1. RESOLUTION AMENDING RESOLUTION NO. 13157 ENTITLED IN
PART -RESOLUTION . .. IMPROVING THE ENVIRONMENTAL REVIEW
PROCEDURES FOR THE CITY OF SAN BERNARDINO. . . - BY AMENDING
SECTION 7 (d) OF EXHIBIT -I- TO EXEMPT FROM ENVIRONMENTAL
REVIEW GRADING PERMITS FOR THE EXCAVATION OF LESS THAN 18,888
CUBIC YARDS OF EARTH AND LESS THAN FIFTEEN PERCENT SLOPE, AND
BY DELETING SECTION 7(i) OF EXHIBIT -I- TO PERMIT ENVIRON-
MENTAL REVIEW OF REVIEW OF PLANS - The Committee recommended
the proposed resolution be accepted. City Attorney, City
Planner and City Engineer will coordinate on final wording
and present to Council. '
2. ORDINANCE EXTENDING THE AUTHORITY OF SECURITY GUARD
PERSONNEL OF CENTRAL CITY MALL TO ENFORCE SAN BERNARDINO
MUNICIPAL CODE SECTION 18.16.218 - The Committee recommended
that signage for project be approved and authority to enforce
the code be granted with existing personnel.
3. REQUEST TO ESTABLISH INTERIM SCHOOL FACILITIES
FINANCING ORDINANCE FOR THE SAN BERNARDINO UNIFIED SCHOOL
DISTRICT - The Committee recommended an agreement similar to
that which has been established between the District and
other cities be prepared by the City Attorney in coordination
with the Planning Department Director and Mr. Frank Ayala of
the San Bernardino Unified School District.

4. COMMERCENTER BUSINESS COMPLEX TRAFFIC CONTROL - The
Committee recommended that a city ordinance be adopted
establishing a 5-ton weight limit, and a tow-away zone with
proper signing.

At the May 13, 1985 Council meeting, the proposed amendments to
Resolution Nos. 83-48 and 13157 were referred to the Legislative
Review Committee.
At the June 6, 1985 Legislative Review Committee meeting, the
amendment to Resolution No. 13157 was recommended for adoption.
(Resolution No. 83-48 does not require an amendment.)

RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION
NO. 13157 ENTITLED IN PART "RESOLUTION . . . IMPROVING THE
ENVIRONMENTAL REVIEW PROCEDURES FOR THE CITY OF SAN BERNARDINO
. . ." BY AMENDING SECTION 7 PARAGRAPH (d) OF EXHIBIT "I" TO
EXEMPT FROM ENVIRONMENTAL REVIEW GRADING PERMITS FOR THE
EXCAVATION OF LESS THAN 10,000 CUBIC YARDS OF EARTH, FOR GRADING
ON LESS THAN FIFTEEN PERCENT SLOPE, OR FOR PROJECTS WHICH ARE
SUBJECT TO ENVIRONMENTAL REVIEW; BY DELETING SECTION 7
PARAGRAPH (i) OF EXHIBIT "I" TO PERMIT ENVIRONMENTAL REVIEW OF
REVIEW OF PLANS; AND PROVIDING THAT THE ENVIRONMENTAL REVIEW
COMMITTEE SHALL NOT CHARGE A FEE FOR A NEGATIVE DECLARATION FOR A
GRADING PERMIT.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 0
SAN BERNARDINO AS FOLLOWS:
SECTION 1. Section 5 of Exhibit "I" of Resolution No. 13157
is amended by adding thereto Paragraph (c) to read as follows:
"(c) A fee shall not be charged for a negative declaration
for a grading permit."
SECTION 2. Section 7 Paragraph (d) of Exhibit "I" of
Resolution No. 13157 is amended to read as follows:
"(d) Grading permits for the excavation of less than 10,000
cubic yards of earth and lor for grading of an existing slope with
less than 15% natural grade, or grading permits for projects
which are subject to environmental review."
SECTION 3. Resolution No. 13157 is hereby amended by
deleting Section 7 Paragraph (i) of Exhibit "I".

Bernardino 11lJnicipal Code i~ amended to read:
"A. Sec.llrity p;1l8Td personnel, who shall be off duty or
retired police officers or reserve police officers, employed by
the Redevelopment Agency of the City of San Bernardino pursuant
to an agreement he tween said Agency and the City, relating to a
security guard program, are authori.zed and empowered to arrest
and issue notices to apnear for violations of the orovisions of
Chapters 5.01~, 8.15, 9.l~8, 9.49, 12.114, and Sections 9.1L030 and
10.16.210 for incidents arising in the Central City Mall and
ou~lic areas in, adjacent to, or immediately surrounding said
mall pursuant to Section [;,16.5 and Chapters 5C and 5D of Part 2,

There is a good possibility that a duplication exists between
those pending in the Building and Safety Department and those
pending Sewer Ca acit Ri hts.
I would suggest that twelve units and below be the .cut-off.
for the 68 day moritorium before charging the School District
Fees.
