking by vehicles exceeding
a weight limit of ten thousand pounds in order to establish a
tow-away zone.
The proposed resolution also repeals Section Four of Resolution
No. 3985, which section provides that the penalty for violating
any provisions of the resolution shall be a misdemeanor. The
San Bernardino Municipal Code is the citing authority for all
traffic violations. The Code provides that a violation of
Section 10.16.020, parking prohibited at any time, is an
infraction.
The attached ordinance prohibits the use of streets in the
Commercenter Business Complex by vehicles exceeding a maximum
gross weight limit of ten thousand pounds. Vehicle Code Section
35703 exempts vehicles for ingress and egress for pickups and"
deliveries.

UPON CERTAIN DESIGNATED STREETS OR PORTIONS THEREOF. . .w,
ESTABLISHING A NO PARKING AND TOW-AWAY ZONE FOR VEHICLES EXCEEDING
A MAXIMUM GROSS WEIGHT LIMIT OF TEN THOUSAND POUNDS IN THE
COMMERCENTER BUSINESS COMPLEX, AND REPEALING SECTION FOUR
RELATING TO PENALTY PROVISIONS.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. Resolution No. 3985, which prohibits parking upon
. certain designated streets or portions thereof, is amended by
adding thereto Section One and One Quarter to read:
WSECTION ONE AND ONE QUARTER. In accordance with Section
10.16.020 of the San Bernardino Municipal Code, it is hereby found
and determined that the parking of any vehicle exceeding a maximum
gross weight limit of ten thousand pounds, except when such
vehicle is loading or unloading merchandise or passengers, will
create a traffic hazard, and it shall be unlawful for the operator

ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION
"10.24.190 SUBSECTION B OF THE SAN BERNARDINO MUNICIPAL CODE TO
'INCREASE THE GROSS WEIGHT LIMIT PROHIBITION FROM SIX THOUSAND
POUNDS TO TEN THOUSAND POUNDS ON CERTAIN STREETS, AND TO PROHIBIT
VEHICLES EXCEEDING TEN THOUSAND POUNDS ON FOUR ADDITIONAL STREETS.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:
SECTION 1. Section 10.24.190 Subsection B of the San
Bernardino Municipal Code is amended to read:
-B. Pursuant to the authority and restrictions of Vehicle
Code Sections 35101, et seq., no person shall operate or drive any
vehicle exceeding a maximum gross weight limit of ten thousand
pounds upon the following streets, and the Director of Public
Services shall cause appropriate signs to be erected giving notice
of such weight limitation prohibition:
